Somewhere In The Ether…

Jesse Dimmick, a fugitive facing a murder charge, abducted a Kansas couple in September 2009. At some point he fell asleep and they escaped. They sued Dimmick for over $75,000 in damages. His response was to countersue for breach of contract (I shit you not!) In fact the scumbag claimed that he and the couple had a legally binding oral agreement for them to hide him from the police(!!!)

Thankfully, his case was promptly dismissed.

Do you know of any similarly ridiculous legal cases?

America does love a good lawsuit it seems;

As an example: Jonathan Lee Riches is presently languishing in a Kentucky jail but has nonetheless made good usage of his time in launching almost 4,000 lawsuits!

Amongst those he has launched legal action against: Adolf Hitler, The Eiffel Tower, The Garden of Eden and Pluto(!!)

In 2009, the Guinness Book of World Records tried to list him as the most litigious individual in history.

.....So he sued them too.

In 2010 he got his comeuppance though when the US Attorney’s Office in Kentucky sued him for wasting judicial resources

Got to admit tho their court cases are broadcast publicly so I might have a nose on YouTube later & see what crazy ones there are. I'm currently following the daybell & vallows case & Leticia stauch one

From talking to an American Legal Type friend, Countersuing is standard practice in most circumstances.

Obviously some attempts to countersue are more ridiculous than others but in many cases it's more a tactic used to try and derail the original claim/case.

Here’s another rather funny one:

In 1991, Richard Overton sued Anheuser-Busch for $10,000 claiming the company had falsely advertised the scene of beautiful women and men enjoying themselves while drinking beer. Overton was upset when he discovered this type of lifestyle was not a reality from merely drinking beer.

Much to his dismay but hardly surprisingly, the case was promptly dismissed

Playboy Rolf Eden sued a teenager for ageism because she refused to have sex with him(!)

In 2007 the German strip club owner, then 77, had his advances rejected by 19 year old Katharina Weiss.

Thankfully, the case was dismissed

I remember hearing about that.

There was a similarly bizarre one involving a chap who snuck into an Orca ‘enclosure’ in a safari park one night and who was subsequently killed by the said whale.

Apparently his family initially tried to sue the park for not erecting proper warning signs around the tank explaining the dangers of swimming with Killer Whales

In 1998, a man from Albuquerque filed a lawsuit against his former girlfriend for impregnating herself without his consent. Plaintiff Peter Wallis accused defendant Kellie Smith of fraud and breach of contract for “intentionally acquiring and misusing his sperm.”

According to Wallis, Smith had given her word that she would use the Pill. Then she intentionally stopped taking it to have his baby. This resulted in Wallis being the father of a baby without his knowledge or consent to the plan. His plea for money was based on the grounds that he would have to pay the expenses to support a child whom he did not want.

On the defendant’s side, lawyers argued that Smith could not have “stolen” the sperm because it was transferred during a voluntary act. Therefore, it should be legally classed as a gift and Wallis no longer had any right of possession.

Upon hearing of the pregnancy, Wallis proposed to Smith and requested that she get an abortion.[1] However, Smith declined both offers and moved in with her parents instead.

Contrary to Wallis’s argument that women have all the choices and that it wasn’t fair for him to have to pay up, Smith was within her rights with both rejections and therefore won the case.

Here’s a rather cruel one:

When Jian Feng from China, first laid eyes upon his newborn daughter, far from being elated and proud, he was rendered instantly aghast at her appearance, describing her to a court as ‘incredibly ugly’ and pointed out that she bore no resemblance to either himself or her mother.

He subsequently accused his wife of cheating on him. At that point, she admitted she had several plastic surgeries before they had met. He sued on the grounds of false pretenses, claiming she misled him by hiding her cosmetic history.

He actually won the case (!!!) and his wife was made to pay him more than $120,000(!!!!!)

"A 27-year-old Indian man plans to sue his parents for giving birth to him without his consent.

Mumbai businessman Raphael Samuel told the BBC that it's wrong to bring children into the world because they then have to put up with lifelong suffering.

Mr Samuel, of course, understands that our consent can't be sought before we are born, but insists that "it was not our decision to be born"."

A man in Los Angeles was awarded a whopping $74,000 plus medical expenses when his neighbour accidentally ran over his hand with his car.

Pretty straight forward thus far?

Well, it turned out that the neighbour who was reversing the car at the time and inadvertently ran over the guys hand was unaware that he was in the process of stealing his hubcaps at the time!

A Romanian murderer hit headlines in 2005 when he decided to.....wait for it.....

take God to court(!!!!)

Yes indeed; Arguing that his baptism had been a binding contact broken by God, the man attempted to sue God for failing to protect him from all evils.

The case was predictably, duly dismissed

A popular misconception.

She actually had to have skin grafts, was in hospital for eight days, and disabled for two years. Evidence was presented that McDonald’s was serving drive through coffee 12-20 degrees hotter than competitors and 700 others had been burnt.

Not saying she wasn’t a klutz for dropping it, but you’ve got to look at the whole case. The judge reduced the compensation also.

Allen Ray Heckard from Portland decided to sue basketball legend Michael Jordan for more than $800 million.

Why? Well Heckard claimed that he had been confused for Jordan every day for over fifteen years and that as a result, it had caused him permanent psychological injury and emotional suffering.

Heckard later dropped the charges (after looking in a mirror perhaps?)

Here’s a great one:

Prison inmate Robert Lee Brock actually launched a lawsuit against himself for a staggering $5 million.

He claimed that he violated his religious beliefs and got himself arrested and that since he had no income because he was in jail, the state should pay the cost as he was in turn after all, a ward of the state.

The adjudicating (and likely somewhat bemused) Judge promptly dismissed the case.

A magician named David Roller sued the illusionist David Copperfield for patent infringement. Mr. Roller alleged that he had patented his ‘godly powers’ and that Mr. Copperfield had used them without his permission.

When Copperfield filed a motion to dismiss the suit, contending that no such patent existed, Mr. Roller filed an amended complaint. This time he alleged that Mr. Copperfield and several other individuals had conspired to murder him (holy shit!) The court noted that the plaintiff was unable to provide any evidence to support this claim and that furthermore, seeing as he had a long history of filing frivolous suits (including previous claims against Copperfield) they dismissed Roller's case and barred him from filing any similar claims in the future.

.....perhaps David Copperfield used his superior magical powers to swing the case his way?

the company I work for has been sued dozens of times by crazy people who think they know the law. Never lost a case though and we never asked for our costs to be covered by the other party. The amount of paperwork it creates is however staggering each time. I'd just wish solicitors were required to give plaintiffs a 'probability score' of winning, or that the judge can throw out a case much much earlier on.

There was a guy (in India I think) who sued the deodorant maker Lynx for false advertising claiming that although he regularly used their products women were not attracted to him.
