Contract help, retention scheme headache

Hey all, so our boss never gave us a contract 18 months ago, produced one now to us, the clause about lay offs has us confused and with employees being furlough, we are worried about not being able to qualify because of the wording and don't want to sign it until we are sure we aren't being screwed (plus there are other things in it that we are sure isn't right but at the moment we are just worried about that).

I've called acas who didn't seem much help. Our boss is as useless as a box of frogs.

We live on site, if we don't have any work legally (according to the contract wording) he can ask us to leave as we are living here as a licensee or something and not a tenant and we don't want to upset him and he says leave (but that would be a wank thing to do as we are providing security, still answering the phone and emails).

If anyone has any help they can give us, we would really love to hear it.

A new contract during a crisis? He, hopefully, is on dodgy ground. If you go to gov.uk you should be able to find your rights. Normally, an unwritten contract takes place if you have worked x amount of hours for x days a week.

Also, if he tries to evict you, have a look re covid and evictions, there was something in the news about a stay of evictions.

If you've done regular work for him, then that's as good as a contract.

If he furloughs you, then you are still his employee. You retain your rights and benefits, but you must not do any work at all. That way, you will get paid 80% of your salary by the Goverment.

I would also think that he would have some problems with Work and Pensions as you are entitled to and should have been given a contract having worked there that long before now.

Your boss may be trying to help you. I don't know the ins and outs but you might find your boss is trying to get you the 80% for furloughed workers rather than let you go.
