Very sad story here, read it all, so many examples in it of the challenges people face now...the mum chose not to get a vax but chose to get infected so she was allowed to go to theatre and music etc...

That would make sense if most venues weren’t severely against passes, most prefer negative tests, but the government have taken their right to impose their own rules by forcing the passes to be an entry requirement. |

For it to be discrimination it needs to infringe one of the protected characteristics, which are:
Age
Disability
Gender reassignment
Marriage and civil partnership
Pregnancy and maternity
Race
Religion and belief
Sex
Sexual orientation.
Which one would that be? and please dont say belief (as in I dont believe in this vaccination or simply dont want it etc) That standpoint has already been tested in law 'grainger v nicholson' & Farrell v South Yorkshire Police Authority and found not to meet the test of a belief which is:
The belief held must be genuinely held.
It must be a belief, not an opinion or viewpoint based on the present state of information available.
It must be a belief as to a weighty and substantial aspect of human life and behaviour.
It must attain a certain level of cogency, seriousness, cohesion and importance.
It must be worthy of respect in a democratic society, not be incompatible with human dignity and not conflict with the fundamental rights of others
Simply having an opinon that the vaccination is not for you (no problem with that) does not constitute a belief.
And I suppose finally, even if it was 'discrimination' it can still be lawful and nothing you can do about it.

It is possible as it would fall under 'belief' as long as you could satisfy a court that is was a genuine belief from the criteria previously posted then there may well be an argument.
I do know that this has been found to be discrimination in an Employment Appeals Tribunal (GMB v Henderson) which found someone had been dismissed partly on their political belief.
As ever with law and case law it is forever evolving. |
