should all that work in care homes be told no vaccine no job ....

300 staff in group only 7 have said no

owners have said no vaccine no job and are looking to change contracts as are many others..

other staff refusing to work with those who wont have the vaccine...

familys of residents and residents themselves asking only for care workers ho have had vaccine ...

the law is very grey in this area and to be honest seems more on the employers side because its health care...

so those of you that work in care has this subject come up at all yet ?? how do you feel ?? are you family of someone in care ifso how do you feel too ...

keep it nice and do bash others opinions as we all have a rights to answer in these free forums

All of our residents and staff have been vaccinated, no declines in our PCN and we have over 500 care beds

I can see where relatives are coming from because obviously they want their loved ones to be cared for and protected as much as possible.

However because the vaccine only seems at the moment to be proven to protect the individual who has received the vaccine I think it would be tricky to prove these people are putting their relatives at risk.

Iv no idea where the law stands on this but I do know that certain jobs require you to have had the hepatitis vaccine so there must be some sort of employment law that allows this I would guess.

I think that in these situations that they should be taking them. My friend works at a care home and has always had to have the flu jab.. and this is no different.

I think many places will end up making it a reason to deny employment.. as to the legality of it I haven't got a clue.

As I've just posted elsewhere, it's too late for my dear old mum. Given it by a carer... I'm raw and emotional. Sometimes we have to do what's right rather than what's easy.

However, if I were a carer.... Id probably want a bit more evidence what kind of difference it makes.

Right now I'd suggest testing and protocols are a better way of keeping residents safe.

Ie all staff tested everyday. All staff clean uniform and air locked changing procedures.

As and when evidence of how much impact of vaccine has on transmission... Sure

. Do the right thing. As someone whose gonna lose his mum in the next 24 hours....I'd do anything reasonable to have stopped her catching it. And having a jab is pretty reasonable.

"My daughter had the vaccine last Sunday she tested positive yesterday"

It takes 2-3 weeks after the vaccine for maximum antibody protection and even then you can still catch it. The vaccine helps you body recognise the virus and respond faster therefore should stop you getting seriously ill.

I'm a carer and we have had our vaccines both residents and staff. A few people refused to get theirs and that is their choice. You can't force people to get a vaccine. Everyone has a right to make that decision for themselves. I got mine because as far as I'm concerned the pros outweighed the cons.

If there will be any repercussions in the future I don't know but at the moment everyone is working away together just as we have up until now. Full ppe is still worn and all guidelines are being followed.

I never said anyone was forcing anyone. I said people can't be forced that's all.

We all have choices. My choice is to work with my collegues just as I have all the way through this. I haven't taken notes on who has or hasn't taken the vaccine as that is none of my business. We continue to follow all the guidelines and hope it keeps working for us.

Yeah as we've seen in these fora. It has the potential to be divisive. But illness and death tends to focus the thoughts a bit. I imagine it will arrive at a balance at some point. But we just need more evidence to try to convince people to make the right choice.

couple, us we him her.

All of the care homes that I have to visit make us do a test before being allowed to enter and work in the building.

One made me test even though I was working outside should I just need to use the toilet I'll still have to enter the building.

In my opinion this is definitely a step in the right direction.

I had 3 tests in less than a 48hr period last week.

I work in a care home and have been vaccinated

Some staff have chosen not to be, as have some residents

It's encouraged, but everyones right to choose what they do or do not put into their bodies is rightly respected.

That's how it should be

Everyone has a right to bodily autonomy, at least they do where I work, thankfully

Exactly it is normally people that work in quite specialised settings though.

I can definitely see a time when having a vaccine is a requirement to be considered for a vacancy.

I'm not sure what will happen with people who have existing contact that refused to take the vaccine and how that can be enforced.

I have a feeling we will find out very soon though.

I'm not sure where you work and in what setting and unsure that is the case in a lot of work places and will continue to be.

I am talking about people specifically that work with very high risk groups (don't mean covid)

I have applied for jobs where having the hepatitis vaccine has been a requirement.

I do not think it will be blanket policy for every care home However I am sure there will be some that choose to make it a requirement for employment.

Understandable for certain job rolesI'd imagine

However, not sure any employer could suddenly impose mandatory vaccination on existing employees and highly doubt many, if any, will try

I think the OP mentioned about changing contracts but I don't know enough about employment law to know if that's legally right.

I presume in time it will be part of your application as it is now with any health care jobs (to prove your vaccination history).

So yeah, I think it’ll happen

Wether that’s good or not... each to their own I guess but it’s no different to proving other vaccines now.... x

It will happen by default- all new workers will be required to have already have it or they won’t be appointed - it’ll be in the job description

Existing employees won’t be ‘forced’ but can be redeployed in non patient facing roles until the point they decide to leave

I guess it could happen anywhere because I know some supermarkets have redeployed mask exempt people so they are either not customer facing or at the till behind a screen.

Be a lot easier to do in larger work environments I guess which involve more varied job roles in large numbers. In settings like care homes it wouldn't be so practical, as non patient facing roles are in the minority

I imagine it will be become a requirement in many jobs. All new employees will be required to have the jab or they are not employed. Those with more than 2 years service are protected so they will not be forced but if for example they are dealing with at risk groups they will be sidelined into office jobs. Then as firms try to tighten their belts due to loss of income they will look to make redundancies and I suspect that one of the criteria used in the selection of those for redundancy will be if somebody has had the vaccine.

I think there needs to be more clarity on the vaccines, lots of people (not just on here, in daily conversations as well) are assuming it protects you from catching it. Employers shouldn't need to worry about making people have a vaccine as staff will still have to self isolate once they have tested positive for covid-19, whether they have had the vaccine or not. So they will still have the loss of staff regardless

Apparently, the vaccine doesn’t stop you catching COVID or spreading it through it just stops the individual vaccinated getting seriously ill... if it stopped you catching COVID then 100percent vaccine or find a new job, it’s part of “duty of care” to me. Mines booked in for two weeks time but I’ve already had covid a symptomatic, I think the weekly testing is more important to protect others

Yes of course but as stated several times on the thread it's not about the individual's right to say no it's about whether the employer has the right to say if you say no you cannot work here.

So what would happen if a resident refused the vaccine?. Could staff ask for that person to be moved?.

The employer has the right to stipulate the terms of employment for any new employees. The worker has the right to say no to those conditions but the consequences would be no job offer. It happens all the time in employment law.

For example you have the right to refuse to opt out of the working time directive where you can work more than 48hrs a week but the employer can ask a new employee to sign the waver if they refuse then the job is withdraw.

"I'm a carer and we have had our vaccines both residents and staff.

Full ppe is still worn and all guidelines are being followed.

nobody is talking about forcing anyone we all know we have a choice but so do the employers and residents and other staff

Yeah as we've seen in these fora. It has the potential to be divisive. But illness and death tends to focus the thoughts a bit. I imagine it will arrive at a balance at some point. But we just need more evidence to try to convince people to make the right choice. "

The right choice for one person is not the same for another.

"No no no and no

The only benefit from the vaccine is it MAY reduce symptoms..

No enployer has a right to dictate what is stuck into your body. End of "

STOP SPREADING MISINFORMATION NOW!!!!

The CDC published a summary of the benefits of COVID-19 vaccination:

1. COVID-19 vaccines are being carefully evaluated in clinical trials and will be authorized or approved only if they make it substantially less likely you’ll get COVID-19.

2. Based on what we know about vaccines for other diseases, experts believe that getting a COVID-19 vaccine may help keep you from getting seriously ill even if you do get COVID-19.

3. Getting vaccinated yourself may also protect people around you, particularly people at increased risk for severe illness from COVID-19.

4. Experts continue to conduct more studies about the effect of a COVID-19 vaccination on severity of illness from COVID-19, as well as its ability to keep people from spreading the virus that causes COVID-19.

5. COVID-19 vaccination will be a safer way to help build protection.

6. Getting COVID-19 may offer some natural protection, known as immunity. But experts don’t know how long this protection lasts, and the risk of severe illness and death from COVID-19 far outweighs any benefits of natural immunity. COVID-19 vaccination will help protect you by creating an antibody response without having to experience sickness.

7. COVID-19 vaccination will be an important tool to help stop the pandemic.

8. Vaccines will work with your immune system so it will be ready to fight the virus if you are exposed.

There is no evidence that after having the vaccine that you can't transmit the virus, the vaccine gives you protection to fight the virus not to stop you catching it!

As we reduce the levels of infection in the country, this will be a diminishing problem. I'd hope that none of the brave staff who have given so much will have their employment prospects damaged, though it should remain a personal choice on whether to be vaccinated or not. Sensitive education and counselling may help those who are hesitant.

A personal choice guided by the science and real evidence. Not garbage on Facebook or Twitter.

I am sick of hearing the "vaccine takes 10 years" claim. A lot of that 10 years is spent recruiting people onto trials that run one after another. It takes something like half the 10 years to approve and manufacture.

The vaccine is as safe as any other.

I think vaccination should be a requirement for those working in healthcare and caring for the vulnerable.

Yes, you can choose. In the same way you can choose not to comply with other requirements of the profession: by finding another job.

"I can see where relatives are coming from because obviously they want their loved ones to be cared for and protected as much as possible.

However because the vaccine only seems at the moment to be proven to protect the individual who has received the vaccine I think it would be tricky to prove these people are putting their relatives at risk.

Iv no idea where the law stands on this but I do know that certain jobs require you to have had the hepatitis vaccine so there must be some sort of employment law that allows this I would guess."

IMHO They should not be sacked, however the owners/bosses have a duty of care and therefore should make those who don't want a vaccine but still wish to work have a negative PCR test weekly at the employee's own expense.

Regardless of whether you choose to have the vaccine or not, there are already policies in place for testing in care homes

For example where I work All staff have a pcr test weekly, residents monthly and if any symptoms,

Recently we have now started the lateral flow tests before each shift, plus anyone who enters the building has to have one even if not in direct contact with residents

We all signed a consent form for the vaccine,I had mine the beginning of January, still a fair few staff are going to appointments over next week or so,those who have declined have not been pressurised yet,

There may be a time where it becomes mandatory,so we will see what happens in the future,at the moment it is choice of both staff and residents

every single registered care manager has a rights to refuse the nhs if they feel that things are not right.

in our care homes nobody gets in unless tested and even then (residents) still get isolated for 2 weeks to be sure .. we set this up right from the beginning with the first lockdown.

the nhs already has court cases lining up for sending positive resident back to care homes in the first wave ... we've been lucky as our local hospital has been brill...

lets not forget either that alot of covid transmissions have been caused by some staff not sticking to the rules too

This is true, but let’s also not forget in some places it isn’t optional but to discharge due to the lack of acute beds and patient safety xx

Still doing it but the big difference is that they are being tested before leaving whereas at the start they were not. Think they need 2 negative tests before getting moved.

I read somewhere that the company can be charged with corporate manslaughter, if they are found to have acted in a way that doesn't protect its staff and residents. This is under the Health and safety at work act 1999.

So it isn't so cut and dry as I don't want the vaccine, but still want to work for you.
