With the update is it illegal for a company to force you to take all of your holiday this year?

Yes as if the company in question has closed and told you that you are not able to work then it is their duty to pay 80% of your wage

I get the Furlough bit.

But as part of it is it illegal for them to force you take all your holiday entitlement this year and not be allowed to carry any over.

To me it seems a approach which is not exactly by the letter of the law

It is 80% of your wage up to a maximum of £2500 gross per month.

They don't have to furlough you either they can make you redundant if they want, some big firms are making people redundant

The way I understand it is you can carry over what you don't use this year (up to 4 weeks) into the next 2 years.

U can only carry over up to the 20 (28) days u should take by law plus 8 bank holidays .. so if u use 15 days and take every BH then u only carry 5 over

That's the way I read it.

And please this thread is not about furlough it's about carrying over holiday entitlement or being dictated to you cant

You can only carry over statutory entitlement. So, if you contractually get more leave than the statutory minimum, then they can make you take that or lose it unfortunately.

I'm taking what I can get lol

I've only used my days I carried over so far so it's still a lot if I want.

I don't disagree it's a sensible thing to do but I've always booked holidays around business needs and I'll continue to do so. But I don't think it is right that a company erodes employment law. Like when most ask you to sign out of of the regulation to start with so they can make you work longer hours than required by law.

I probably have more to loose than to argue it but when something else is put down in law to protect your rights I think it's a wrong thing for companies to ask that they you sign a contract to say they can't comply with the law

The way I read it they have to allow you to carry over unused leave.

However there is nothing there about them being unable to force you taking all the leave allowance in the year it's due.

I'm on forced holiday this week.

I think I'd take it if it was only a week

But after being furlough it feels a bit like why would ... you can't use one part of the law to line your pockets and ignore the other bit on employment rights.

As it's a minimum 3 weeks and it will be very busy when I get back I won't have the time to take holiday without having to work exceptionally hard to do so.

Probably what gets my goat is I was working from home busy every day 8-5 with a long list of things to do. So theyve only done it to to get the grants

I was working from home two for 2 weeks. Now holidays for a week. Still don't know what I'll be doing next week. That's what gets me most.
