My understanding is there is no specific law regarding toilet segregation.
Premises can mark their facilities by gender, but there is no legal requirement to do so.
It is not a new issue - TS/TV types have been using toilets since, well, toilets came into fashion.
The issue has risen in profile because of suggested changes to equality laws and the possible removal of certain thresholds for an individual to identify as a gender different from the sex identifier allocated at birth.
It all comes down to what is reasonable and what is not.
That is as much to do with your own presentation as it is with the nature of the premises.
When I'm out, I'm simply looking to perform a biological function, not to make any sort of political statement or stand.
I tend to look for disabled or unisex facilities as a first port of call.
It all comes down to your own judgement, your own self-awareness and your own risk assessment of the premises you are using.

Thankyou so much for that detailed explanation. My question was serious and a very genuine need to know as wouldn't ever commit any type of offence knowing it's wrong. I always dress appropriately to go where ever it may be but on a couple of occasions got caught needing to go urgently. Admittedly frightened I am breaking the law. |
