Can you Lose Your Job Because Your A Swinger.

Had a friend on fab suspended from her job pending an investigation because a stalker messages her work place stating she was a swinger. She luckily kept her job as it couldn't be proved.

So what's your thoughts folks, do you know, have experience of job problem due to being a swinger.

It depends on your job I suppose.

I would say for the most part it shouldn't impact your job whatsoever however, I imagine if you were a teacher for example it "could" be deemed inappropriate especially if it ran the risk of meeting parents of potential pupils. This could in turn result in you being told to "behave" appropriately or leave the job.

This only effects people with a security clearance and those that have morality stipulations in their employment contracts....

Also people that work for religious organizations.....

I'm sure if they had tons of proof, photos of her swinging with couples or doing something dodgy in regarding form fabswingers then they would have taken it further but she got out of it somehow

but she's just an example I used, I'm talking about any jobs or important jobs etc..

If there is a risk to the employers reputation then yeah you could potentially lose your job, doesnt apply only to swinging of course.

Most employers will have a section in your contract or t's & c's regarding bringing the company into disrepute.

Unless you are pictured swinging in a works livered vehicle or in a uniform or of course your actual place of work then I would think you would be able to sue the arse of whoever sacked you for your own private persuits

I've had morality clauses in contracts before. I don't know exactly how far I'd need to go or what proof there would need to be to terminate a contract though but certainly something that could be threatened. Certainly stopped the porn career alongside the 9-5 happening though

Yes.

I have clauses in my contract regarding 'conduct unbecoming' and 'bringing into disrepute'.

I know of a teacher who lost her job and a policeman who lost his.

She was outed by an ex pupil and he was reported by a couple at a meet. Don't know the details of the meet.

Some people are in positions where they may have to make judgements on other people’s lives .. magistrates, police officers, social workers etc. If someone could prove those people were leading what could be considered immoral lives it could make their jobs difficult and skew people’s opinion of their ability to judge or support others.

Sadly, swinging os still considered immoral by some and could change the way others view us so many of us like our private lives to remain that way.

I run my own business, so unless I wanted to fire myself I’m sure I’ll be fine!

It’s also worth stating that in my view it would be thoroughly against the rules to dismiss someone for doing something legal in their private life, especially if there’s no mention of the company. I’d never put anything like that in an employment contract anyway.

Not me but my ex disliked a guy i was swinging with before him but it turned out he was a controller. He rang the person job up most of told lies like been in my house while working. Not the case, I was in the car an him my ex sat next to me. I got a call from the guy job. Asking questions one what I was told were lies and two i should never have been contacted. The guy kept his job because he hadn't done anything wrong. But my ex was lived cause I didn't do what he wanted. The guy worked within the government..

I look at it this way..... if a person is homosexual and frequents gay bars and occasionally meets up with other gay people for sex, (which also happens in ‘normal’ bars), would anything be said to them about this? You can bet your ass it wouldn’t be as they would be sued so fast their feet wouldn’t touch the ground......

it’s no different than 50 odd years ago when people were being victimised in their jobs for being gay..

It’s because swinging is the last taboo

Depends totally on the job, the company & your contractual requirements.

If your contract has a clause about ‘disrepute’ then chances are you could potentially lose your job if found out.

Also if you work in a job where you need to adhere to certain standards - religious roles, social workers etc

But there are a lot of roles where you might not lose your job directly, but your career option may become restricted, passed over for promotions, moved to different departments that are not what you want to do etc ... forcing you out that way.

It’s going to be different for everyone!

The disrepute clause is often a 'catch all' that some companies use to good effect - two managers where I used to work lost their jobs for what was deemed to be disreputable behaviour outside both the workplace and working hours...

I lost my job due to my sex addiction. An anonymous stalker hacked my account screen shot message threads and married these up with verifications and dates etc when I should have been working and sent them to my office !!

The laws might be different in the UK... but I have played with 1 Greek Orthodox priest couple and 1 orthodox Jewish Rabbi couple. They explicitly told me if they were found out. They would lose their jobs...

Scenarios

If your a teacher in a primary school, a parent is informed that the school teacher is a swingers, says what site, profile details, pictures etc.., that parent tells other parents, do you think the parents who are non swingers wont do anything about it, they will go to school to protest, to take their child out. the school will then have to take action, suspension with pay etc.. until proven as the schools reputation will be put online and if its a private school, certainly reputation is important.

A man or female of the cloth, same scenario, do you think they would still be able to keep their job.

A member of parliament caught out as a swinger, do you think they will keep their job, might be forced to quit etc...

Footballers you say, as an ex professional player who is now a coach, I work for a professional football team in the youth section, yes I believe I could lose my job if parents found out I was a swinger. Footballers are in a precarious job because company reputation is so very important.

Only a few examples I have given that I do not know if you could or could not lose your job because of those situations were to arise.

Similar situation.

I was always discreet about being a swinger, confided in no one.

I ran my own business at Airport with 45 workers. I brought in big accounts to keep everyone busy. Some government accounts, some with private schools etc... all workers who were dealing with clients, customers, under age had to go through disclosure.

If it was found out but my main clients that I was a swinger, I know for a fact I would have lost some of those contracts, if I did I would have had to let most of the workers go so they would lose their job due to swinging , indirectly. Not the same as direct involvement, I give you that but I would lose the contracts because it was bring these companies into disrepute thus, contract lost

And if you all want to take this further, how about checking out some of the photos on this site that are moderated before being shown and clearly break UK law.

Swinging and having a job does not bring anything into disrepute but if you posted compromising pics of you in your uniform or capitalised on your job to get sex then you are clearly stupid and in hot water.

I don't think that is true.

The Equality Act makes it illegal to discriminate on the grounds of sexuality, that's true.

So it would make no difference if your Cert 18 pics that appeared in the Sun were of opposite-sex or same-sex - you'd get the sack either way at my work place.

No one can be sacked for swinging but most of us can be sacked for bringing a company in to disrepute.

Lots of ifs......

If their contract mentions codes of conduct and behaviours.

If their contract mentions bringing the company into disrepute or impacting on its reputation.

If they're breaking the law.

If their actions can be seen to be breaching these terms, probably.

If the contract doesn't and they're doing nothing wrong, probably not.

To the best of my knowledge you can't be fired for being a swinger.

When I was interviewed for my current role I had to declare all of my interests, preferences and "activities"......

Swinging is a lifestyle choice it is not sexual orientation therefore not a protected characteristic.

The disrepute clause is absolutely a catch all and if a company want you out it can and would be used very effectively.

Most people see this site and their activities linked to it or elsewhere as a small part of their life that's just not worth risking their livelihood over.

Like so many have said it is your private life and for the most part people appreciate discretion.

Lastly I think not having a public face picture, being careful what you post and just being cautious in general is wise. While some may spout the whole I'm not ashamed card or its my life my choice, I think personally they are reckless

One guy at work was outed from a porn site which involved body fluids and other things. Him and his wife charge a subscription for viewing their movies. Everyone knows about it now and work couldn't care less as he turns up does his work and goes home. The job we do involves being responsible for the safety of literally hundreds of people at a time while they are with us for the short time we have them.

You are correct but there is a little wiggle room in there I think.

A happily married bisexual person has the option of openly having sex with a same sex partner or sneaking about behind their partners back.

You could argue that swinging is the way in which a married person can fully express their sexuality without lying to their partner.

That brings it into the protected area. Most HR departments would run a mile before testing that in court.

Someone at my work outed me as been on Fab, proceeded to show everyone and this included the directors and MD. It hasnt affected my role within the company.

Whoever had used the company computers within worktime to view Fab would be at more risk of getting fired as its a breach of internet security and viewing of adult material

The disrepute clause is absolutely a catch all and if a company want you out it can and would be used very effectively.

Most people see this site and their activities linked to it or elsewhere as a small part of their life that's just not worth risking their livelihood over.

Like so many have said it is your private life and for the most part people appreciate discretion.

Lastly I think not having a public face picture, being careful what you post and just being cautious in general is wise. While some may spout the whole I'm not ashamed card or its my life my choice, I think personally they are reckless "

Had a friend on fab suspended from her job pending an investigation because a stalker messages her work place stating she was a swinger. She luckily kept her job as it couldn't be proved.

So what's your thoughts folks, do you know, have experience of job problem due to being a swinger.

My employer is fully aware that I am non monogamous as i became that a number of people i came across in day to day business communications were also on the scene. I opted to out myself rather than have it become an opportunity for accusations of wrongdoing, threats of being outed (b*ackmail) etc, and it has never been an issue. All my employer seems to care about is whether or not I'm good at my job and as what I do in my private time doesn't affect that there doesn't seem to be an issue.

Admittedly I'm not going out dogging in a sign written vehicle in company uniform, if i was there might be a different take on it. But I'm not, so there isn't.

I think the posting naked pics and pics engaging in sexual acts, is more of an issue than being a swinger.

Someone in a job that makes decisions such as a policeman/woman, judge, bank manager, (list is endless those are for example purposes only), anyone in a position that having their pics seen online would open them up to being bla£%mailed etc, I think this is part of the issue.

Of course plenty clauses in contracts (all of my previous jobs) include bringing the company into disrepute.

When I worked for police, we had plenty presentations and warnings about not even being allowed to be on dating websites. Not mentioning on fb about who we are employed by.

I don't think its necessarily bout discriminating against swingers, however I know its an issue in some circumstances.

Its a lot about being bribed, bla£*mailed into making decisions and judgements and making very very bad decisions in order to hide the photos etc.

I know one minister who is a serial adulterer. He just says sorry and moves to a different parish. I know of four churches he has worked in so far and played around with married women in each. We also have the Catholic priests who fiddle with kids or father kids and still stay in the church.

I would guess that if you can do that and get away with it then swinging is low on the list.

It's not hard to avoid though. Just don't post full body and face graphic nudes or anything explicit that can identify you. Keep your face pics vanilla. Even if someone disclosed it to your work with the fabswingers logo on them you just front it out and say it's been done without your knowledge.

Surely a job is more important than any sense of 'i'm doing nothing wrong'?

I would suggest that no reasonable person who knows unreliable statutory interpretation is would want to be the first to take their company's 'morality' or 'disrepute' clause to a tribunal.

Readers of the forum will remember the twists and turns of the case of the cake and the writing supporting gay marriage.

If your work is fine with swinging go ahead and go public but those who are wary should not be treated as weak cowards. A lot of corporations and organisations would look dimly on employees swinging.

I would also suggest that fetish activity where consensual harm is caused is the last taboo.

The CEO of where I work was plastered all over the papers a couple of years ago for being in a hotel with a lady who wasn't his wife.... investigated and all the company was worried about was if he had used company funds to pay for the hotel, he hadn't... carried on with his job and an internal memo saying it was a private matter to be resolved between him and his family.

If your profession has a code of conduct that states you will uphold the public's confidence in that profession, then that is a can of worms. As we know the general public may not approve of swinging. Especially if the media are stirring it up. Not just swinging that can be an issue. Consider the social workers struck off the SW register as they shared a cartoon pic by email. Was the time of the Gary glitter scandal and the cartoon showed a man going through airport customs with a child stuffed in the suitcase. Distasteful yes. But each shared it privately. But through their work email. Nobody outside their friend circle knew until Press found out, big furore, 'public confidence' allegedly shattered. Imagine your entire profession being lost for that? Basically sharing a sick meme. Then imagine the press finding you were a swinger and outing you? Once press is involved absolutely jobs could be lost for being a swinger. Although if it happened to me I would fight it tooth and nail.

IANAL (I’m not a lawyer... but also, ha!) but whilst those are protected characteristics none of them directly correlate to swinging. So for certain roles discussed previously (of a religious, social care, teaching nature) would likely be able to at least argue the disrepute or moral standards angle.

A lot of folk are saying “an employer wouldn’t dare... they’d get sued” etc. Which may well be the case... but would you want to put yourself through that and have to deal with lawyers, tribunals and the like for months? It boils down to the individuals appetite for risk in my opinion.

I would be checking contract terms and conditions and company handbooks. You'll find the majority will have a clause somewhere which could screw you whatever you get up to. If they find out about something and don't like it. They will find away to ditch you. Simple as...

Swinging is not covered. It’s a sexual behaviour or preference, rather than an orientation as far as the law is concerned. So you’ve no legal cover under the equality act.

If an employer wanted to end your contract because of a morality clause, they could.

Haven't read the thread in detail, but I would actually be incredibly surprised if any employer tried to get away with firing a swinger provided they were open about it and whatever they got up to was 100% legal and consensual.

CofE, perhaps. Organisation devoted to sexual abstinence, probably!

But I think that the key thing for me would be the open-ness (I'm not, but that's because my nilla friends wouldn't get it). It's when people are ashamed that the possibility for coming under pressure opens up, which would scare the hell out of me if an employee was handling potentially sensitive information....

You can be sacked for being a swinger if it is linked to your company and that they feel it affects their reputation and brings the company into disrepute.

Therefore you should never have on your profile who you work for or give an obvious hint. A classic example is the number of Army guys who show photos of themselves in uniform.

Provided there are no obvious links then everybody on here should be safe and it would be a tough for any Company and HR department to sack a person.

Yes of course.

For example if your face is on your profile and someone recognised you and sends it to your boss, they could argue that it could bring the wrong attention to work & let you go.

I don’t agree with it at all, but sadly this happens.

A lady friend of mine is an escort and was sacked after a disgruntled ex sent her escort profiles to her boss which had her face on them.

Agree with this. Some employers do specify that employees are not to put anything on social media that could identify them as working for the company. Such as company name, pictures with company uniform, logo etc. If you don't breach that then the company has no ground to stand on sacking you.

Also to note, being suspended at work is not a punishment. It takes the accused out of the situation and allows an impartial and thorough investigation. Seems these allegations were made, it was looked into and nothing came of it so the person went back to work.

The video was made public by this pupil. There was outrage among parents. Not at the little thief but at the teacher. Calls were made to the school for her to be sacked. If you work with the public e.g. carer, teacher, police officer, social worker etc you could be sacked if they got information regarding your unusual sexual activities e.g. pics films ads etc.

Like anything else in the adult industry we are all tarred with the same brush if our sexual conduct can be used to discredit you or your employer's, bribes etc can have serious effect depending on your job.

For this reason we ourselves don't work with / film / photograph private sector workers because of the high moral scrutiny of uk citizen's compared to that of other European people.

There is no reason why you would lose your job - your private life is private and having sex is not illegal. You can be as private (or not) as you feel appropriate on this site.

Like with anything else that is seen as ‘alternative’ it’s often better to keep this side of your life within the right circles.

If you are a primary school teacher working in a CofE school then sure - your lifestyle is under some scrutiny, so be sensitive to that.

I (Mr) used to have a very high level of clearance for my job and was told that so long as I declared everything then it would be fine as the danger was of being blackma**ed or coerced into disclosing information.

The guy was eventually dismissed from the Police force. As has been said many time before if you compromise your employer then you can be dismissed.

The other, my boss has been my best friend for 21yrs.

Might raise a few eyebrows if people knew, but it wouldn't affect my employment

One big issue is even if it unlawful for a company to dismiss you, they may still do so. The win ratio at employment tribunal remains low and the compensation even if you win (almost no one actually gets reinstated) are not normally great either. Then there's your legal fees.

My advice? Join a trade union, there not perfect but good to have when you need them

Funnily enough the OH had to have a high level security clearance for his job at the time and had to declare everything he does in private, including swinging, it didn't stop him getting the job.
