There was a recent post about how the law would view pics uploaded on here without consent and I have just read an article in our local paper about a similar court case.
A couple married for 18 yrs split up, the husband as revenge uploaded 64 explicit images of the wife on to tumblr,
They also had 3 kids so the guy must be an absolute piece of shit of a man to do that to the mother of his kids but he did end up getting a sentence suspended for 18 months and community service so was dealt with pretty seriously.
He was also a psychiatric nurse so has lost his career now he has a criminal record.

I think it is all about intent for harm. I haven't read any sentencing guidelines or anything so may be talking out of my behind, but posting a pic or two on here, against a literal spear campaign with full name and address on social media must be taken into consideration right? Obviously just best to get a written contract of copyright and distribution rights whilst taking the pics....in the middle of a full swap meet... oh might be a mood killer  |

Looking at the Scottish legislation, it’s only an offence if “the photograph or film has not previously been disclosed to the public at large, or any section of the public, by B or with B’s consent.” So, if we’re talking stolen profile pics, it’s not an offence under the legislation written to deal with revenge porn. |
