BBGBs are not for me, but if I organised such event and it was specifically advertised as such, then anyone breaking out a condom would be shown the door. Plenty of GBs and GG nights advertised that require condoms, so if safe sex is your thing, go for them instead. |

I guess this is the reverse of the no sex without a condom. If consent is given based on the use of condoms then to not wear one is legally considered to be rape.
So it seems likely that if consent to have sex is conditional on you fucking bareback then using a condom could be considered rape. Weird but possibly true. |

Thank you for putting me right there. May I respectfully suggest you also correct the Crown Prosecution Service who have specific guidance on "conditional consent".

This is not an area of law I have studied recently, as we would never go against anyone's wishes, regardless of the legal position. So not something we would need to be up to date on. 'Implied' consent?? No such thing. There is consent or no consent. Failing to get consent means you have none.
Furthermore it is rape to remove a condom without that consent. As it would be to move from vaginal to anal sex without consent. Both have been proven in court.

When was the last time you were kissing someone, started stripping each other's clothes off, then stopped as asked "can we have sex now?" To which she said "yes I consent to having sex". Probably never (outside of swinging). In which case by your reckoning you have committed rape several times.

Implied consent does refer to some law, such as..a person has implied consent to enter Tesco. This can be withdrawn.
Sadly there is no such thing in the sexual offences act. One can have reasonable belief they have consent and this boils down to capacity to consent etc. |
