I got the idea from a club/party on here called BMFC, how would everyone feel about a party every now and again with the main focus being black people and the people who love them?
All races would be allowed men and women BPFC being the main theme though?

That's not how trademarking works.
checking the government trademark website and doing a search for "BMFC" it does indeed return your registration, and it also lists "FCBM" "BMCF HLQ4" "BFCM" "BCFM" "FCMB" all of which are VALID REGISTERED trademarks very similar to your own.
As you will also know trademarks have to be shown to have been defended at every opportunity for them to stand in court, and typos abound so the OP is as likely to trigger an action from Black Country Family Mediation as yourselves, and both would still have to prove their case in court on the day.
Provided there is no actual intent at "passing off" or profiting from someone else's name like opening a MacDonalds burger shop, where is the harm?

1/ There is little purpose in Fred contacting Jim's solicitor, Jim's solicitor can only act on Jim's behalf, he can't give Fred legal advice, not denigrating your offer of same to the OP, but unless he was thinking of making a business offer of some kind there is likely little point in it.
2/ You did state the OP "will not be able to" and it was this that I was calling into question. disclaimer, I am not the OP's legal adviser either, but I know something of copyright/trademark/IP law and with the greatest respect there is a world of difference between "Apple" and "Easy" and your own trademark, and the legal teams backing same.
3/ We habitually block everyone that we encounter who mixes money/business/profit with swinging, it's nothing personal and it wasn't intended to prevent you from responding, we just find that we don't have anything in common with people who mix sex and money, so even though we might to choose to go to Acme swingers club one night (as we choose to "go" virtually to Fab online) we'd still block Acme swingers if they had a profile here.
For the record I have no axe to grind either way against yourself or your business, I merely took exception to *how* you stated your case to the OP, and if you and the OP choose to compare notes you'll find that he is also blocked by us, so we are at least even handed in our own petty prejudices and preferences.

The fact of the matter is that i have worked hard for 13 years to achieve the reputation that i have and I feel it is morally wrong for someone to knowingly use a similar name in the hope that people will assume that they are the BMFC or that it is the BMFC organising their parties
There is much information about this on the internet as it could be seen as trying to pass off their parties as ours
I am not a solicitor and that is why i suggested that if they wanted to obtain the legal facts then feel free to contact them as i am only too happy to share my solicitors contact details with them |

Are they providing the same / similar thing to us though? ... No... Just like the Barry Manilow Fan Club won't be bothered that we have the same abbreviation as them - coz we don't have the same interest!
It's about confusion of people thinking it's our brand and it's us running them. And when we have worked so hard to get to where we are today, too right we are gonna try and protect our brand - just like any other club or website would. But if I'm honest, legalities aside, it's about having manners. Why would someone want to have a brand that sounds the same as someone else's? Why not be unique?
There's so many other names that can be picked that get the idea of the concept out there. Also there's enough people to go around to visit all the multiple events that run alongside ours with the same / similar concept, so that isn't an issue either.
Just don't use similar names. Its pretty simple really.
We have asked politely and the OP has actually messaged back privately and seems more than happy with what we have asked. It seems the joy of the fact it's on a public forum that people are making a mountain out of a molehill

I thought he meant the OP'a idea of black people, not just men. Therefore, white or Asian, Middle eastern etc men would go to meet black women. "

Whilst i am totally flattered that you appreciate our concept and business model, i am afraid that you will not be able to use the terminology BPFC as it is too similar to the one that we have trademarked
Feel free to use something else but unfortunately it cant be anything as close as the name that you are putting forward

So I wouldn't attend then, as I am not a "fan" of black men (I've nothing against them, but as a straight man I'm not looking to play with other men), however I would enjoy playing with (some) black women, so I would attend the OPs party, but not BMFC.
Is that really so difficult to comprehend? |

Are they providing the same / similar thing to us though? ... No... Just like the Barry Manilow Fan Club won't be bothered that we have the same abbreviation as them - coz we don't have the same interest!
It's about confusion of people thinking it's our brand and it's us running them. And when we have worked so hard to get to where we are today, too right we are gonna try and protect our brand - just like any other club or website would. But if I'm honest, legalities aside, it's about having manners. Why would someone want to have a brand that sounds the same as someone else's? Why not be unique?
There's so many other names that can be picked that get the idea of the concept out there. Also there's enough people to go around to visit all the multiple events that run alongside ours with the same / similar concept, so that isn't an issue either.
Just don't use similar names. Its pretty simple really.
We have asked politely and the OP has actually messaged back privately and seems more than happy with what we have asked. It seems the joy of the fact it's on a public forum that people are making a mountain out of a molehill

I'm still thinking of using the name as I've seeked legal advice and there'll be no trouble for using it, especially as it's non profit, still debating on changing I just don't see why I should , thanks for your understanding Lil miss BMFC and hope to maybe even collaborate in the future |
