Sex outside and the law
Jump to: Newest in thread
Not sure about this however I recently had an awesome sex encounter outside under some covered benches away from the public although on public land.
Am I right in thinking if you are caught performing sexual acts in a public place no matter hiw secluded it is you could (emphasise could) be put on the sex offenders register?
If the answer is yes then that means anyone caught dogging in theory could be put on the sex offenders register.. thats scary |

You'll only go on the sex offenders list if its with a minor!!!
It's classed as indecent exposure to have sex in public if your seen by someone who takes offence and reports it which can result in 6 months inprisonment or a £5000 fine!! But the actual having sex itself isn't against the law!! |

Minors??? I thought Mrs T sacked all the minors. That coal dust gets every where I imagine and don't start me on their little lamps. |

That's certainly not the case in Scotland. Adult couples have found themselves on the Register after being captured having sex in a public place. |

I think it is highly unlikely that two consenting adults would end up on the sex offenders register for having sex in public. Its all about being a little sensible. Dropping on the floor and going at it like rabbits in the High Street on a saturday may not be the best move.
It all depends though who sees them. If a family were walking by and you caused them alarm & distress you could be in trouble. Just be sensible with the location and common sense would prevail.

It's not the case south of the border either. |

Totally agree with this. Some years ago I was out mountain biking and disturbed a couple having sex. They were. about 50-100 metres from a kids playground on a sunny weekend afternoon . To me that is seriously wrong and asking for trouble if caught. But late at night or somewhere secluded the risk of being arrested must be minimal. |

As far as I can see from cop shows on TV they generally just give people a verbal warning and move them along.
Think, as someone has said, it is a different matter if someone sees it and reports it. There was a couple recently who performed a sex act in a bank foyer. Unfortunately they were seen by people waiting at a bus stop, including a child. Think they were spared jail but they were very lucky.
I have had sex outdoors many times. I think the rule is to just be sensible(-ish). |

The sex offenders register is a list of anyone cautioned or convicted of a sexual offence as listed on the Sexual Offences Act 2003 and having sex outdoors is most certainly not on the list. As sex in public if caught and charged would be charged under public indecency laws then they cannot be put on the sex offenders list!!! |

Having researched the facts I entirely agree with you. Don't know what happens in Scotland, they are literally a law unto themselves and have a completely different system.

Exactly maybe I should have made it clear i was referring to England and Wales only. Mooning out of a bus or having a pee in public = sex offender list and having to report to local police station each week is pretty hard to believe!!!! |
