This is copied from an article in my local newspaper:
With the sun shining and warm weather to rival the canary islands, it can be tempting to get your kit off in the privacy of your own garden to avoid any tan lines.
But there are rules to follow if you want to stay on the right side of the law.
It's not an offence to be naked in public, but it can be an offence if you cause distress or alarm to others, according to the law.
That means you're perfectly fine to sunbathe in the nude in your own garden - as long as it doesn't upset your neighbours.
This is what the actual law states: "In the absence of any sexual context and in relation to nudity where the person has no intention to cause alarm or distress it will normally be appropriate to take no action unless members of the public were actually caused harassment, alarm or distress (as opposed to considering the likelihood of this)."
So if you live in the countryside with no one overlooking your garden, go ahead but you might want to think again if you live near others.
It's also recommended that people who want to sunbathe naked should inform their neighbours first.
It comes as the UK faces a rise in temperatures while under lockdown with police urging the public to stay at home.

Thanks O.P. but it's not a revelation although some may never have researched laws regarding being naked in public, so maybe it's of a help to them.
It's NOT illegal to be naked in a shop doorway as long as you are not seen. Nakedness is not a crime. Offending those sensitive to your nakedness in a public place is.
Your garden may be private but as you KNOW you can be seen your neighbours would be given priority in any dispute. |

There is a dude has been walking buck naked all over the UK for years and never been actually punished for it. I do it sometimes in my garden because lucky for me its private. The kids hate it though |

I wouldn't trust our local rag telling me that the sun will rise tomorrow until I see it myself! Copy paste journalism at it's worst.
The reality is, unless you intentionally act in a way to cause upset you don't commit an offence. If you are massively overlooked then you're asking for trouble to strip off. If you quietly strip off where you reasonably don't believe that you are going to be seen then you're fine.
The naked rambler keeps being arrested because he keeps walking past schools and deliberately setting out to cause upset. |

The way I see it is it’s my garden, it’s NOT a public place and as long as I am not doing anything sexual (although I’m confident I’m pretty secluded and would only be seen if someone really went out of their way) then it should be perfectly fine!! |

I have been sunbathing naked in my garden for 22 years neighbours have come and gone and not none of them have said anything if they want to look they have to hang out of the windows so that I would say it’s Private |

Mrs F took the advice. She's been naked sunbathing in the garden for years but never realised the law stated she had to inform the Neighbours when she's going to be out. You wouldn't believe this but every neighbour is sitting in their upstairs windows looking over our garden. Hope they now don't get offended as all these years of naked sunbathing will have to stop. If its all ok Mrs F will continue to stay within the law and post fliers through the letterbox of our neighbours letting them know the time so not to offend |

While this is the law, i think its pretty sad that your level of clothing on your own private property can be determined by someone elses over sensitiveness and ability to be offended by a naked body
We all have one so sure why so many are embarrassed and ashamed by them
And just for clarity i an referring to a purely innocent nude scenario like for example sunbathing
Playing in public and / or touching yourself as others have said above comes with a different motivation and its not right to force other people to become involved in something for your sexual gratification |

Not sure that's right, think about naked bike rides and other nude areas
your garden is not a public place, if your neighbours have to climb a ladder, look over a fence, stand on a box, go to a certain window to be offended then the police will tell them to fuck off lol unless you are purposely standing on a ladder naked waving your cock youll be ok

If you go to nude beaches then that is your choice, as it is for the families who go there.
Choosing to take children to see art, including nude depictions of the human body, in a public gallery is not the same as having no choice to see your real live next door neighbour with no clothes on. I would have thought that was pretty obvious.
Ditto being relaxed about nudity as a family - that doesn’t mean the same as children having no choice but to see strangers naked from their own home, which may make them feel uncomfortable. And children have a right to feel safe and comfortable in their own home.
Don’t recognise your description of Germany. However again if there are public places where nudity is allowed, it is the family’s choice to go there.

Not often I see an informative thread like this so nice one OP. My garden is big, but overlooked by at least 8 other houses. Some more could probably see and no 'hidden areas' so being mindful of that I only go as far as topless lounging/gardening.
Will be topless for doing my gym workout. Sweat the horn off as for my neighbours all pretty friendly and engaging. The men same as me topless/shorts. The ladies getting comfy enough to be mindful of those that have children. Especially those in trampolines.
Those little bundle of energies could jump right over 6ft fence! |

Ha ha not to me. My god, neighbours have seen mine, no equality there! However going by the general mindset of my surrounding neighbours the men have been topless, boys topless in trampoline. Ladies never completely bare and the girls never. So it's just the way it is. I would imagine possibly the same around the UK unless gardens are secluded.
If other neighbourhoods do things differently then I don't know about that. Being single and no children means I have not had to think about that in more detail. One of my neighbours has even taken my pic twice, that I know of! At first I was like ok that is weird/shocked but she is one of those constantly taking selfies literally never seen her without phone. Know my neighbours for over 2yrs so we have that friendliness/banter, but still surprised she took my pic
Do you take your nipples out? How is your garden area? Secluded/overlooked... neighbours etc sorry if you've already posted on it I will scroll up again see what your thoughts are. |

Yeah this gets me a bit, guys can wear shorts and walk around the street, but women have to put something on, it just doesn’t make sense that men’s nipples can be seen but because women have something a little more they have to cover up.
Completely agree on all the points around not offending neighbours and of course children of neighbours, too! |

Yeah this gets me a bit, guys can wear shorts and walk around the street, but women have to put something on, it just doesn’t make sense that men’s nipples can be seen but because women have something a little more they have to cover up.

That is another good point about guys walking down the street in shorts. I have never done that, but never seen a woman do that either.
With the neighbours/children it could be because the dads are topless and mums are not they may not like/appreciate it if others were different... if the mums were topless then maybe if they seen other mums won't bother them... or there could be multiple other possibilities. Not a conversation I have had with my neighbours. I think this is just the 'unsaid' rule and just happens the way it is...
I suppose in some neighbourhoods there will be people that do as they please no matter what the circumstances. I guess each household has to weigh up the options... keep a friendly atmosphere amongst neighbours or do your own thing. After all it is your space home/garden.
Children:
This for me is the key decider. I only went topless because all the men before me did so thought not going to offend anyone. If someone approached me and said sorry we are concerned about that and the guys never went topless I would listen. Fortunately the situation where I am has been without any problems/issues.
Luckily not ending up on the programme 'Nightmare Neighbours'
This thread has certainly got me thinking about this topic and how/why certain dynamics work in gardens... acceptable/unacceptable things... so I am going to ask the lady that took my pics what her thoughts are...

Despite living on an Estate, my patio is un overlooked, especially closer to the house, so I’m naked quite a lot when the suns out. If anyone was to see me, it’d be because they are peaking over the 6’ fences, or leaning out their windows at a bizarre angle. Either way there’d be ‘invasion of privacy’ issues I would imagine. And in addition to that, if anyone wants to look at me in the buff, they’re welcome too, they’d clearly have issues themselves other than my nakedness! |

I wouldn't sunbathe naked in my garden if anyone could see me. But if the children could clearly see you,then I think they have every right to ask that you don't sunbathe naked

Interesting again that, accoring to some, a person's right to offend takes precedence over another peson's right not to be offended by the same action.
Then the standard respone is usually "well it's not against the law". I call that the toddler response, as it is just "me first". It leaves no room for self moderation and the universal respect for others which should be an automatic part of the human condition in a civilised society.

Why does nudity offend? It's in all the great art galleries, why are children extra offended? I go to nude beaches with very mixed crowds and the kids are to busy building sandcastles to be checking anyone's bits! In Germany nudity is common place in parks and on lake sides.... It seems to Brits make the most fuss about a willy lol

If you go to nude beaches then that is your choice, as it is for the families who go there.
Choosing to take children to see art, including nude depictions of the human body, in a public gallery is not the same as having no choice to see your real live next door neighbour with no clothes on. I would have thought that was pretty obvious.
Ditto being relaxed about nudity as a family - that doesn’t mean the same as children having no choice but to see strangers naked from their own home, which may make them feel uncomfortable. And children have a right to feel safe and comfortable in their own home.
Don’t recognise your description of Germany. However again if there are public places where nudity is allowed, it is the family’s choice to go there.
Do you possibly see a theme emerging here ?"

So you seem to accept that seeing art depicting the nude body and also seeing people nude in designated public places is not the same as people seeing others nude in their back gardens. Good, we are getting somewhere.
Re your earlier post, did you mean the one about the "judge" needing "evidence" ? That would seem to apply to the Sexual Offences Act only. We are not talking about that as far as I am aware.
In the case of the Public Order Act it seems it depends upon the circumstances. However the CPS guidance does say this:
"Victims or witnesses with vulnerabilities might include children (and their carers) who are faced with the suspect's genitals and bottom in close proximity. Any views expressed by victims or witnesses on the impact the offence has had are important, in particular whether they have felt harassment, alarm or distress."

But it does say there would be very little probability of prosecution.
Having said all that despite whatever the law says, can I ask you this: if you knew you were causing offence and distress to a neighbour, however inadvertently or innocently, and especially if that neighbour had children who were also distressed, then simply the question is this - why would you continue to do that?

"Not often I see an informative thread like this so nice one OP. My garden is big, but overlooked by at least 8 other houses. Some more could probably see and no 'hidden areas' so being mindful of that I only go as far as topless lounging/gardening.

Ha ha not to me. My god, neighbours have seen mine, no equality there! However going by the general mindset of my surrounding neighbours the men have been topless, boys topless in trampoline. Ladies never completely bare and the girls never. So it's just the way it is. I would imagine possibly the same around the UK unless gardens are secluded.
If other neighbourhoods do things differently then I don't know about that. Being single and no children means I have not had to think about that in more detail. One of my neighbours has even taken my pic twice, that I know of! At first I was like ok that is weird/shocked but she is one of those constantly taking selfies literally never seen her without phone. Know my neighbours for over 2yrs so we have that friendliness/banter, but still surprised she took my pic

Well I can’t help think that if it is impossible to see without really really trying, then there is nothing wrong with it. I’m lucky and I’m in the same position as you where I could be seen but only if you’re making a really effort so I wouldn’t be happy if someone complained |

Well I can’t help think that if it is impossible to see without really really trying, then there is nothing wrong with it. I’m lucky and I’m in the same position as you where I could be seen but only if you’re making a really effort so I wouldn’t be happy if someone complained "
