Glad you've taken it so well. We wouldn't have been so relaxed about it. Only goes to show that you have to be careful what you release to the public. Do people earn money by stealing piccies and selling them on? |

"you can make a lot of cash by taking legal action against the site, unless of course you fancy being a porn star then we can add you to our sites
"
You cannot take legal action, even if you have posted a disclaimer! Once you publish a photo in the public domain (which this site is) it can be reproduced in seconds anywhere else in the public domain by anyone who wishes to do so! Copy and paste is all it takes. That is a given under International law as well as UK and most other countries legislation. |

Oh let's get two things straight here ...
1) We're 100% happy with our stuff being all over the net. We've been doing this for 6 years and have had our stuff on many sites, and on many open forums. It's a turn on for us to know lots of people are getting off to our stuff Plus, Perrie has a nude blog on tumblr. It's called Perriebelle. I wont post a link here but if anyone cares, they can find it.
2) These images and videos were not given out by someone we know or don't know ... they are grabbed from servers (probably our folder on our own server) by web bots that scour the net looking for groups of images. It's simple tech. It's why you often find 'self shot' nude sites with sets by girls in the mirror getting naked. Most of the time those images are normal girls who have had their stuff ripped off of the net somewhere. It's nothing new.
Like I say, we're happy enough with it. Doesn't bother us I wont be posting links here as I don't want to upset the admin staff |

I love it when people start talking about servers and bots and all the other complete and utter gibberish, that I have not got a clue about. Computer speak is completely baffling to me, mind you it might just be that I am a thick twat. lol
Fair play to you,if you don't mind. We always put the block thing you can do over our face pics, see I am getting into the computer speak already. Not long now and will be talking like Bill Gates. hehehehe |

Hehe ... and that's fair enough But we have no issue being seen naked online. Our careers can't possibly be affected because of what they are, and we're pretty excited by doing it :D It's everyone's own choice I guess. But yeah, it's quite funny when you find your own images around online.
Wanna do it? Google "Google Reverse Image Search" and you can use that to see if your own pics are online |

sorry that is totally wrong!
The person who took the photograph keeps copywright unless they give it up. Posting on a forum does not constitute that.
There are many cases of photographers sueing sites because they have reproduced their work and won.

No, it's not done on your computer. It's a bot that scours the net itself. Your computer is never accessed by these things. Just servers that host images. |

Not if the photograph has been reproduced with permission on a site not copyrighted by the owner of the photo. That then becomes public domain and can be freely reproduced! By all means, Google it! |

that is the reason we watermark all pics/vids we send to anybody or put on any sites,we had some of ours put on a site where the person who had uploaded them was being paid for each viewing!(didn't even offer us a cut!!) |

What a load of proper rubbish!
Often when you upload material to a site there are terms and conditions that you agree to and often it means you giving permision to the site owners to reproduce the images for their own purpose even on other sites they may own. In fact Yahoo is a good example of a site that does this.
BTW I don;t believe this site is public domain either as the site has an owner and I would imagine that all content is covered by their own terms and conditions and they will own the copyright for this site, possibly including all coding.
The owners will no doubt do their best to ensure that copyrighted material does not end up on their site, why do you suppose every picture upload is vetted, its not just to ensure the picture content is ok! |

Tin eye and google reverse image search both fail to find pictures that are on both my fab and my facebook. I'd have thought anything on facebook especially would be easy to find. Is there a more reliable software? |

Is your Facebook locked down with privacy settings so only your friends can see it? I did the same thing (did tineye on my pics) and it didn't find my facebook pics either. Might just be a facebook thing. |

Yeah, these web bots can only get to files that are not locked behind security walls. Our files were accessible to anyone who could find them. It's no big deal, but if you leave your files somewhere they can be found, they will be |

taken from a modeling site
A couple of repeated concepts have been brought forward that we want to help explain and hopefully dispel some myths. These two concepts are "Public Domain" and "Fair Use".
"Public Domain" in really simple terms means anything that has outlived its copyright or has been placed in the public domain by its creator. Copyright is different by country, but it usually lasts the life of copyright holder plus 50-70 years. So, it is important to note, that just because you find a picture, video, or writing on the internet it does NOT automatically mean it is public domain. Only if the person who owned the copyright says "I am putting this in the public domain", or if it has outlived its life, does it go into the public domain. For more info, see here.
"Fair Use" (slightly different wording and meaning in different countries) basically allows for limited use of a copyrighted item. In the US, there is a 4 part test that is used to figure out if something fits Fair Use - the item is supposed to pass all 4 tests in order to qualify. The tests are:
1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
2. the nature of the copyrighted work;
3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.

I know a good Intellectual Property Solicitor in Coventry who helped me in the past....
He is professional and very good at his job....
BUT.... I wouldnt waste his time or mine or even Jayne's trying to get him to kick someone's arse online over Photos etc....
One thing that I know is also a waste of time is the Disclaimers people keep sticking on their profiles.....
But there you go!

Most important is to keep you real names private. Otherwise anyone can repost one of these pics or vids titled with your name. These will then come up on the first page of google whenever someone you know try's to look for you.
Yes it's cool have your pics hidden away on the web but not directly linked to you and super easy to find... |

Iv just tried the google image finder app where you take a pic of the picture you want to search, if nothing comes up does that mean that mine are not on other sites? Other than trawling through thousands of pictures on lots of different sites I can't see how I'd ever know? |

Nope none at all, but I do have my profile so it doesn't appear on search engines which may be why.
I'm not particularly bothered if they have migrated to other sites after all I put them on here to be looked at and I dont have any pics that reveal my identity, only pics that are of face only which can be found on many other social networking sites so it's not like full body and face pics of me are hanging around on porn sites lol
Just intrigued more than anything |

note yr comment om yr privacy setting but am sure i've read in past that fsb's image servers Auto block search engines.. Hence have never seen fab name in any tineye results.. Therefore our pics could be on other sites with privacy rules |

we only post pics that we would not be overly upset if they appeared somewhere else, even though it would be against our wishes
just a risk you take, the second you post a photo anywhere on the web, you run the risk of people stealing them, it only takes a second....life's a bitch |

Im sorry, but you are completely and utterly wrong. All images, whether posted on the web, in an album, whatever, belong solely to the photograpther. You hold copyright AT ALL TIMES AND UNDER ALL CIRCUMSTANCES. If the images have been stolen (yes they were) and sold, you have the right to recompense from the image holder ( hosting website) and the right to have them taken down. You must be able to show that you own the originals though. There is no such thing as 'public domain' in the world wide web. No original music, art, photos, text, written work etc belongs to anyone else than the original author. If you wish to make public your work and let anyone and everyone use it that is up to you, but no one can use it without your permission if you dont want it used. |

While the OP is correct its easy enough to rip images of this site or any web site and reuse the images - even easier if a paid member.
That said - doing a reverse search on the Ops images - appears that all of the image are on paid or ad earning blog sites under their profile name.
So OP is this scaremongering or an attempt to get people to your sites to increase revenue from ad services and the like? |

"They haven't been on Fab for 4 months,I don't think they will be replying "
Too busy selling services on the net - good try though at drumming up business!
Just for those concerned - none of the pics were ripped from this site - and in general they won't be, due to how site is setup. Some other @swinging" sites will get hit. If you find you pics on the net, they likely be from either users on here who have ripped them and used them elsewhere, or where you have posted them on other sites.
Top tip don't use google images to reverse search your pics either - google aren't one the richest companies in the world for nothing....remember you never pay for google(they just sell your data and information) any search you do is data they sell, along with your IP, and any other cookies it uses to gleam info from your PC, same as Facebook. |

Ours were ripped from this site! Pictures that we only put up on this site have found their way on to Hamster, as have friends of ours. Yes it was a single guy on here who put them up on Hamster, but to say it is not possible is just wrong!
Tell any IT guy that you can't download pictures from here and he will come back with loads! Just because you can't get in the front door, don't be fooled into thinking they are safe. They are not! |
