They're right.
The Multi-Partner Penetration Act of 2009 made all consensual sex amongst adults illegal where there were more than four people within a 5m radius.
Some clever dick found a loophole though, so it's legal to have multiple threesomes in the presence of someone who is trying to sleep naked. |

The way I understand is that if there are two or more women under the same roof having sex and money (for any reason) has changed hands, then in the eyes of the law the building becomes a brothel, which is illegal. I suspect if a hotel room is being used and a contribution to the cost of booking the room is asked for, it could be a grey area, but anyone charging a general entry fee (lol) could be falling foul of the law. |

It is not illegal and there are only a number of standard charges which could be brought, for example indecent exposure, public order offences, public decency offences. In order for any of those offences to apply someone would a) need to be offended and b) make a complaint. I'm not sure how this would be be possible if it's in a private venue with invited guests only |

I don't know the answer to this, it has always fascinated me though. I suspect that the club gets round it by not being responsible for the actions of it's clients...they just provide drinks and 'socialising rooms'. |

Guys, I don't want to bore you all with the various types of case law but I'm a lawyer (barrister) and can assure you there is nothing illegal. Unless you do something that offends public decency in which case u obviously need to do it publicly. Clubs are licences and have been through the planning process. There are very few sexual acts that are criminal these day with the (animals etc) so u a re left with public order offences, consenting adults in private does not give rise to any potential charge |

A swingers club which charges entry/membership fees is perfectly fine and not a brothel. The money is not going to the guests in exchange for sex, it goes to the club.
Same if you organise a house party or hotel meet and collect reasonable costs to cover room rental, refreshments etc. |

This Lawyer as it wrong guys even mortgage companies stipulate that it in breach if used for illicit purposes, inadvertently check with your local council as rules vary on licenced bars in swinging clubs up North are different to down south where selling of alcohol is prohibited in swinging clubs so local councils could differ.
Could the Lawyer privately send me details saying this is not against the law so i can recheck it through my police friends as this is a new one on me. |

Paying for sex is legal with one woman in that said property but if there are 2 woman or more it becomes a brothel even if the other women dont partake in any sexual practice.

We know this from experience when a group shoot we were doing was raided by police & tax officers, because it was a film shoot the police couldn't do nothing but the tax people wanted our tax code & books to look through.
Our details were give over by AW as the police were investigating about a 30 women & couples at the time doing parties/gang bangs/bukkakes etc, it was the police that explained the laws to us.
This is why documentation from the lawyer on this would be good as people we know got a lot of hassle at the time.

That lawyer didn't set it out as well as you do.
It's illegal to run a brothel, that is, to have more than one sex worker under the same roof who is paid or forced to have sex. Regardless of the amount.
Anything else is legal. (apart from bestiality , offending piblic morals, etc).
Swingers clubs do not guarantee sex and don't charge per se for sex. Although, grey area here, some of them trully have paid prostitutes to entertain the guests and if proven, this could lead to prosecution.
In ideal case scenario, consenting adults engage in adult activities. That's all. How much they pay at the door, is immaterial.
Conversely, one woman can legally charge for sex services. Just one. If they are two or more, it becomes a brothel.
If someone else pimps her, this will be illegal prostitution.
In other words, you can sell your body, but not in collaboration with others and you shouldn't be pimped up by another.
Swingers clubs maintain that noone sells or procures sex, but everyone is there for enjoyment only.
