I need to check something with people who are in the business of law ...lawyer / policeman.

If my garden is covered by marquee and it can't be see....probably overheard though...cam people have sex in the garden?

And with windows open the neighbours will hear it all...would they have grounds for complaining so that I could get a visit from the police or local council ?

If so what time would this become an issues.

I would say it would be an issue, definitely. If your neighbours can hear lots of people having sex in your garden, that would be very bad. The time is immaterial.

As a swinger you should have consideration for non swingers.

You have said yourself that neighbours will hear, that means neighbours won't be able to go in their own gardens.

Let your guests fuck in your house instead. If you are holding a big party with any fee charged, you will need a premises licence or you could be prosecuted.

I think you are being selfish towards your neighbours.

I would say it would be an issue, definitely. If your neighbours can hear lots of people having sex in your garden, that would be very bad. The time is immaterial.

Just to clarify it's not my intention to be a nuisance...but I can't prevent people from being vocally expressive if they are in raptures...

Nor do I intend to use the garden...but if something starts when I am elsewhere..i just want to be on the right side of the law...

And no I am not charging...

If I could afford a bigger and detached house ...i would.

I might try crowd funding for a bigger house...reckon it will work ???....joke !! Before someone gets serious

I'd let them know in advance that you're having a party that may spill out into the garden. You don't have to tell them what type of party. Let them know when you're expecting the noisy part to end and try and keep to it and keep the sound down.

The neighbours could either come round to complain or contact environmental health or the police. If it's just the odd instance of outdoor fun then it may not be an issue (think overhearing your neighbours at it every now and then). If it's 5 hours of bump and grind then you may wind up with a fine or an ASBO (if they still exist?).

You have to live next to these people so try not to create a problem. Let your guests know to try and keep it down if they're outside.

If you do anything which could reasonably be expected to offend your neighbours, you could well end up in trouble.

Do any of your neighbours have kids? It's not something a lot of adults would want to listen to but it's totally inappropriate if there might be kids able to hear.

The law doesn't stop people from making noises during sex but if anyone considers you a nuisance for making those noises they are well within the law to complain about you.

Basically you are not breaking any laws until someone complains about you.

Polce woud probably give you a warning the first time, not even on official one, just come round and let you know theres been complaints and to keep it down and give advice on how to party more appropriately.

Tbh, if you don't really care about your neigh ours then it would take years for you to get an asbo so you could potentially piss them off for years before the law got involved and forced you to do anything.

The police have no powers to deal with noise complaints, it's environmental health that do that but for a one off they wouldn't get involved, as above the police would come out and just give you some advice and politely ask you to keep it down. I think the legal cut off point for loud noise is 11pm. As for the sex, as long as you're taking all reasonable steps not to be seen by neighbours or the public then you're fine, you would have to intentionally have sex with the intention of being seen to break the law. Having said that from a moral point of view, being legal doesn't make it ok. If I had my kids and there was an orgy going on in next doors garden I'd be putting a brick thru a few car windscreens I think, if I didn't have my kids tho I'd be expecting an invite.

I would not be particularly pleased if neighbours allowed guests at a party to have sex in a marquee. What is wrong with using the rooms inside your house .

Good relations with neighbours are crucial to me and I would never do anything to upset them.

Why would anyone want to have sex in a marquee. ?.

Don't think anyone's judging or getting on moral high horses, more pointing out that there are other factors to consider besides the law, those of consideration and respect for your neighbours (and not just the immediate ones either) and particularly any kids that might overhear something wholly inappropriate for young ears.

The fact that you've asked the question suggests there's a concern that play WILL spill out into the marquee and if that's the case I think you have to take appropriate steps to ensure it doesn't, such as informing all guests that play in the marquee is off limits out of respect for the neighbours.
