Been told once or twice that if I got rid of the legal warning on my bio regarding my profile and its contents, I would have a better profile. I'm inclined to keep it nonetheless, but I just want to gather people's thoughts on having a warning like that on a bio.
Perhaps if there's anyone there who works with law, maybe you could tell me if having it there holds any weight at all? |

The "legal disclaimer" is pointless nonsense and all does is take up extra space on our servers. Please remove it if you have it on your profile. If you're worried about privacy please set your account to be hidden from non-registered users on your privacy page (this also hides it from search engines but may take a week or two to drop out of search) and remove the notice (and encourage others to do likewise).
Common sense advice would be NOT to put any information on your profile (here, or on any such site) that could identify you or that you don't want to become public! So for your own benefit, don't post phone numbers, real names or email / instant message addresses on your profile that people might see or "Google".
Some people may put non-identifying pics on their public profile but keep face pics private or for friends, for example. |

what will you do if someone does use your details? What will they use your details for? How will you know someone has used them?
It's entirely up to you what you have on your profile but believe all of us when we say it's pointless.  |

I always wonder what the people who quote them will do when their privacy is violated - would you seriously drag someone thro the courts. Your's doesn't actually threaten legal action OP but so many do and so many of those same people point out that discretion is important to them. Go figure - personally I don't think it's worth the space it fills!! |

This bit? Keep it on if you want, if someone did nick your profile or pics you have made it clear that you didn't want them taking them and could sue them in civil claims court. It goes without saying that under civil law if someone took your profile or pics and claimed they were theirs then they could be done for fraud, if the police could be bothered to prosecute. If they took and used them to harass or bully you then also common law could prosecute for that. |

I would just rather not have my information nor my pictures to be used by third party studies, etc. I'd be inclined to keep the warning in case it does hold some legal weight, but I hope someone would be able to definitively tell me if there's any point. If there was definitely no point, then I would remove the warning, but otherwise I would keep it in case anything did happen. Wouldn't want something like "But you didn't tell them they couldn't" coming back and biting me in the ass. |

The onus is on you. You have to prosecute not the police. You have to prove someone stole you pictures. You have to prove that they were yours in the first place.
All this while the tabloids are shouting 'look at the perv on the swingers site' whilst pointing the big fat judgmental finger at you and your family. |

I'd bet good money that there are solicitors, barristers, judges on here who would know the definitive answer - I wouldn't bet good money on them coming forward to admit it / give advice tho |

What it really boils down to, with or without the warnings.... would you take someone through the legal system if they copied your profile or pictures. The media interest it would problem generate, would ensure that many would know, then we have the test of what damages have you suffer and what compensation is required. .... |

There is no legal premise to have that warning. No audit trail to prove it's you (in sense of proof of ip) and very difficult to prove you didn't want to put it online.
Affect my unless you have genuine copyright on your pictures. Prior to them going on ANY site not only this then they are classed as prior art and can not be protected.

it's not so much this concerned, anymore. I'm just intruiged at this point. I've learned a lot from this thread, and i'm gonna remove the disclaimer as it is, ultimately, pointless, but i've become fascinated by the legalities discussed in this thread  |

If you don't believe the site owners, ask a solicitor. The answer will only cost you £200. I've just won an unrelated civil case. My costs were £9,870 of which the other guy had to pay £8,870. So the "winner", me, had to pay a grand for "justice". And it took three years.
ANY legal action will cost you an arm and a leg, plus a LOT of time and trouble. If there are things you don't want the whole world to know, don't put them on the internet |

I see. Well I can tell you that all we could do was report the profile to admin and make sure we watermarked our pictures from then on...although that isn't foolproof. |

I think I should have the right to have only interest coming from site members..why should my livelihood be risked for something I do with consenting adults that is not breaking the law?
not that bothered about my pics being used elsewhere(if some guy wants to pretend he is me lol)...but I'd see it as a form of revenge porn(which IS illegal) if someone wants to posts my pics in an effort publicly 'out' me or the simply that they profit from me(sell a story).
i'll keep my variation of my disclaimer.
my pics are for members of the site who are are/may be interested in this life style. |

We originally had this on our profile when very first started.. Took it off quickly when realized it was a waste of profile space. Any one can screen shot others pictures, edit the fab swingers logo and use for what ever. Some people now edit their own picts with their own txt ... We don't show faces in public( in private picts) and any on show are cropped to show no backgrounds etc.
we used to show more picts till sum were used as anothers profile pic!

it is worth it's weight in gold..... I have never known anyone who has had their pictures stilen when they have displayed it...

. Completely pointless. Even if you had the money , would anyone really sue an organisation or individual for misusing your profile ? That would just generate more unwanted publicity. Anything that you do not want the public to see should not be on your profile. |

It is impossible to know if someone had copied your profile or pics unless someone else is vigilant and notices, then tells you.
Someone copied my profile word for word. He also blocked me so i couldn't see the profile. If it wasn't fot a vigilant lovely lady who liked my profile and thought it sounded familiar asking me directly if I had 2 profiles, I still wouldn't know.
The legal notice wouldn't have made a difference. He probably would have copied it too! |

What you have to be aware of is once placed on the internet it is available worldwide. Many countries do not have the same privacy laws as the UK. Would the UK police Or interpol for that matter really be interested in chasing down someone from another country who copied and used your pics of your willy and other parts for their gain, i think they have more important things to deal with.
If you feel that strongly you can hire a solicitor to start civil proceedings with other countries but be prepared to sell your house and posessions to fund it and without gaurantee of winning.
Or like us you could remove your pics and only send to people you have liaised with and are happy to show your pics to, i know which id choose |

If anyone wants to steal your pictures they will, copyright is being infringed all the time with relatively little comeback. To be quite frank we would be quite flattered if anyone thought our pictures were good enough to pinch. The simple answer is do not put anything on the Web that that you don't want anybody to steal. The Web is like an open door! |
