My faith in Scottish police has plummeted. My mum has an anti social tenant living above her shelter housing flat. He has an asbo preventing him coming to her door or him or his "friends" buzzing her entry system. He did that tonight when I was over for Hogmanay. When I confronted him, he called police and I was cautioned???? Apparently as a registered alcoholic he's a vulnerable person an can buzz anyone in block for access(asbo or not, even when be begs money or cigs)the fact my mum has just been diagnosed with cancer counts for fuck all, even though the anti social thing has been ongoing for 3 years. She's paying £30a week extra in rent for supposedly shelter housing an extra security!! I maybe charged cos I confronted him an when he grabbed me I pushed him away. He said i Assaulted him That even with an asbo gives more fucking rights to an alki.

If he has breached his asbo (which has set conditions) in any way he should be charged. If it didn't happen with the police who attended tonight then report it tomorrow.

If he can buzz for entry fine. But if it was for more than entry surely he has breached his asbo.

He has breached his asbo, more than several times in the past couple of months. The sherif has said as he's a "vulnerable person" and "at risk from his own d*unkiness "( the police brought him home a few days ago and carried the 42 inch telly he'd just bought up to his flat) since when did our finest become tesco delivery men? They've admitted when they've attended his asbo breaches that it's easier to give a verbal warning than arrest him. All very well for the sherif and them to feel sorry for him but they don't have to live next door to him.

Why is it a person who is a danger to himself and others is allowed to do as they please. If it had been anyone else we would be charged with d*unk and disorderly at least.

Because this person is vunrable he is allowed to flaunt the law! Lock him up and dry him out. If he breaches asbo ... Back inside. Why should the rest of us have to put up with a system of law that favours the criminal.

Asbos are a load of crap , I wouldn't worry about being charged with anything to much hassle for the coppers ,

Now a little rant I hate all this crap how people who have an addiction get everything going for them and people say they have an illness sry no they don't they no exactly what they are doing when they start ie drinking to extent or put a needle in there arm and then claim how sick they are and expect to get everything going when hard decent working people get fek all , feel sry for your mother who has to put up with this crap

Anyway if you need someone to have a small discrete word with this guy well u know what a mean

thats shocking Ava x, nobody should have to put up with that and that scum shouldn't be given any priority whatsoever, they got themselves into the mess so its up to them to get themselves out of it. I spoke to a Fife councillor recently who stated that the makes gouncils give priority to people who have been in jail.....fckn ridiculous xx

If I were you, I would attend the local police station and demand to see the duty inspector and make formal complaints about their lack of action regarding the asbo breaches.

You'll be surprised how quickly they move when faced with another complaint. And don't stop with the duty inspector either. Take it further up the chain of command in writing and keep copies of all correspondence and forward them to the sheriff with a formal complaint to them for their inaction too.

Don't let anyone fob you off.

I'm sorry, but I don't see how this guy is 'vulnerable'.

If he has a diminished mental capacity then surely his caters should be responsible for him and his actions which include the excessive drinking. Maybe they need to accept that they have failed in this case too and need to get him help.

If he is just an alcoholic with an out of control drinking problem, maybe it's time they moved him away from sheltered housing to prevent him causing more problems

(Just my opinion mind)

100 % agree with this statement.

attend during the day with your complaint and if pos use mob phone video evidence to show him breaching the asbo. Doing it during the day will likely get a better chance of an arrest as if they do it at night when he has likely been drinking then the police officers know fine well they are taking front line personel away for at least 3 hours to deal with a d*unk.

Be strong and keep documenting his actions and keep all corospondance and notes of badge numbers etc who attend. You will be surprised how much more they will be keen to help.

Thanks everyone for the kind words and advice.

Apparently part of the reason he's at risk and vulnerable is when d*unk he gets abusive and he gets beat up from his drinking cronies.

I'm making a formal complaint to the police later and the council when it opens later in the week.

If people with addictions refuse help and make decent peoples lives a misery when under the influence then they should all be housed together and left to their own devices. Maybe a tad harsh but I've worked with addicts who have sought help and straightened themselves out and transformed from neighbours from hell into caring, decent people.

Recording someone without their consent is bit well you know. Even if it suit your purpose to show this persons in a d*unken state.

Is high handed complaining the best way.

You may find the police are containing, rather than solving your problem.

My folks are fortunate, good neighbours reside next door.

Sit down with a pen and some paper and write the whole thing up line by line, what was said, who was there, who did what, when the police where called, etc etc. Basically make your own statement whilst you remember it all.

Also get everyone else that was there to write things up as well. Check to see if there is any cctv at the block of covers the area that you had the issue with this guy.

Keep to the facts and not speculation. Also you said he grabbed you, well check to see if there are any brusies on your wrists/arms where he grabbed you.

Sorry to hear about your mum. I had an issue with a former neighbor, who was just evil for evils sake. No booze involved.

1. Keep a diary

2. Keep copies of all correspondence and copious notes of all calls.

3. Time, date, Full Name and position in office of person talked to including and transferred or conference calls.

4. Ask if the conversation is recorded

5. 3rd party corroborating evidence. Make sure others in the building have the same evidence of harassment/abuse.

6. Make a formal written complaint to housing provider. Get neighbors to do the same.

7. Make sure you get a crime number for every incident.

8. Seek legal advice once you have a body of evidence on the possibility of a restraining order.

Lastly, I know this is the hard bit, keep calm when you deal with him.

Please drop me a pm if you want to rant/let off steam to someone out of the loop.

Most stations dont.even have a regular counter service now....will need to book an appt. Often you are better seeking help from your M.P. Some of them are very good at helping their constituents.
