Nah, there's no right to a court process, the change of use route is exhausted. They could theoretically appeal the enforcement action but realistically there isn't a leg to stand on since they've been operating without the right permissions in place all this time so just prolonging the inevitable, possibly by a few months max. |

People who do not know the details of the planning process and planning law should not show their ignorance and spread false rumours on forum posts.
1) Due to a technicality the enforcement notice is 'illegal' and holds no water.
2) There is an option to appeal to the planning decision. Once that is done the enforcement notice goes on the back burner anyway.
3) Yes there IS a route to a court process. Just as there was for the Lap Dancing clubs in the city centre (different process and different rules) but the principle is that there is a route.

Just saw that someone is saying we are closing in January! That is news to us!!

What I said was an enforcement notice has been sent saying the venue has to be closed by January (it's not AfterDark specifically). It's public info, anyone can go look.
If it gets appealed, withdrawn, is illegal or whatever then the situation might well change but that doesn't make it a rumour or a lie as things stand. |

Just read the enforcement notice on Edinburgh Council website and planning policies (I’m a geek like that..). It’s really sad, and I hope the owners find a way round it.
Personally, I’d pivot and open a sex toy factory (light industrial use). Research and development - where we all come in - is also valid under the planning policies |
