The two civil servants who investigated the allegations created retrospective guidelines and drew up a critical report based on their enactment!
They and their methods were severely criticised in court by a senior law lord. I cannot understand why they have not been charged with attempting to pervert the course of justice.

Because they were investigating a complaint on behalf of the "employer", not as part of a criminal investigation.
That is why Salmond sought judicial review in the civil court, that the employer - a public body - had not followed its own process.
The criminal investigation is separate.

I would argue that the civil case feeds in to the criminal investigation. I doubt whether Police Scotland would have entirely ignored the actions of the civil procedure, flawed though it undoubtedly was.
Through observation and third party engagement on behalf of a friend who was unjustly accused, I know that the atmosphere within the justice system in relation to anything to do with inappropriate behaviour, either at work or in the home, has been skewed by Holyrood "sending out a message" to accompany its legislation.
You can not rely on the unsullied purity of justice from the Scottish justice system, unfortunately. |
