labour can withdraw the whip...or kick her out of the party, but they can't technically force her to vacate her seat unless she wants to, she would just end up being "independent"

If Labour want to hold the seat, they have little option than to do this. There should be a recall system for MPs who break the criminal law. Unfortunately there isn't.

Did MP's resighn after the expences scandal?No and they are no doubt fiddling in other ways.What planet are people from thinking that labour MP's are more honest than tory MP's,now get real.

In fact I would suggest that Labour MP's are far more easily tempted to be dishonest as they are generally less off in the first place.

As I understand it, if she owned up, it would be 3 points on her licence and £100 fine. Instead she's thrown away the chance of joining the gravy train!

This sort of behaviour does not confine itself to one particular party.

Chris Huhne was caught using his wife to try to avoid points. Tory MPs aling with those from other parties fiddled their expenses.

Why do these things always tend to end up as party political issues on these forums? Because some people cannot accept that their chosen breed can ever be wrong and their chosen enemy is ever right. A true sign of ignorance.

I thought Labour had kicked her out?

I seem to recall previous cases like this in other parties - they do not have the power to force anyone to resign as an MP.

Eric Joyce springs to mind.

I think there is a law that states a sitting MP imprisoned for 12 months or more automatically loses their job and there is a by-election.

Three months is a bit of a pointless sentence, but I understand why any judge would feel the need to make an example of a dishonest law-maker.

I agree.... but the law says that the sentence must be 12 months or more....

Labour kicked her out of the party... they have done as much as they can legally do

There is now a right for a recall vote. However, this can't happen until the appeal process has been completed. She's going to be one of the better remunerated lags in her local gaol.

She will do 4 weeks....then she may become the first serving MP to wear a judicial ankle bracelet.

What is most disturbing is that she doesn't go along the Chiltern Hundreds route....she is therefore guilty of a bringing disrepute to her seat, her colleagues,our Parliament (despite the way it is temporarily perceived at present) and defies our reasonable expectations for someone who seeks to fairly represent us.

On the whole, quite simply a despicable human being.

She been expelled by Labour so is no longer a Labour MP. She has chosen to not resign as an MP and therefore a by-election cannot yet be forced, unless a significant number of her constituents call one (I can't remember what the threshold is). This isn't anything Labour have any control over and they did the right thing by expelling her when they did, fingers crossed she now does the right thing and resigns herself.

Remember the expences scandal,fact more labour mp's than tory mp's reprimanded over that.
