For example
can anyone say under what law says you cannot film in public or record/ take photos of private companies from public footpaths ?
Under what law tell you you cannot record in a shopping Mall ?
Every wondered why its ok for them to stick CCTV cams all over the place and film you but no no may god you cant use your camera or phone to record a video in public ?
No law states you cant but again its upto you lot to decide many wont ever challenge or question it just do as your told such a shame many are willing to give up their rights |

Public Order Act...
If what you are doing in a public place causes or may cause a 'breach of the peace' then you are committing a criminal offence. You may also be 'Obstructing a Public Highway'...

A shopping mall is private property and you need the owners permission to carry out any act on private property. The owner or their agents can ask you to stop recording and require you to leave their property. Failing to do so is a civil offence, however the property owner can call the police if you refuse to leave and again we are into public order offences.
So the question is not so much what is or is not legal but at what point actions (or inaction's) become criminal offences under public order legislation.
Of course if you are recording within 400 mtrs (I think, but not quite sure) or line of sight of an establishment covered by the Anti-Terrorism Act or Official Secrets Act (which includes all military establishments, most government buildings, arms manufacturers and sites of national strategic importance (like airports, railways, roads or bridges...)(I believe your local Chief Constable gets to decide what goes on that list) then you are committing an offence under said 'Anti-Terrorism Act' and may be convicted of preparing information for an act of terrorism.

Ok i will give you a wee example of this
Right in London at Kings Cross there is a Harry Potter shop thats private property but do you ever see any of their staff say my god you weans can never film in this store
Same with the Harry Potter Studios private property you really think they have the power to say no filming in here get real
there is no law that states you cant it make up pish you make you believe there is but then again do as you please i dont care its you that is giving up all your rights |

Not many people know why they can't do the things they're told they can't do. It's part general ignorance, part trust that those reasons are there for the common good. And that is part of policing with consent.
There are so many laws out there that no one can hope to be aware of them all. That's why lawyers specialise in the different fields.
But your general everyday stuff, like traffic, public order, everyone knows where the lines are pretty much and they chose to cross them or not. |

You are quite within your rights to film anything or anyone as long as you are in a public place. . . Shopping malls are mostly private property, owned by development companies etc. Therefore it could be deemed as trespass by filming.

Not sure where you are going with this remarkably familiar thread? As you are correct, there is nothing stopping someone filming in SOME public places. So it's not like you want to debate. You want to lecture and if anyone challenges you then you tell them to do their own research rather than prove your case yourself.

I have to admit that perhaps I didn't express myself correctly. There are no laws saying you cannot film in a public space.
But there are public spaces where, AFTER you have started filming, you MAY be prosecuted under various acts.
So you may choose to film in a public space. But you would need to be aware that the subject included in any footage may cause you to be in breach of various acts.

You know what the difference between a bill and an act is? A bill is the proposed law, an act is the bill turned into law.
Acts do not need consent either, unless you mean the consent of parliament, but even then you'd be incorrect because you can only call it an act once it is actually law so at that point parliaments consent is no longer needed. |
