Lets look at this

supreme court cases

" in a much as every government is an artifical person an abstraction and a creature of mind only a government can interface only with other artifical persons. The imaginary having neither actuality nor substance is forclosed from creating and attaining parity with the tangible. The legal manifestation of this is that no government as well as any law agency aspect court etc can concern itself with anything other than corporate artifical persons and the contacts between them

I can't be bothered to do research because when I have done so on some of your previous posts it turns out you are just talking shit.

So as the law of averages go where you can't provide the correct information or go off on some waffling tangent I think its fair to say your still talking shit.

Incorrect in most respects.

TV license violations are now processed under civil law, and you won't be arrested for it. Assume you bring that up because you hate the BBC, probably anti-scottish propaganda or something.

I don't know how many policemen actually arrest people for breaking acts. Usually you get arrested for simple things. And no, you don't have to give your name to a policeman. But if he SUSPECTS you of committing, being involved in, or about to commit a crime, and you refuse to divulge your name, then it is grounds for arrest so it can be established.

Shouting "I live under common law!" Will do fuck all.

Hope this helps.

No ?

Ah right so the highest courts in countries and you dont agree with them lmao "

These are all UNITED STATES Supreme Court decisions, do you agree with them?

Court decisions.

1. Dred Scott v. Sanford (1857): Hands down the worst Supreme Court decision ever, Dred Scott held that African Americans, whether free men or slaves, could not be considered American citizens. The ruling undid the Missouri Compromise, barred laws that would free slaves, and all but guaranteed that there would be no political solution to slavery. The opinion even included a ridiculous "parade of horribles" that would appear if Scott were recognized as a citizen, unspeakable scenarios like African Americans being able to vacation, hold public meetings, and exercise their free speech rights.

2. Buck v. Bell (1927): "Eugenics? Yes, please!" the Court declared in this terrible decision which still stands as good law. In an 8-1 decision written by Justice Oliver Wendell Holmes, the Court upheld the forced sterilization of those with intellectual disabilities "for the protection and health of the state." Justice Holmes ruled that "society can prevent those who are manifestly unfit from continuing their kind" and ended the opinion by declaring that "three generations of imbeciles are enough."

3. Korematsu v. United States (1944): Here, the Supreme Court upheld the internment of Japanese Americans during World War II, finding that the need to protect against espionage outweighed the individual rights of American citizens. In a cruel and ironic twist, this was also the first time the Court applied strict scrutiny to racial discrimination by the U.S. government, belying the idea that strict scrutiny is "strict in theory, fatal in fact."

4. Plessy v. Ferguson (1896): The Court's famous "separate but equal" ruling upheld state segregation laws. In doing so, the Court made sure that the gains of the post-Civil War reconstruction era were quickly replaced by decades of Jim Crow laws.

5. The Civil Rights Cases (1883): Another testament to the Court's failure to protect civil rights, the Civil Rights Cases struck down the Civil Rights Act of 1875. That law sought to ban racial discrimination in businesses and public accommodations. The court, in an 8-1 decision, held that the enforcement provisions of the Thirteenth and Fourteenth Amendments do not allow Congress to prevent non-governmental racial discrimination. It would take over 80 years for the Court to switch course, allowing for the government protection of civil rights in Heart of Atlanta Motel v. U.S -- this time under the Commerce Clause.

6. Bowers v. Hardwick (1986): This decision upheld a discriminatory Georgia sodomy statute that criminalized sexually active gay and lesbian relationships. As Justice Harry Blackmun noted in his dissent, the majority opinion displayed "an almost obsessive focus on homosexual activity." Bowers was overruled in 2003 by Lawrence v. Texas, though unconstitutional anti-sodomy laws still exist in several states.

7. Lochner v. New York (1905): Look, they're not all civil rights cases! In this case, the Supreme Court struck down a New York law limiting bakery work hours to 10 hours a day, finding an implicit "liberty of contract" in the Due Process Clause and giving birth to the Lochner era.

8. Hammer v. Dagenhart (1918): Here, the Court ruled that Congress could not ban child labor in intrastate commerce. Sure, Congress could legislate against gambling and other vices, but whether children were to be kept out of mines and factories was a question only states could decide.

9. Kelo v. City of New London (2005): Taking land from one private party to give it to another is a valid public use under the Takings Clause, the Supreme Court ruled in Kelo. The decision allowed New London to condemn Susette Kelo's land and transfer it to a private developer as part of a "comprehensive redevelopment plan."

10. Lucas v. South Carolina Coastal Commission (1992): A developer purchased vacant lots on South Carolina beaches. The state, seeking to prevent beach erosion, passed a management act which prevented Lucas from building homes on the land. That, according to the Supreme Court, was a total destruction of all "economically viable use" and a per se taking. Not only are the case's factual conclusions implausible, but as UCLA Law professor Jonathan Zasloff notes, the opinion is full of "expressly and needlessly anti-environmental" views.

11. Bush v. Gore (2000): You don't have to be a Democrat to question the wisdom of this Supreme Court case. In a partisan split, the Supreme Court's five Republican appointees halted the recount of contested ballots in Florida, handing the election to George W. Bush. Even Justice Sandra Day O'Connor has come to regret the ruling.

12. Exxon Shipping Co. v. Baker (2008): Want to send a message to corporate wrongdoers? Don't expect the Roberts Court to make it easy. Following the Exxon Valdez oil spill, one of the greatest environmental disasters of the time, and after years and years of litigation, Exxon was finally held responsible for its negligent captain and hit with $5 billion in damages. Then the Supreme Court ruled that Exxon couldn't be subject to punitive damages in excess of compensatory ones, dropping total damages down to $500 million. Not only did Exxon evade billions in damages, the Supreme Court's ruling increased the value of its stock by $23 billion in two days. That was particularly a boon to Justice Alito, who chose to recuse himself from the case because he owned Exxon stock.

13. Citizens United v. FEC (2010): Perhaps the most hated decision from the Roberts Court, Citizens United held that political donations are speech protected by the First Amendment, opening the floodgates to unlimited personal and corporate donations to "super PACs." Though widely unpopular, the ruling isn't going away anytime soon. It would take a constitutional amendment or a new Supreme Court makeup to reverse the decision.

Acts are not law once you give your consent you are entering a contact of which you abide by those laws

Statutes come from the laws of the sea come on people know your rights

Everyone well i hope everyone abides by Common law if not you are unlawful and could be arrested

Kinky, as you as such a fan of SCOTUS, what do you think of Texas v White? It found that Texas (and the rest of the Confederacy) never left the Union during the Civil War, because a state cannot unilaterally secede from the United States.

You must agree that one part of a country can't just unilaterally leave, right?

So you agree with "Scott v. Sanford (1857): Hands down the worst Supreme Court decision ever, Dred Scott held that African Americans, whether free men or slaves, could not be considered American citizens." That's what SCOTUS said!

Under what law to you require a tv licence ? Hehehehehehehe

People can opt out of having a tv licence

Only when tou abide by their laws which states if you watch live tv or record then you need one if you do not well hey you aint breaking any laws

Think people think lol

But hey if you wana give them £150 i suppose thats your choice lol

I'm happy to pay my license fee. It's worth it alone for radio 4, I love their news coverage, it's objectives and balanced.

No, you can chose to ignore the act. Doesn't mean it doesn't apply to you and you can't be prosecuted for breaking it.

Try saying "I refuse to consent so you can't prosecute me". When they've finished laughing they might tell you why you're wrong.

All this to explain why you don't pay your TV license (BBC anti Scottish propaganda probably)? Seriously?

No, I have no contract with the BBC, and they are not the only recipient of the licence fee.

Part 4 of the Communications Act 2003 makes it an offence to use or install TV receiving equipment to:

watch or record programmes as they’re being shown on TV or live on an online TV service, including programmes streamed over the internet and satellite programmes from outside the UK, or

watch or download BBC programmes on demand, including catch up TV, on BBC iPlayer without being covered by a TV Licence.

The Act empowers the BBC to make and amend the terms and conditions of a licence. It allows the government to make regulations to exempt or reduce the licence fee for certain persons in certain circumstances. It also makes it an offence for anyone to have any TV receiving equipment in their possession or under their control who intends to use or install it in contravention of the main offence (above), or knows, or has reasonable grounds for believing, that another person intends to install or use a TV receiving equipment in contravention of the main offence.

The Communications (Television Licensing) Regulations 2004 define what is a 'television set.' The regulations also set out the various types of TV Licence, the criteria for obtaining them, the fees payable for them (including the frequency and amount of instalments) and the different concessions available, including concessions for people who are blind (severely sight impaired), people who are over 74 years of age, people who live in residential care and people who run hotels, guesthouses or campsites.

I can’t believe I’m actually going to feed the troll, but here we go...

There are lots of UK-wide laws. Yes, there is Scots law, however Scots law includes a number of Acts that ar UK law. The Road Traffic Act 1988 is just one of many examples.

You still don’t understand what ‘policing by consent’ means. You also don’t understand that you have agreed to abide by all laws that are passed by continuing to live here. If you don’t want to abide by the laws, you don’t want them to affect you, you are welcome to leave.

As with everyone else who spouts the same nonsense; you simply do not understand what you are talking about. You’ve read the words of someone else who doesn’t know what they’re talking about, and you’d like to believe it.

You are not born when your mother's waters break. Surely as a woman you should know that.

You are born at the end of the period of labour, not before it even starts.

And most mother's know the exact time of the birth. It is important to them and something that they rarely forget.

Most births take place in a hospital or in the presence of a midwife and the date and time of birth are recorded.

And you cannot ever know when your DOB is as you will never know when you came out your moms waters

Found on www.gov.uk it's the only thing this fool has said that is right

What happens if you don’t register

You must register to vote if you’re asked to do so and you meet the conditions for registering, eg you’re 16 or over and you’re British or a national of an EU or Commonwealth country.

If you’re asked to register and don’t do so, your local Electoral Registration Office could fine you £80.

You won’t be fined if you have a valid reason for not registering, eg a long stay in hospital, or you have severe learning difficulties.

Our neighbours are conscientious objectors to our form of democracy (they are PR supporters) and they have never voted and have refused to go on the electoral register. As a matter of interest, they get virtually no junk mail compared to what the rest of us get. He says that in his opinion, the electoral register is just a money making database and he refuses to be a part of it until his vote can actually count for something.

Why would you not want to vote and have your say?

Why would you not want to be on the Electoral Register in the modern world?

Our neighbours are conscientious objectors to our form of democracy (they are PR supporters) and they have never voted and have refused to go on the electoral register. As a matter of interest, they get virtually no junk mail compared to what the rest of us get. He says that in his opinion, the electoral register is just a money making database and he refuses to be a part of it until his vote can actually count for something."

Well he will find it very difficult to sign up for credit, utility supplies, mobile phone contracts, hire cars etc, as they all use credit reference agencies and one of the checks they do is to verify you at your address, and they use the Electoral Register to do that.

"Back to the birth certificate hehehe

Right again its not to be ised for evidence

You are not born when your mother's waters break. Surely as a woman you should know that.

You are born at the end of the period of labour, not before it even starts.

And most mother's know the exact time of the birth. It is important to them and something that they rarely forget.

Most births take place in a hospital or in the presence of a midwife and the date and time of birth are recorded.

And you cannot ever know when your DOB is as you will never know when you came out your moms waters

Your parents told you when you were born but then again your parents are liars as they told you Santa was real and the tooth fairy and easter bunny

To have hearsay on your DOB is fraud "

But who could "you"ever know ?

"I can’t believe I’m actually going to feed the troll, but here we go...

You’ve read the words of someone else who doesn’t know what they’re talking about, and you’d like to believe it."

This is 100% correct. I said the same thing in the 1st thread hours ago.

"Found on www.gov.uk it's the only thing this fool has said that is right

What happens if you don’t register

You must register to vote if you’re asked to do so and you meet the conditions for registering, eg you’re 16 or over and you’re British or a national of an EU or Commonwealth country.

If you’re asked to register and don’t do so, your local Electoral Registration Office could fine you £80.

You won’t be fined if you have a valid reason for not registering, eg a long stay in hospital, or you have severe learning difficulties."

Kinky says it's £1,000 though.

I recently went through the process and it was an eye opener for me. I had thought that registering the birth was the first step in making sure the little person was all properly recorded, but it's not. It's actually the NHS that first record the birth, take the name, create a record, assign and NHS number etc. When you register the birth, you are actually just confirming the NHS details are correct. I found it bizarre that the parents don't have to provide any ID proving who they are, so I asked the registrar what's to stop us coming in and saying we are David Beckham and Posh Spice, thus giving our little one a bona fide birth certificate with their names on. She told us that all the information is already recorded from the NHS, and that's why you don't need to provide proof of ID.

You couldn't answer this before, so I don't expect you to answer it now, but my wife doesn't have a UK birth certificate, so it's not owned by the Crown. So does that mean she has a different set of laws to follow despite the fact that she is a UK citizen? The same as you and me.

Also, you haven't answered if African Americans can be American citizens, or if you agree that unilateral declarations of independence are illegal as ruled by both the Spanish and American supreme courts (and probably many more).

I can only tell you my experience, and the registry office knew things that we had told the hospital, but not told the registry office.

That just is not true. There is no linked computer system, and even if there was, the hospital have a duty of confidentiality. There is no way they are allowed to tell the Register Office, which is run by the Council. They cannot tell the Police most things about a patient, except in very limited circumstances."

Again, I can only tell you my experience.

"Back to the birth certificate hehehe

This is some laugh

Right again its not to be ised for evidence

You are not born when your mother's waters break. Surely as a woman you should know that.

You are born at the end of the period of labour, not before it even starts.

And most mother's know the exact time of the birth. It is important to them and something that they rarely forget.

Most births take place in a hospital or in the presence of a midwife and the date and time of birth are recorded.

And you cannot ever know when your DOB is as you will never know when you came out your moms waters

Your parents told you when you were born but then again your parents are liars as they told you Santa was real and the tooth fairy and easter bunny

To have hearsay on your DOB is fraud

Again you were told by your parents

But who could "you"ever know ?

Your parents lied to you about Santa right ? Lol

Your parents register the birth. It is an offence to provide false information.

And the birth certificate is never to used as evidence correct ?

So who in the hell do " you" know you when you were born ?

Evidence of what?

Of course it is used as evidence of your birth, sex, name, date and place of birth, and your mother's identity, and your father's if his name is on the certificate.

Oooffftttt shhhhh dont ever say that your going to commit fraud

The birth certifcate is not to be used for evidence is crown owed

Look at the top left and bottom left of your birth centifcate

You as a man can never know your DOB you are told by your parents

But like i said your pRents told you Santa was real lol

So why are you asked to provide your birth certificate by government departments and official bodies?

Have you ? Infact dont answer wouldnt want to commit fraud

As i said its crown owed thats the legal entity

And for you to use that is a big no no but thats your choice

You are commit fraud if you use it for your name and DOB

You were given a name and told by your parents when your DOB was lol

"

It is not Crown owned. It's not even produced by the Crown, but the local Council, in their Register Office.

And of course I have had to produce it! You have to, to apply for your 1st passport, and you have to produce it to get married!

Your parents register the birth. It is an offence to provide false information.

They NHS only record it for their records. You are still obliged to record the birth formally at your local Register Office. The NHS do not do that for you, and it is an offence if you do not.

What I'm saying is that when you register the birth, they already have another system to check against.

If only! The NHS doesn't even have a nationwide computer system for everything! One NHS Trust cannot see what is on the system at another! Internal systems can be different for different departments.

You are mistaken. If you were right then there was be massive implications for Data Protection and patient confidentiality. The CQC, the Department of Health and the Local Commissioners would launch major investigations.

"So what is your argument?

You are obliged to register to vote and you risk being fined if you do not vote.

Why would you not want to vote and have your say?

Why would you not want to be on the Electoral Register in the modern world?

As a matter of interest, they get virtually no junk mail compared to what the rest of us get. They have probably registered now. And how foolish to have to pay a fortune in tax, and Council tax, and not to have a say in how the money is spent by voting for MPs, MEPs and local Councillors of your choosing, if for no other reason.

Not totally though.

You can be kept off the open register - the one that they sell to the junk mail mob, but not the Full Register.

Credit reference agencies and others have access to the Full Register.

"Ok here is prove that the birth certifcate cannot be used as evidence look at the very bottom and what does it say ? Lmao"

This is another example of you not understanding something you have read.

What that sentence means that the person in possession of the document isn’t necessarily the person described in the document. It is not photographic identification.

Also, the royal family don’t have a surname, because they’re the royal family. They use surnames for marketing, basically. Most of them use ‘Windsor’ because that is the (new) name of their house, but Charles uses the surname Wales. They’re actually the house Saxe-Coburg and Gotha, changed during the Great War because it sounded too German. They picked the name of their favourite castle; Windsor. It’s a rare example of a family taking their name from a castle and not the other way around.

But, much like most of your posts, the things you write no more prove your various, shifting, transient, ephemeral ‘points’ than the existence of elephants prove that UFOs exist.

No, it’s not my choice, it’s fact.

The fact that you use a phrase like, “The laws of the sea,” shows that you don’t know what you’re talking about. You watch a video and, because you think the narrator sounds like he knows what he’s talking about, and uses words and phrases you don’t understand, he must be right.

You’re still bandying around the word ‘consent’ in the misguided belief that individuals must consent to be subject to certain laws. I know how much you want to believe that, but it’s not the case. You are subject to all of the laws of the land, be it common law or Acts of parliament, regardless of whether you want to be or not.

No, it’s not about belief. One cannot choose to believe or disbelieve facts.

Knowing that you are categorically wrong is not the same as not believing in your catastrophically misguided claims and assertions. Nothing you say has any factual basis. Most of what you say is meaningless.

I’ve encountered similarly misinformed people all too often in the past. Without exception, their empty words dissolve in the wind when faced with reality.

No he's not, unless that particular battleground has moved to the forum of a swinger site.

He's just posting long drawn out threads which eventually all lead to independence. Like this one, where he eventually says he doesn't consent to the act which enables governance from Westminster, and therefore all Scots have to do is withdraw their consent to be independent.

"What about the Official Secrets Act? You don't have to have signed the act to be prosecuted under it?

Kinky is trying to make the point that you are given the option of complying with an act. For example, buying a telly. When you buy one you are implicitly consenting to the communications act which means you pay your TV license. (He might not like it but it's true)

Same with the official secrets act. When you take on a role that requires it you are usually informed and sign your consent to be covered by it. Otherwise you don't get the role.

But ultimately he is trying to say that he's not covered by the act of union as he doesn't consent to it. Yawn.

"Ps

The queen is Elizabeth from the house of Windsor correct ?

Her legal entity name is Elizabeth Windsor correct ? Hehehe your all welcome

Crown owned dont believe me look up your own birth certifcate lol"

The name was changed from Saxe-Coburg and Gotha to the English Windsor in 1917 because of anti-German sentiment in the British Empire during World War I

but we will let your mistakes slide once again.......

Once you start to pay income tax or vote you have then given consent to be governed.

The only way out of this is to withdraw as a citizen of the UK, but then you would have to leave the country.

I was trying to make the point that you don't actually need to sign the official secrets act, yes they make you sign it if the role requires it, but you can still be prosecuted under that act if you haven't signed or consented to it, more as an example of where Kinky's argument is flawed - not that they needed any help there...

I gave up yesterday trying to educate Kinky , they just refuse point blank to acknowledge simple true facts that are so easy to look up on the net.

They refuse to look anything up that will prove that they are wrong yet constantly whine on that everyone else should do their homework and look stuff up that does not fucking exist to try and prove they are correct.

Shite fret no daws lamo lol rolf lmao hehehe hahaha yadda yadda

"Tax law is not common law, yet we all have to pay taxes or face the consequences.

Kinky, do you pay your taxes?"

An extremely simple question, that is too hard for Kinky to answer because it blows their argument out of the water, in their language, it debunks them.

Burton on Trent

I once arrested a person for assaulting a fellow police officer. And he went off on one saying that he had a right to do it for self defense under pagan law, and that we couldn't prosecute him. He kept screaming it all the way back to the nick in the van. And through custody. And in the cells.

This thread is very reminiscent of that

So you stand under Common Law.

How is Common Law made?

Who makes Common Law?

Kinky, you pay taxes. You can't go into Tesco and refuse to pay the VAT.

You can't fill up at BP and refuse to pay for the duty and tax.

You can't refuse to pay your road Tax, and continue to drive around regardless.

If you work, your taxes are moat likely deducted at source, so your income tax and NI is taken from you, regardless of you "consenting" or not.

You have been thoroughly DEBUNKED!
