2nd travel ban

so don juan has had his new revised travel ban blocked nationwide because it's unconstitutional .... the trumpster is getting a comprhensive public education on the american constitution lately... i hopes he is paying his tutors for his schooling

its been blocked in hawaii so far.... but there were two other places where appeals against the ban were going thru today and we may hear from those later (in washington state and in maryland)

the problem trump has is actually of his own making buy opening his mouth.... saying in the presidential campaign that he was going to institute a muslim ban (which would be unconstitutional)

and then rudy gulliani saying on fox news that he was asked by trump to try and see what would be the closest he could get to a muslim ban legally.....

so the arguement is "travel ban" is really "muslim ban" in all but name... especially since they took countrys on/off list without reason (iraq) and none of the countries on the list have produced anyone who has committed a terrorist act on us soil since 1975.....

this one will go to the supreme court

I didnt realise that the Executive Order was called "Protecting the nation from foreign terrorist entry into the United States"!

Why doesn't he just make terrorism illegal? Simples.

The judge from Hawaii is a federal judge so the block goes nationwide until Trump decides to appeal and he lost the last appeal so...

this one will go all the way to the supreme court and it really hinges on one simple question that everyone is still asking now.....

do you take any comments made by trump in the past/present "literaly" or "figuratively".... as in the context of candidate/president

if it is the former, then those comments are admissable... and trump loses the case as it is then based on religious discrimination...

if it is the latter... then comments in the past are inadmissable, and he wins based on the text and language used in the executive order....

trump may have again shot himself in the foot minutes ago by saying and admitting that the second order is in effect a watered down version of the first, and that he didn't want it watered down...

so again... if we take him at his word... then he loses...

Quite amusing it is a judge from Hawaii.

It's not just trumps words, miller fucked this one over with his comments, comments trump praised him for.

That is the think about the Right, they are clever in a cunning, deceitful, manipulative, greedy way but not clever in an intelligent way.

Lets face it, the initial 3 month time span will be long up and gone before this is settled,

so realistically, they should have updated all visa regulations and there will be no need for a ban full stop.

the verdict for the maryland judge is in...... and again it is blocked... and again in the verdict summery it uses trumps own words against him....

so between the words of trump, miller, gulliani, and trump again last night... you thought he would have learnt by now to shut up!!!!

this will go to the supreme court eventually.... the hawaii case now goes to the 9th circuit federal appeals courts, the maryland case will now go to the 4th circuit appeals court

the 9th is considered to be more liberal.... the 4th is seen as being more down the middle...

A good move now would be to how to the courts descision gracefully as it's detracting from everything else his party is trying to achieve and taking up too many resources.

If anything did happen in the future reguarding any attacks that came out of it then would be the time to say something more.

I'm actually really interested in how this all turns out. Trump has made comments that he would support going to the Supreme Court with his original version of the ban - I wonder if the Department of Justice agrees...

More interestingly from a legal standpoint is the 1st amendment constitutional argument regarding an establishment of religion. The decision of the Hawaii court was heavily dependant on this aspect of the case.

As anyone who studies constitutional law would say, no right or amendment is absolute, and that includes the establishment clause of the 1st amendment. If this does go to the Supreme Court it isn't necessarily a win for people against the ban. The court could very well rule that the Executive branch's power at the borders regarding national security is enough to restrict the reach of the establishment clause. However, such a finding would ultimately be against the interests of the consevative right - it is generally understood that the establishment clause is a protection FOR religion, not against it. As such, it is championed by the religious right. We have to remember that it is the clause the protects Americans against secularism just as much as it protects against a state-endorsed religion.

This would put conservatives in America is a really difficult position. Pitting National security against religious freedom is a traditional American conservative's nightmare.
