Another analysis was that he was beginning to realise that freedom of speech in the USA is harder to fight against in a court of Law. If the Press decided to take a negative stance on the pair, his route to 'compensation' would be so much more difficult and inordinately expensive to do than it is in the UK.

In fairness the First Amendment is pretty bonkers. There are a lot of caveats attached to it plus there is a whole movement called "first amendment auditors" who basically seem intent on pushing their luck.
