If he doesn’t owe the money , the time to challenge the demand was before October 2020.
If that judgement is actually for real, then he would have had multiple reminders snd opportunities to resolve this up until (and on the day) the Court hearing that issued the CCJ.

You are right. Anyone can apply.
However, failing to respond to the Claimants multiple evidenced demands, failing to attend Court and then waiting 8 months to try to set it aside is unlikely to be viewed in the best light.

I am assuming only someone with a grudge or an axe to grind would take the Prime Minister to court. The Plaintiffs name or service provided do not appear to be publicised. Anyone can go online and issue an invalid county court summons . |

Whilst anyone can apply for a CCJ, for a CCJ to be issued and judged on there must be credible evidence of an unpaid debt. They are not issued like flyers through your door.
He may have eventually paid the debt so wants it settled . It’s embarrassing so denials like the bodies piled high comment will be thick and fast. He’s not afraid to lie as he knows he gets away with it.

We don't know the full story yet but if it's a personal debt (arising out of his personal life or other business interests) I hope tax payers money is not being used to support his legal advice and strike off process ( reference help from no 10). It also irritates me that senior politicians ( in any party) seem to need wealthy friends to pay for their holidays whereas the rest of us only spend what we can afford but that's probably another thread. |

Anyone can issue a claim online regardless of whether it is true or false. You simply enter the details and pay the fee. There is no verification process . |

I wondered about that and it seemed a very small amount for defamation maybe the BBC got it wrong.it seems very strange to me that the media dont know what its for or who bought the claim against him which makes me think its just another stunt. " Had the plaintiff used the correct procedure she would either have sought legal advice or used the correct forms .
Any solicitor would have simply laughed at her for even considering issuing procedures against the prime minister .
Her other option would have been to use the correct forms which is a more expensive and time consuming process.
Did she send a letter to Boris first advising as to why she thought she was defamed and how she calculated the amount owing. Such a letter would be sent recorded delivery. She would also need to prepare pleadings. Her action would simply have been struck off at the first stage as an abuse of the process and she might have ended up with a costs order against her . |

Seems more likely she has claimed for something related but not actually defamation which would have been struck out as said.
Maybe she claimed for stress, time off work, legal advice, something like that. |

I don’t think Boris needs to lose sleep over this.
Seems plenty people are losing it though.
It's a media exaggerated stunt and as usual, plenty of people have fallen for it mainly because they hate the PM. It would be good if HM Courts could make an example in this case and prosecute the plaintiff for deliberately making a false statement on a County Court summons. In a event you cannot use the small claims procedure for defamation.
Which members of the court staff ( in any ) reviewed the claim before allowing the judgement to be registered.
Claims such as this make a mockery of the judicial process .
It must be an embarrassment for the Courts service.
The details have yet to be made public and you want someone prosecuted?
Please pat if you ever get a jury summons, decline it ..

Must be handy being a PM and getting your debts and court orders cancelled.
I am sure that he is totally innocent and there is a simple explanation.

I know from personal experience how you can get a CCJ against you for something you didn't owe or even know about.
It took a couple of months to sort out but I got it removed from the court actions and my credit history.
Pain in the arse but I suppose its just one of them things that can happen to anyone if enough people fuck up enough  |

And the final result is . . .
"Boris Johnson no longer has a county court judgement against him after his lawyers sought to strike out a claim for a £535 debt for alleged defamation.
Downing Street said the claim against the prime minister had been "totally without merit" and "vexatious".
The PM's lawyers lodged an application to have the judgement struck out.
A court official confirmed a CCJ was no longer present in the case after applications were considered by District Judge Hammond."

She will now have a costs order against her . Let's hope it is enforced. Most senior government ministers have received court court summons from her.
In this case a criminal prosecution would be fully justified for making false claims. |

She could wind up as a Vexatious litigant hopefully. As whilst it’s quite amusing Boris ended up in this situation. He had the full weight of number 10 to extricate himself.
If the lady does it to others as much as they say it’s not a nice thing to do and not as easy to extricate yourself from as a normal person I should imagine. |
