Does anyone know what happens next after getting pulled over by the police for not wearing your seat belt??

Was told I’ll get a letter in the post to attend court.

It's none endorsable (as passengers in vehicle may not all have a licence,so cant be issued points,even if you were driver and licence holder)

The driver is responsible for passengers under age of 14 to wear seatbelts,over that it's the individuals responsible

Might sound cliche but I was en route to be a shoulder to lean on for a family m_mber after some bad news. no valid excuse especially since the seat belt is for my own safety.

I've been caught a few times... usually just got a warning at the roadside think once was a 7 day producer but they don't do that anymore. Odd for it to go to court in my experience.

Were you specifically asked if you'd a certificate of exemption? If not pop, check what fits medically online and pop off to your doctor before court

Put that into percentage terms of the billions of people who drive on the roads in those 8 years and the number would be miniscule. Meanwhile other victims of crimes are told the crime can't be investigated because of lack of manpower. So 4 police officers for someone not wearing a seatbelt is ridiculously excessive.

Up to £500 not fixed at £500 and it's not an endorsable offence yet that is still draft legislation I believe, so no penalty points

It reads as if they were all in the same vehicle, not that 4 officers were scrambled to the scene for back up. They were already there so just got out of the van.

As others have said it's a non-endorsable offence. £100 and no points. However, some forces are moving away from the decision being made on the roadside and instead measured by their seriousness in the circumstances (although this is usually for endorsable offences such as speeding).

Which is what the OP has said already. She agreed she was in the wrong. She hasn't looked for excuses or loop holes to get out of it. She just wanted to know what the likely outcome was from other people's experiences.

Surely there a more important jobs police officers could be doing. Motorists are easy targets.

My cousin is a traffic officer who has visited 382 fatalities in the past 8 years. He'd probably disagree. Put that into percentage terms of the billions of people who drive on the roads in those 8 years and the number would be miniscule. Meanwhile other victims of crimes are told the crime can't be investigated because of lack of manpower. So 4 police officers for someone not wearing a seatbelt is ridiculously excessive.

It reads as if they were all in the same vehicle, not that 4 officers were scrambled to the scene for back up. They were already there so just got out of the van. "

A lad I used to know was out with a car full of friends many years ago and his rear passengers didn't have seatbelts on. He flipped the car while going too fast overtaking thinking he was clever, one 17 year old girl was thrown out of the window into the road and died instantly, and his 20 year old best friend was thrown out of the other side into a ditch before the car landed on him causing horrific injuries and putting him in a coma for months. It would still have been a nasty accident regardless, but had they had seatbelts on the girl would probably have survived and the other guy wouldn't have ended up having his body rebuilt and being permanently crippled. The driver got significant jail time. Sorry for the lecture but I can't believe people don't put seatbelts on, just why wouldn't you?

you have to go on a crash test dummy awareness course it costs £200 but you don't get the 5 points on your licence "

£100 fine, no points. You should have been given a ticket roadside. If you pay you accept the charge if you don’t you go to court.

That’s what I was thinking but wasn’t given that option.

That makes sense especially if it’s a first time offence

As far as I'm aware it's just a fine for not wearing a belt. Not trying to preach but most modern cars now have alarms now. Hopefully being your first strike you won't have the book thrown at you

You will get a NIP (notice of intended prosecution) through the post. There will be an option in there of paying a fixed penalty of £100 or ignore it and wait for the summons. Most people just pay the fixed penalty unless they can prove that they are innocent.

To prove innocence you will need to prove that you are except from wearing a seat belt as the officers body cam will show you not wearing it as will the camera on the car, so denying it will get you nowhere except a charge of purgery.

Its usually a £100 fine and no penalty points for a first offence so I wouldn't worry too much about it.

The law changed last July. It used to be £100fine. But new stricter measures, were introduced in July 2019 to stop repeating offenders. This means if they take you to court, the fine can be up to £500 and you definately get 3 points on your licence. Taking you to court now, varies from force to force. It may seem harsh. Good luck though anyway x

A seat belt offence is non-endorsable so it's just a fine not points

I rem_mber correctly the only reason you would go to court as if you are contesting the penalty so other than that is an on-the-spot written fine

It's usually a fixed penalty notice through the post, court is only required if you contest it .

i always wear my seat belt but its the law and yes the law impose it and reap the benefit of it imagine a government minister claiming tax relief on his wife cleaning their own official residence, shes cleaned it and surely that demands payment so how should they not claim tax relief

Not really, after all it is the Law.

its viewed as taking advantage of the system and yet the police can directly benefit from the laws they govern

I drive all day at work without a seatbelt, when I get in my car to go home sometimes it just doesn’t register that I’m driving without one on, my car doesn’t have the warning light or annoying sound to remind you. It’s easy done I’m afraid.

Not really when you think how much would it cost for emergency services to come out and put her in a body bag if there had been a crash and she had gone through the windscreen. I know two people that have died this way one at just 19 so buckle up and be safe or safer at least.

There was a crash on the A23 a few years ago, the passengers died at the scene for not wearing a seat belt. The rear near side passenger had life changing injuries, due to not wearing a seat belt. The rear offside passenger got whiplash, he was wearing a seat belt.

There could be a moral there somewhere.

Maybe best to ask google than people on here ;

Normally dealt with by way of a Fixed Penalty Notice (£100.00 fine) but carries a maximum fine of £500.00. It is not endorsable.

Statistics aside and to cut a long story short. I had an accident many years ago before seat belt laws, had I been wearing one and unable to slide onto the passenger seat, I would not be here today as a telegraph pole pushed the engine into the drivers side in the crash. So there is always a flip side to safety and statistics.

It's not fun pulling the steering column out of someone's chest though. Ruins your nails!

OP. If they have decided court then they have 6 months to summons you. Its unusual to go straight to court though. If you already have you to on your licence, they cant give you a ticket if the points on the ticket would take you to 12.

I’ve not heard anything back from them yet. Just waiting to see.

I have never had any points on my licence. Will just take the route that they chose in the end.
