A fair point, but when you make a statement that applies to two groups but narrow it to one you are being pretty misleading. If that wasn't your intention then fair enough.
Personally I'm of the view that both are as bad as each other. I'm also inclined not to take much of a view as to how bad it actually is where it's just trying to sneak a peek. There's an argument to be made that if you put something out in public then the public have every right to gawp at it. Depends whether the person puts hands on a person. For me if you can see genitals without putting hands on a person to move something covering it then the responsibility falls to the person choosing the clothing, not the person doing the viewing. |

Yeah I agree that's creep behaviour, and of course recently illegal. I also pretty much abstain from a view on that act. It's behaviour I wouldn't do, and certainly deserves social consequences such as being considered a prize cunt. But criminal sanctions... Not sure.
For me there's an acceptable level of perving on members of the general public. If someone is wearing revealing clothes, it's fine to take a good hard look at that backside and mentally save it to your cerebral spank bank. They are usually wearing such an outfit because they want to attract attention.
If an upskirt situation presents itself from time to time (like say someone sitting inelegantly opposite you) and the gusset angle falls directly in your eyeline, that's an act of God so far as I'm concerned and it is righteous to enjoy that moment, verily I have gazed upon the illicit gusset, and it was good.
But to put yourself specifically into a position to attempt to make it happen, no, that's creeper behaviour because you are the actor and she the acted upon. As opposed to her being the actor in inadvertently flashing you, and you being the acted upon |

If you don’t think upskirting deserves criminal sanctions you’re part of the problem, not the cure.
We’re talking about men photographing women’s crotches by putting their phone at thigh level pointing up their skirts, or photographing under cubicle walls in changing rooms or toilets.
It’s a massive invasion of privacy and should 100% be subject to criminal punishment.
Also - when I wear clothes that show off my body it’s for me. Probably because I’m hot but don’t have the benefit of being able to take my shirt off like men can. It’s not for some bloke to stare and get a record for his mental wank bank. What else should I do - cover myself up from neck to ankle loose fitting clothing all summer?

I really couldn't care less what you do, wear a tuxedo if you want, it's of no concern to anyone else. There are ways of staying cool without thrusting your body out there, as men have to do. Don't want those, that's fine but don't expect to be able to put these things out into the public and for you ONLY to be looked at by the target audience for your self centred elitism.
As for being part of the solution or the cure, once again you seem to be confusing me with someone who gives a shit about the problem or the solution in this case. It's a behaviour I don't do, that both genders do seem to do to each other. That is probably massively overblown in terms of prevalence. It's not something that I'm going to lose sleep over, nor is whether you think I'm "part of the problem"
I do also love your false equivalence, I stated quite clearly that where the viewer has to take an action to see what he is seeing, then he is the actor, she the acted upon and he is therefore the creep. A person who is abusing changing rooms is effectively a peeping Tom and as I understand it existing legislation should cover this.
I'm not losing any sleep over the upskirting statute, I'm not even saying it's necessarily bad. I'm saying I'm not 100% certain it is proportionate, particularly in a world where women face absolutely zero consequences for far worse sexual harassment and assault.
