YUK! I would be in the baddest of moods on night 1
But the 6 days off would be something to look forward to,but then again you'll be sleeping for one of those and then having a sleep before you go in on night 1
How long is your shift? |

Look in to home care private sector with an agency if you have them round your area and look into bank staff too more money. And do the hours you choose. |

My mother is in the same position as you right now she going from a 7 day night with one week off to a 4 day night and 3 days off.she contacted the union and is fighting it.good luck and hope you get it sorted. |

Because the last girl that did other nights left we got a new boss who seems to think wont get anyone to do the other 3 nights when infact those that have done the other nights have done it because it fitted well in their lives. The way it has worked without any problems has been I do Sunday thro wed and the other does the Thursday to sat with the understanding that at any point if either of us needs to swap a shift we can do and as I said has worked fine for nearly 3 yrs. |

A legal contract of employment can only be changed with the consent of both parties. If you do not consent to it then simply tell them so. They will then have to give tou 3 months notice of change in terms and conditions.
If it is then forced upon you you could resign and put in a claim for constructive dismissal.

can they change your shifts that quickly ?
i thought if a precedent had been set ref the regularity of shift patterns then employers need to provide notice of an intrinsic change ? |

im having to do 7 nights a week at moment due to having no night staff im the only one
started this batch on the 17th dec with no nights off hopefully be able to have a night off soon
fed up putting em to bed and getting em back up all the time with no help
if one dont want to go to bed i now let her stay up so im not talking to meself for 12 hrs |

that's just wrong _oddy, not only from your perspective, but also from that of the residents.
it is however nice to note your commitment to the residents, which i guess in addition to the pennies is a major factor for you in being so conscientious.
you can't let go on though - at some point you need to make a stand for your sanity, health & well being and also for the people you look after xx |

Pretty sure there is only a certain amount of hours you can work in a week, bearing in mind it would be 8 days on might be worth checking.
Wouldn't dive straight in with a constructive dismissal claim as it really isn't that simple. I do feel for you though! |

That depends on whether the employer has "made" his staff sign an opt out to the working time agreement or as in the case of some employers now, making it a condition of employment. There should be no more than a maximum of 48 hrs worked per week (AVERAGED OUT OVER A 17, 26, or 52 PERIOD) There is also the matter of ensuring min 11 hrs off between shifts, again averaged out over a variagating period.

A lot is going to depend on what process is set up between the employers and the unions. If this is what is classed as a Managing change exercise, they should be giving a 30 days consultation period, at the least and 90 days at most, followed with a 90 notice period. Get the union to check it out. Staff should be consulted and the legal notices given. |

I had a similar situation where I worked where they wanted to change our working patterns which really didn't suit me in the slightest. They gave us the requisite notice for it. It was reliant on no one leaving during that period as well as we were at minimum numbers to be able to do it.
So I did what I had to do and one month before it was due to start, I handed my notice in. A huge gamble as I didn't have another job but it has all worked out for the best for me.
Don't let yourself be bullied by your boss. |

The very first thing to check is your contract of employment (and T&C's, employee handbook etc).
Are you contracted for 40hrs per week or for 80hrs per fortnight or something else.... how many days is a week/cycle defined as ... and so on.
Then check if there are any explicitly stated reserved rights for the employer to change the rota/working patterns (this does not have to mention anything about the hours worked).

Just a quick update , having stood my ground and finding another job my boss finally listened when I said wasnt doing 7 on 7 off. So I am now doing 3 nights 1 week 4 the next with a morning shift as well to make up hrs as the dozy bugger hadnt even checked my contract which is 40hrs a week. I still lose 5 hrs a month which I can make up if I want but seeing as how I also got a pay rise then dont think I will bother. Am still going to do the training days for the other job incase the hrs dont work out but at the moment I am happy. Thank you all for your help xx |

Lol I got my 90 day notice just before xmas. Some notices ain't that good!
Been there 13yrs on shifts so will get a good pay out. My shift rota gives me a block of 8 days off a month.. which I spend sleeping.. lol
Gonna be 1st time on dole since I was 17.. Never mind I'll have lots more time to play now

Their staffing problems are not your concern. I'd check with thw CAB about the Working Time Directive because if you haven't opted out of it they can't force you to work more than 48 hours in one 7 day period. (you'd know if you had opted out as they'd have asked you sign a form that says they can ask you to work more than 48 hours/week if required to do so).
Also, point out that you have structured your out of work hours to suit your current working pattern and to change your hours would affect other people who don't work where you work. |
