Refused a purchase

We took an item off the shelf in M and S today, took it to the till where the assistant said "I can't sell you that" and showed us the screen saying "do not sell until 13th November".
I'm flabbergasted
We came home without the item.
Has anyone else experienced this? |

I did once decide that is indulge in debauchery with a fab member, only to be flabbergasted to find out that when I went to summon them, I was unable to view their profile!!!
Odd...why put it on the shelf?? |

I can sort of understand the next day but almost two months! This was hanging there among everything else.
I know contract law says they are under no obligation to sell to me but still. |

The manager who I requested to deal with the incident would only talk to the assistant on the phone and could offer no plausible explanation. It was a mistake I'm sure. |

It's the Sunday Trading Act that gives smaller shops the ability to open earlier than later shops. Idea is to create a trading advantage for smaller shops |

I got an immediate answer from customer services. I'm not satisfied with their answer so I'll be escalating it.
When I did have a Twitter account I had so few followers that nobody would care lol.

Ask for their complaint policy when you speak to them tomorrow. I’m sure if you escalate it they might end up sending you the item in question. M & S aren’t doing great so they need good PR. |

I was but I really wanted the other thing so I bought it.
What has really annoyed me is that they've done the standard thing of listening to my concern, patting me on the head and sending me on my way. I don't expect compensation or heads to roll just an explanation. |

Having worked in retail some items get recalled and are under investigation. Stores are supoosed to remove these items but your store probably didnt. From central support the tills will automatically prevent these items from going through the till. I see your frustration it should have been removed from shelves. |

Although sometimes shops have fireworks, for example, out early but in some places you can't buy them until a certain time. There should be a clear sign explaining that though! |

Something got put on display that shouldn't have been, simple human error. Could be one of many reasons why it's not supposed to be sold yet. It could be a breach of contract with there supplier to sell it early for example, The ramifications of that could be expensive for them so makes sense not to let you have it. |

But if I pick something off the shelf and leave the money on the counter, I don't need them to accept the sale in any way and I can't be done for theft. Legally.... Can't be displayed on POS (Point of sale) unless it's a legitimate item for purchase.
Regardless of whether the checkout screen says "Not to be sold until November 13th" it MUST be sold if it's under the point of sale UNLESS it clearly states "For display purposes only. Not for retail" Consumer law says that an item displayed under point of sale with a clearly marked price can and must be sold as seen in the place of display.
The store itself could be fined under the trading acts for false advertisement and fraudulent enticement (They've advertised the goods to you and encouraged you to make a decision to purchase it and failed in both counts to keep their side of the sale)
Consumer law is a technical minefield but if you voiced the concern I guarantee you that tomorrow morning that product will either no longer be visible or a very clearly and differently worded sign will be in place. |

I suspect the goods are on recall it would have been worse if they'd sold you a faulty item especially as it was going to be a gift. I wouldn't waste anymore time on it. It was after all only a minor inconvenience in daily life.

Indeed. It’s probaby Christmas/seasonal stock that’s not intended to be sold until later but some poor soul (probably a teenage weekend worker) will get a bollocking for thinking they’d done a good job in getting all the stock out. I get it’s frustrating but mistakes happen, hey ho.

So not only was the assistant indifferent, the manager couldn’t be arsed to come and offer decent customer service either!
Nothing grinds my gears more than shit customer service. I’d be very hard pressed not to put this on social media if it was me |

No. A shop can remove item from sale and don’t need to give a reason.

But if I pick something off the shelf and leave the money on the counter, I don't need them to accept the sale in any way and I can't be done for theft. Potentially their sign negates that principle.
There wasn't a sign anywhere. If I offer money they can refuse to accept it so no contract is formed as I understand it. That's what happened here.
No that's the thing, there is no contract. That's a vital part of why I couldn't be arrested. The fact that they put the item on display and state the price they want for it, negates any need for a contract.

So you didn't read the part where i said I left payment on the counter. You're just flat out wrong about "permission". Yes they can remove it from sale but if you've picked it off the shelf and are intending to pay for it then they can only ask you to put it back. |

Or the store manager was so busy dealing with the other 20 jobs they had to get done before the end of the day so they could get home at a reasonable time to see their family. A lot of the retail industry is really struggling at the moment and staffing is tight, not because the manager doesn’t want to recruit but because the budget won’t stretch from the powers that be.
Nothing grinds my gears more than people with too much time on their hands to complain about trivial matters.

It’s to do with Sunday trading laws. Shops (other than convenience shops), are only allowed to trade up to 6 hours on Sundays. So they allow customers to ‘browse’ an hour or so, as long nothing is put through the till before the ‘official’ opening time. |

Regardless of whether the checkout screen says "Not to be sold until November 13th" it MUST be sold if it's under the point of sale UNLESS it clearly states "For display purposes only. Not for retail" Consumer law says that an item displayed under point of sale with a clearly marked price can and must be sold as seen in the place of display.
The store itself could be fined under the trading acts for false advertisement and fraudulent enticement (They've advertised the goods to you and encouraged you to make a decision to purchase it and failed in both counts to keep their side of the sale)
Consumer law is a technical minefield but if you voiced the concern I guarantee you that tomorrow morning that product will either no longer be visible or a very clearly and differently worded sign will be in place. "

I suspect the goods are on recall it would have been worse if they'd sold you a faulty item especially as it was going to be a gift. I wouldn't waste anymore time on it. It was after all only a minor inconvenience in daily life.

Not being able to buy items in display in a store the run isn't exactly trivial though is it? OK it was just a scarf but as the crux of their business is providing good service so people return not sparing 5 minutes to just talk to a customer to explain why the error occurred isn't that taxing for them. |

Kinda similar story to yours, I went to purchase a car the other week agreed with the salesman was going to buy it there and then with cash but literally 2 mins before we finalised the sale someone made a finance application on the car online so I was then told I could not buy it even tho they would have had to come to the site to sort out there finance I still couldn’t buy the vehicle to say I wasn’t abit annoyed is a understatement |
