I was woken up by thumping and banging which made the whole house shake, together with loud music at 4.00 am. I banged on the door of the upstairs flat to be met with mouthfuls of abuse including "Go back to bed or I will fuckin kill you".

I phoned the police but they said they were too busy to send someone as they had emergencies but would leave it on notice. It is now 5.22.

The noise is less now but he is still thumping about and shouting. I can't knock again as I am scared and I am on my own at the moment.

Anyone had this kind of thing? What can I do I am at my wits end. This is happening more and more these days but I will be scared to knock now.

Did you inform them that he threatened to kill you?

Yes, and they told me not to go out and knock on his door!

what do you think he is doing?? How regularly is he making noise? Is it worth involving Environmental Health? The police in my area dont get involved in noise complaints.

They phoned me back just before I posted to see if I was alright and too say they had emergencies hence the delay.

I will phone the council tomorrow and see what I can do but they are just gonna give me forms to fill in for sure.

I don't know what to do really. I feel sick.

Hopefully he will get tired and drop off.

Council will just give you a diary to keep and present to them at a later date.

Was the same last night. Started at 12 and I knocked and asked him to stop as I needed to sleep. He stopped then at 2 ish it starts again and woke me up and I banged and banged on his door till he stopped. Went back to sleep and then it started again at about 4ish and I banged again and was returned with abuse.

He has done it before, he seems to have periods of it but usually stops when I bang. Tonight he was really abusive, scarily so.

Yes it's reasonably quiet now. Still hear the music but I can sleep though that. It's when he starts banging and thumping, then it's impossible obviously.

Will try to get a bit more shuteye before getting up again at half seven for work.

Maybe he is making you a christmas present? Table and chairs set? A small rowing boat? A set of stocks? A small cage........ run, just run, Devon is safe

My friends experienced this from a neighbour above including the loud music, the banging about at all hours, the death threats and even him attempting to gain access to their flat (with a sledgehammer).

The police were sadly ineffective, but although it took time, the council worked through a due process with the guy which resulted in eviction.

If you follow it through with the local council they will work with you to sort it, but it won't be an overnight solution.

Sorry to read of your troubles.Keep a diary of all incidents as the council and the environmental services will need details. It does take time but the diary will help with your complaint.Good luck

You need to be firm with the police, this guy is making threats to kill you, even if they take it as a public order act, they can still arrest. Threats to kill is a criminal offence, and does carry a sentence in prison. Next time you tell the police, inform them of their duty of care, you have telephoned for help several times, and if this isnt investigated or a squad pays you a visit you will take it further.

Also remind the police of the victims of crime, how many of those contacted the police for help, i can name several, only because, unfortunately we use them as case studies in our business.

Phone the police back and tell them it doesn't matter because you have shot and stabbed him, they will be there in minutes!

Tell the police you are keeping a log of the time you have to wait for them to respond to a threat of violence/being killed and when something serious happens you will use that in a court of law against them.

As previously mentioned.... LOG all incidents, times & dates.... if you can, use your phone to record his comments & the noise levels...

Most Councils now take threats like these very seriously & some have specialist teams that deal with them.

When you ring the cops next time......... insist on speaking to a senior officer, not just a voice on the phone.... get there name, rank & number.... the police have a duty of care to protect the public.

You need to contact the landlord and tell them what is going on including the threat. Ask them for some log sheets, if they don't have any, make a note of the date, time started, time finished, how many people you see entering, whether they are male and/or female, what age, what the noise is, how it affected you and what you did. If up called the police, make a note of the time, date and incident number plus what they said and did

well they did visit after I said some of the things you advised.

However they said that to prosecute for a death threat they have to prove that he really believed that I really believed that he was going to kill me and that because I stayed in my own home and did not run away that would not hold up.

They did however try to have "a word" with him but found only his girlfriend at home. Afterwards they knocked again and explained he was not there and they had asked said gf to pass on the message to reign himself in and said that I could contact them again if it reoccurred and I was frightened again.

They also advised me to contact his landlord and to start a process with the council also.

Let's hope he does not try to kill me in the meantime.

I had a neighbour like this a few years ago. She would start shouting and screaming, banging the walls, singing at the top of her voice etc. She also went outside and marched around shouting and singing. My other neighbours called Environmental health who put a device in their flat to record the noise and how often it was. They also chatted to me.

It turned out that she was extremely mentally disturbed but had been removed from the home she was in, and her aunt thought she would be alright on her own . After a while she was evicted and we could all sleep again. It will take time but really use your council. If you are in rented accommodation nip to the CAB to see what they say about your rights too. Call the police and/or Environmental Health EVERY TIME this happens and they will do something about it. It just takes time.

You should contact the local Environmental Health. For you it would be Medway Disctricyt Council.

If this person is continuously making noise and other complaints have been received, especially of the threats, he may get an ASBO and if he is a public sector tenant, may be given notice to quit.

If you do phone the police again mention the threats. If you are a lady alone, they should respond and disable/ confiscate the noise making equipment.

Fat lot of good the police did, had another night of the same last night.

Contacted them again but they did not come. Have contacted his letting agent and also the council.

Phone the police again and ask to speak with your local beat officer, keep a record of what's happening, when and for how long, the local beat officer can if the problem persists take them to court and get an Anti Social Behaviour Order ( ASBO ) slapped on them, also if it's social housing the council have powers to stop it from happening ...

Thanks all. Need a bit of a morale boost. He does not work and makes noise anytime from about 3 pm onwards and throughout the night, intermittently.

Have furnished both neighbours with the incident room number and asked them to phone if poss and get an incident number each time and given them a form to fill about disturbances. The lady next door gets pics falling down!!!

The police keep saying there is nothing they can do. I asked the council about ASBO and they said that was police business too.

Well pulling out every stop I find now. It's survival of the fittest and I have had it up to here!

If he has got a social worker then they should be supporting him to make sure he is managing his tenancy properly, if he is not and you don't think the support is good enough, speak to the superior officer, ask what support package is in place and explain what has been happening, just make sure you tell them that it is not good enough
