advice needed

my sons girlfriend works for a well known fast food chain. twice she has booked the weekend off following correct company procedure. on both occasions the time off wasnt given and she wasnt told why. is there anything she can do? she has been there about 18momths

Any company should have a grievance process in place as well.

no they just ignored both requests. she has to apply online and write in holiday request book at work which she did. this is meant to be checked before next rota given they just said we never checked.

In which case they aren't following their own procedures, so a complaint should be made.

That's quite poor on their behalf.

She should use the grievance procedure using any evidence of her following the rules and them blatantly ignoring them.

she would need to look at her contract of employment, this would set out both procedues, how to apply fro holiday time off, and how to raise a grievence with teh company.

does she have proof they said they never checked as per procedure? that will be very important in any case she raises.

IS she in a union, if so she should speak to them

who she works are known for being bad to work for but she needs the job. will have a chat with her or my son and get them to check her contract

I was about to say that she doesn't really have a leg to stand on, as not granting holidays at a particular time doesn't constitute a breach of contract (unless her boss refused to allow her to take any of her statutory holidays in the year)... but the last point you made in this post is her 'get out of jail free' card.

She should ask to speak to either her manager's manager or alternatively someone in HR to raise this as an issue. Her not being given time off for operational reasons is one thing... her not getting the time off because her boss didn't bother to check the holiday booking system is another completely different matter.

Of course, she could also mention to her manager that she's requested time off in case he's / she's not seen it, but it still doesn't mean that her boss is without blame if it's his / her responsibility to check the holiday system.
