A mother was in a garage paying for her fuel, kids in the car when a man started breaking into her car and trying to steal it. She managed to get in the back seat before he got away and told him to stop. When he refused, she shot him in the face.

When contacted by reporters, said woman had this to say to the thief:

"I wish i would've killed you, if i didn't already".

That's my kind of woman

What a peculiar thing to not only think but then to post.

I mean it probably didn’t happen, unless the mother thought it would be a wise idea to murder the driver of a speeding car with her and her children in, as opposed to telling them they can have the car if they let her and her children out

In that particular case, he shot the burglar in the back, as he was running away, so self-defence does not apply, as it would have if the burglar was approaching him. Probably the same in Texas.

Plus the pump action shot-gun was not registered, so again he'd probably have been charged in Texas, let alone the UK.

He served three years for man-slaughter.

Tony Martin shot the guy in the back. The jury decided it was difficult to claim self defence if the attacker was facing away from him.

If he'd been facing Tony Martin he would probably have been found not guilty. And rightly so.

I'm not saying he was wrong.

He'd been burgled a number of times before the incident. He was given little in the way of support or protection.

He was undoubtedly at the end of his tether. Angry frustrated and scared.

I belive the length of his sentence reflected a degree of mitigation for his actions.

Personally, I'd have done things very differently.

Tony Martin was in unlawful possession of a firearm, and he shot the two thieving shitbags as they were running away, hence he was no longer under threat, hence that's why his actions were illegal. He was also accused of being lying in wait so his actions were deemed premeditated. I have every sympathy with the man as he had endured endless similar troubles, however he acted unlawfully in how he went about it. His was a landmark case and was the start of turning things around to emphasise the right to self defence.

The bizarre thing in our legal system is that if you have any article intended for use as a weapon, self defence or otherwise, it is then deemed an offensive weapon and your acts would be deemed premeditated and unlawful. However if, during the course of an intrusion, you feel under threat and pick up an article spontaneously and use it in self defence, that's ok. You can imagine the legal wrangle though. Fortunately, Tony Martin's and a few subsequent cases have started the judicial system leaning in favour of the householder/victim, which is as it should be.

"Exactly, it's total madness that you can be done for assault if you defend yourself if someone tries to break into your property over here ffs "

If you reach for a weapon such as a gun or knife, then yes you should expect to get done for assault.

..and incorrect. If you are in genuine fear for your own or another's life, you have a right to self defence under Common Law. S.3 Criminal Law Act, PACE Act, Article 2. Human Rights. How many do you need?

What happened to Tony Martin who was trying to protect his property from thieving scumbags when outnumbered 3 to 1

Tony Martin shot the guy in the back. The jury decided it was difficult to claim self defence if the attacker was facing away from him.

If he'd been facing Tony Martin he would probably have been found not guilty. And rightly so.

It wasn't the first time he'd been targeted though, I'm not saying what he did was right, but how much can a man take before something's got to give?

I'm not saying he was wrong.

He'd been burgled a number of times before the incident. He was given little in the way of support or protection.

He was undoubtedly at the end of his tether. Angry frustrated and scared.

I belive the length of his sentence reflected a degree of mitigation for his actions.

Personally, I'd have done things very differently.

It also reflects that he refused to show remorse. Righly so in my opinion, it's a shame he didn't get a head shot. "

Got to be honest and doubtless many will slate me for it, i'd have shown zero remorse myself.

I was discussing this particular incident in one of my classes a couple of weeks ago. As it was a closed shop and not a public forum (such as this) I shared what I would have done.

My students all said, wow, yes, that would have worked.

I feel sorry for the kids. What they witnessed will trouble them forever and then they'll be allowed to also carry guns when they're older.

Troubled teens with guns!!! Just what America needs more of.

If we are allowed to arm ourselves in our own homes then intruders will come armed!!! Blood bath over a bloody tv or laptop?

You'd think that, but.....

In the States the incidents of hot burglaries have gone down whereas in the UK they're going up.

In the states a burglar knows if he's armed and breaks into someone house the chances are he'll get shot.

Over here we'd have turn all the lights on and help him carry our telly to his car because of Elf n safety.

.

Whereas the UK is desperately short of troubled teens armed with knives and acid!
