"Yes. She should also be birched for displaying such poor parenting skills. Her child should be placed into care because they are clearly not safe with such an horrendous mother. And they both should have life bans from visiting anything that is arty in any way. Or...... The arty place claims on their insurance and we leave the mother and child alone, because at the end of the day, everyone’s kid has broke something somewhere by doing something they shouldn’t have while mum/dad weren’t watching. " Also...... Where the feck is health and safety?! If a child can pull a statue over then surely it wasn’t being displayed properly and safely.

Nobody blamed the boy for fucking about, and nobody blamed the parents. Responsibility lies with the arty place to make sure it’s exhibits are safe and secure. The child was responsible for knocking over an expensive status, statue got damaged. Parent not within whipping distance. Who was responsible?... The dozy sods who thought it wasn't a great idea to make sure it couldn't get damaged, the child for climbing it or the parent. My conclusion all three, but mainly the former for allowing it to happen in the first place.

" The child didn't take a screwdriver to the statue, he was giving it a hug... quite sweet really! Unfortunately he knocked over. Maybe the mother should have been paying more attention, maybe the gallery should have made the statue more secure. If the child hadn't knocked the statue over a lot of people would have been cooing over the display of affection and praising the mother for having such a sweet child. Typical insurance company trying to apportion blame so it can wriggle out of paying up. Put your pitchforks away!

"Pay the full value of the piece, no. Pay the insurance premium of having it professionally repaired, yes. The museum should also be forced to install better security around such valuable pieces if they don't want them damaged to protect them, and anyone it had the potential to fall on. The museum should have had appropriate guarding around the statue if it was so valuable and in a position to be easily knocked over. Any venue that has high value stock within easy reach of a child, is no place to take them until they're old enough to understand they can't play with them. The mom should have been paying more attention to what her child was doing. No, I'm not a pefect parent who watches their child every second, but I also sure as hell wouldn't take her somewhere with expensive and valuable items that can be easily reached or damaged and then leave her to her own devices. They're all at fault. " It was a community center not a museum. They had the statue on loan from a local sculptor. The family were at a wedding reception being held in one of the rooms there. The stature was in the public lobby. The mother was in the room at the reception, the child was roaming round the rest of the building alone. After the statue fell another woman (a member of the public) checked the child was ok. It took the mother a further 5 minutes to come out and see what all the fuss was about.

Parents should have been paying more attention to what their child was up too. Gallery should have secured the statue better. I still think the insurance company should pay up! Anyway, who doesn't like a broken statue? All the best museums are full of them! Maybe the mother could offer to fix it. It could even improve the statues appeal, some of the worlds best art has been collaborations. Pablo Picasso and Gjon Mili - painting with light. Andy Warhol and Jean-Michel Basquiat - Olympic Rings.

Whether he was planning to hug it once he had climbed high enough, who knows. The original post stated the child was seen on CCTV hugging the statue but, you're right...who knows! Parents should have been paying more attention to what their child was up too. Gallery should have secured the statue better. I still think the insurance company should pay up! Anyway, who doesn't like a broken statue? All the best museums are full of them! Maybe the mother could offer to fix it. "Yes. She should also be birched for displaying such poor parenting skills. Her child should be placed into care because they are clearly not safe with such an horrendous mother. And they both should have life bans from visiting anything that is arty in any way. Or...... I like Nooo! Sue the hell out of her! I like seeing blood I just liked his post, especially the first bit...I have given no view of whether I think she should pay or not I don’t care if she should pay or not! I just want a long court case that is an example to other pesky kids and lazy ass parents They’d took their kid to an art exhibition. They can’t be that lazy. Health and safety in public access areas is far easier to get a win on than proving parental neglect. I’m just mad a kids because the other day i have a lift to my friend and his kid and the kid kept on winding up and down the electric window and his dad said nothing! Over use of an electric window you say?! Burn him!!!! Let’s not get carried away, it was parental responsibility to stop the minor Yeah, but electric windows are such fun " Since when did Morris Minors have electric windows?

"This was on This Morning yesterday. Yes, the whiney woman was neglectful, who allows a child that young to wander around the rest of a community centre that's open to the public whilst at a wedding reception being held in one room? The community center should also take partial responsibility as the statue was not securely displayed. They should pay half each." She's typical white trash. She lost all my support when she said "the event wasn't fancy, it wasn't at a gallery or a museum". She's got a really annoying voice too. On the other hand, I'd probably still do her. So i am conflicted a little.

"No there insured So if a child deliberately wrecked the paintwork on your car, it would be ok, because you were insured?... The child didn't take a screwdriver to the statue, he was giving it a hug... quite sweet really! Unfortunately he knocked over. It was a community center not a museum. " Jesus, anything could have happened to that child then. She's lucky that the worst thing to happen is getting a bill for her negligence

I have to provide certification for everything including my competence. I am liable for everything I do and have to ensure it is safe and secure. The kid and his parents were enjoying a wedding reception. It’s the venues and exhibit installers responsibility to ensure the exhibit was safe. It didn’t get pushed over by an inebriated adult, it got hugged by a child. " So it’s statue’s fault?

"For those commenting on insurance, yes an insurance company would probably pay out. However, thaw mother has vicarious liability and they would seek to recover their outlay from her. The child is a minor in her care and she has failed in her to duty to adequately supervise the child. I would guess there are implied terms upon entry regarding damages also. That’s the interpretation of the law. My view? Yes the mother has been negligent and if the child knocked over eggs in Asda messing about the mother should play, the value is only an extrapolating of cost and no different." Insuers only generally pursue recoveries against those with the means to pay. Otherwise it's not worth the legal cost And I would love to see you argue any vicarious liability matter here in UK or Irish Courts. It would in all probability be thrown out at a very early stage on the grounds of reasonableness. All of which ignores the fact that you can't sue a minor and indeed your faith in the courts supporting this being the "failure of the mother's duty of care" is somewhat optimistic.

"Mind you when my nephew tipped an entire tub of Chanel No 5 after bath powder down the loo I thought his mother should have replaced it!! How old was he? I can't remember - very young, 6 or something like that? It was a special gift from my ex, one of those big expensive powder puff boxes and I adored it! " We were at my parents house one and I realized that it was a little too quiet. My niece's were doing jigsaws and watching telly and practicing their dance routines to take that when we left them to enjoy the sunshine and peace and quiet of the garden. When I went in to find out what the unnatural quiet was all about, they were in grandmas bedroom mixing all her expensive perfumes together We decided to keep it as our little secret and grandma didn't seem to notice. We fessed up some year later and she pissed herself laughing

Because it's insured it's OK and acceptable? A couple of years ago, a small boy got crushed to death by a massive mirror in a shop in Bicester village. Nobody blamed the boy for fucking about, and nobody blamed the parents. Responsibility lies with the arty place to make sure it’s exhibits are safe and secure. So the parent wasn’t totally in control of their child, big deal! It’s not like she left them in an apartment and fucked off for dinner!! Yes, kids are kids. They do stupid things, and parents deserve a break. At least she was trying to give them some culture and not sitting them in front of a PlayStation with a happy meal. Clearly he's exaggerated the value for the insurance claim. He's not famous and he's one of those contemporary art wankers. So how much is it Banksy? I don't think anyone actually buys that shit I definitely would ! Absolutely love Banksy Banksy is sick! I have visited his Museum in Amsterdam and visited his hotel in Palestine (Bethlehem) aside having artistic skills I love the symbolism of his creation and how he keeps low profile a bit like Daft Punk and Bananaman " I really like his work.. he highlights the important issues of our world.. wish we will get to know him one day

"Can i just point out that the statue is a piece of shit and not worth anything remotely like $132,000 Are you positive Tommy? I just want to know how they came up with that valuation because there's no way anyone bought it for that. "Yep she should and should also get to keep it." Can't see why she gets to keep the statue, she's responsible for the child that broke somebody else's asset and therefore is paying for the damage. If I was an irresponsible parent and my child damaged your car, would you allow me to keep the car once the damage has been paid for? probably not.

Sounds like they're trying to claim for the full value of the statue not just the repairs. If I damage your car and it costs £2,000 to repair, you can't hit me with a bill for the full value of the car. If the statue isn't repairable and they bill her the full value, in essence, what they are saying is, you break, you buy! That's why she gets to keep the statue in that situation. I'm sure it's the last thing she would want though!

"I’m sorry, but in my job I install all kinds of shit and it’s all in public areas. I have to provide method statements and risk assessments for everything I do. So it’s statue’s fault? Exactly!!! It was Venus de fucking Milo’s fault!!! If you kid goes and damages neighbour’s car.. who’s ass is going to pay? " Bit of a skewed analogy that though. There’s a big difference between deliberate vandalism and a young child hugging a statue. If the kid had been crushed to death everyone would be venting their spleen at whoever put the statue there, but beause the kid was unharmed the mother has been vilified and the kid demonised.

"I would guess the artist that made the statue will now be known all around the world . I mean if a thread started on a swinging site fills up , imagine what’s happening elsewhere ! So based on his worldwide publicity , he should accept that he’s a dick for allowing the community center to display it so haphazardly . It really wasn’t well supported . The kid should get a telling off and be made aware that climbing on other people’s belongings isn’t on . The parent should be fined , the insurance excess would be a good figure , and sent on a course which outlines how to be a responsible parent . I mean the bloody kid was only five and was running around the community centre for five minutes before she even knew where he was ! And the artist can laugh all the way to the bank now he is famous !" That statue is worth more to him broken, than before!

" Did you tell the kid to stop it? I've given a friend and her kids a lift before. The kids were pissing about and distracting me while their mother said nothing. I told the kids to either stop messing about or I'd stop the car and they could get out because they were making it dangerous for everyone. They stopped pissing about.

"Yes plain and simple. I think all parents should pay for their children and take responsibility if the child can't be prosecuted from criminal behaviour then the parents need to be made to pay No difference to dog fouling Did I tell you that you look like the picture of a late person? " What you on about Willis

"Why take the child in the first place. The child should be old enough to know not to touch x Why shouldn't the child be there? " Child needs to be old enough to appreciate the art and not to touch it. There are plenty of museums and galleries that are interactive so take them there instead x
