JAFFA CAKES. Biscuit or cake?

"Age old debate......my opion? They are tasty."
Cake the vat man seems them as a cake because the sponge goes hard when stale and a biscuit goes soft.
I do like a Jaffa cake...tried a raspberry one recently, just not the same |

It was defined legally some time ago with respect to VAT.
When it gets stale, a biscuit goes soggy. A cake goes dry. Jaffa cakes go dry, therefore are cakes.

I remember years ago McVities baked a huge one to prove it was a cake. the reason behing it was to do with the taxation on the chocolate. choccy for biscuits is taxed. choccy for cakes isnt. |

This subject has been argued in the courts of law and has been settled more than 26 years ago.
Jaffa Cakes are biscuit-sized cakes introduced by McVitie and Price in the UK in 1927 and named after Jaffa oranges. The most common form of Jaffa cakes are circular, 2 1/8 inches (54 mm) in diameter and have three layers: a Genoise sponge base, a layer of orange flavoured jam and a coating of chocolate.[1] Jaffa cakes are also available as bars or in small packs, and in larger and smaller sizes.[2] The original Jaffa Cakes come in packs of 12, 24 or 36.[3]
Because McVitie's did not trademark the name "Jaffa Cakes", other biscuit manufacturers and supermarkets have made similar products under the same name.[4] The product's classification as a cake or biscuit was part of a VAT tribunal in 1991, with the court finding in McVitie's favour that the Jaffa cake should be considered a cake for tax purposes.[5] In 2012 they were ranked the best selling cake or biscuit in the United Kingdom.[6]

Supposedly they cut a big slice and handed it to the judge, asked if he had been handed a slice of cake or biscuit |

Why not have them moved to the same aisle as the fizzy Vimto?
They could put the bicuits down one end on one side the cakes at the other end and the Jaffa cakes in the middle with the Vomit sorry Vimto opposite. |

I have a niggling thought at the back of my mind that they were originally apricot not Orange, or at least made of apricot pulp.
But my favourite was the limited edition lemon and lime flavour nom nom nom |

For vat purposes they're classified as biscuits, mcvitities defended they're classification as cakes but lost.
Interestingly they're not even orange, they're apricot |
