"They will take the rifle and most likely he will be charged for firing it in a public place. Least that's what happened to me all be it 30 odd years since.."
Oh yes think they have to be over 16 to and the air gun has to be under a power limit but forget how that works. Think it's something like 12 ft pounds. |

I know someone that was recently reported for firing an air rifle in his back garden, the police were called and said that he was doing nothing illegal, given the size of his garden being marginally bigger than a postage stamp it does beg the question of liabilty should an accident occur, but deliberately shooting your dog should surely be an offence?

Yes but it seems it could of been a accident and now OP is talking about putting his windows in.
That's a bit OTT and not a rational woman.

"With all due respect my friend but if anyone done that to my dog, or anyone else's, or any other animal for no reason whatsoever they'd be getting a piece of my mind! Via two fists! Twats! "
Great response- gotta love a man who stands up for the helpless. Well done. |

It's not a crime to fire an air rifle in your own garden, nor are airguns (sub 12ft lbs) illegal to own without a license. If any of his shots cross the boundary of his garden, an offence has been committed. If not, then no crime has occurred. If your dog was in your garden, it follows that he fired onto your garden, and thus, an offence has occurred. However, you will need to prove this to be the case. The police have no power of entry or confiscation unless a crime is suspected to have occurred. |

Depends on the type of air rifle and power I suspect won't be a licenced one, but he has failed to take precautions and the law will I suspect confiscate his rifle because it could easily have been a child or person. If the dog needs treatment give him the bill |

I sympathise, but handing the owner of the rifle a vets bill is a waste of time. He's no more obligated to pay it than I am. Regardless of opinion, air rifles, their ownership, use in a garden, sale, or purchase are NOT illegal. Whilst I understand that this is unpalatable for some, the law is the law. Also, the burden of proof lies with the accuser. So - if you consider a crime to have been committed, you need to offer incontrovertible evidence to that effect. |

Perfectly legal to own and shoot within your garden providing no pellets leave the boundarys. If they do then it's illegal.
So shooting at anything that's on the fence wouldn't have a backstop so would potentially leave the boundaries if missed.
But shooting a dog is not legal at all that's just being a prick. You must have some serious self control to be able to call the police. I very much doubt I'd be ringing them maybe an ambulance after if calmed down. |

I think if I was you my next step would be talking to the rspca and if they agree with you they will carry a lot more weight with the police and force them to take the matter seriously.... |

It is an offence to shoot outside the boundaries of your property, you also have to take measures to protect others from stray pellets.
Why have you not reported him already, he has injured a dog this time |

Only one way to deal with this & it reminds me of my late uncles when someone broke into one of thete houses. The 3 brothers got the guy, took him to the country & smashed both hos hands with a hammer. Lad never played the violin again. Op your call |

Found this dont know if has any relivance.i know law in scotland changed now need licence up here and i was always under impression if using near people you had to take precautions to ensure no risk to anyone near by.doesnt sound like he was following all of the basic rules to ensure safty.
is also illegal to fire an air rifle:closer than 50 ft [15mtrs] of the centre of a highway, if by doing so you cause any member of the public, using that right of way, to be injured, interrupted or endangered.
*This offence could be committed, for example, by someone on private property close to a road who uses an air rifle in a way which endangers people on the road.
closer than 50 ft [15mtrs] from the centre of any bridal path or footpath |
