Car accident claim now settled after 2 years are we entitled to refund of overpayment?

I had an accident 2 years ago, this was the 3rd claim on a multi car policy & because of this our premiums went up (nearly trebled!) as my NCB went from 11 years down to 3.
3 weeks prior to court the 3rd party has settled so I will now get my excess & expenses paid back, I'm also assuming my NCB will be reinstated but also aware that this claim may have an effect on our premiums.
What I really want to know is, are we entitled to the overpayment of premiums we've incurred over the past 2 years? It seems very straightforward that I should get a large lump sum refund but something tells me the insurance will try & duck out of this.
Anybody got any first hand experience before we plan what we're going to spend our money on? Thanks. |

I would have thought that you should be compensated by the other person's insurance? |

Don't think it's down to the 3rd party it's my insurers who put up my premiums & believe they are the ones who should pay. A bit of googling doesn't really give me a definitive answer guess I'll have to ring my insurers in the morning & ask. |

Ok thanks if that's the case there's a lot of money to be refunded, the problem lies is that my insurance was renewed fairly early into the claim, so they will have to work out what my premium should have been prior to the accident, but as I said before I will almost certainly get a strike for this claim which may or may not have an affect on my premium, here's hoping it didn't. |

Unlikely to get anything from your insurer as harsh as it seems. Best course of action would be to speak to your insurer in the first instance and explain what you're after. I'd expect them to say they won't refund the extra you paid but they should be able to give you an idea of what your premium would've been if no claims bonus hadn't been affected. Get this in writing. Then look to claim it back from the guilty party as an uninsured loss / additional expense.
