So let me set the scene, my beautiful daughter H is a goth. When she goes out she's dressed head to toe in black. Often she teams this with gothic jewellery and make up. Now I love my daughter and I let her express herself exactly how she wishes. I don't care what she wears or how much white and black make up she wants to wear as long as she's happy. She's only 13 but life moves so quickly that in another 5 years she may not be able to express herself as she wants too cos she maybe in university or have a job that means she has to tone down her look.
Today whilst we were out H was photographed by an adult without her permission. This isn't the first time this has happened but it is the first time it's happened whilst I have been with her. H isn't arsed about people taking her pic but tbh I was pissed off about it. I was pissed off because I though it was fuckin rude! How would you like it if I took a pic of your child without permission? And why didn't you ask permission? And why do you want a pic of my goth kid? To put on the internet? To mock?
I kinda feel I shouldn't be pissed off cos if she looks so alternative then she's got to put up with attention. And yes I get that. H doesn't give a shit. She thinks it's funny n she pulled a silly rock pose.
She's a cool kid n I love her but please for the love of god if you wanna take a pic of an alternative kid just ask them. They don't bite dispite the fake teeth n blood. kids will be kids. Adults should behave like adults and learn some fuckin manners.

Sorry but I would have gone mad. Nowadays there is so much people can do to photos. If she'd have been asked then fair enough but to do so without permission at her age is very rude. X |

I think your daughters appearance and fashion choice are irrelevant.
The question I'd be asking is why someone took a picture of my 13 year old daughter?
You don't have to be impolite, simply say excuse me why are you photographing my juvenile daughter?
People can be interesting to look at and it may be completely innocent, but if you feel offended that challenge the behaviour tactfully. |

You've a lot more restraint than I have, similar happened to me once and I took the camera off the person. Whether your daughter is bothered or not I'm sure there's some legalities about taking pictures of minors without consent. |

Some people lead very sheltered lives. I accompanied relatives who aren't very worldly to Brighton recently (aged from 16 to 50). They were openly shocked and amused by some of the alternative looks we saw. I had to tell them to stop commenting. I honesty believe that some people are incapable of realising that people who look different are actually real, living and breathing humans. |

As someone who had many goth friends in the 80's (anybody familiar with the bear in bedford will know what I mean) they got plenty of attention and shitty comments,but they were adults not kids,the guy taking photo's is bang out of order. Your daughter sounds like a cool kid,well done You! X |

Taking photos or video of anyone in public is totally legal. It's a shame really as it's the reason all these cctv cameras are allowed. I personally thing they're intrusive.
If your daughter dresses unusual or in a manner that's different from the norm then a stranger taking a photo is unfortunately an extension of this modern obsession to photograph everything. |

Causing a scene? That stranger took a photo of a child without parents permission which technically is illeagal! Just because that little girl is a goth, doesn't mean the stranger had innocent intentions! Clearly they did not.
OP, you should of took their photo or camera off them and went straight to the police. Decent adults do not behave in that manner. Your daughter shouldn't have to be used to such treatment. |

But you would of though an adult would of simply asked if she could take a pic of H. I got sent a pic yesterday of a friends daugther n I had the manners to ask the person if I could show the pic to H. It's manners! Xxx

Yes! I think in reality the woman prob though H looked cool so took a pic, I just found it so rude as I was with her n I like to think that it's obv I'm her mum. xxx |

No it's perfectly legal. The legality depends on the location and whether they have the "reasonable expectation of privacy". On a public street you do not. |

Not that I'm aware of unless the law a has recently changed. 'Public' is the key word here. No offence has been committed by just taking someone's photo whilst they are out in public as far as I'm aware. I'm open to hear otherwise though.
I'm an a mature photographer so would definitely like to know if the law a has changed. There are lots of issues that this raises and uts good to talk about them especially with your children. |

Yes n no, I doubt the pic will be used for nefarious reasons, goth are well covered clothes wise. I was just pissed as I saw it as rude not to ask permission first. If you took a pic of your daughter now, in what she was wearing at the time of the photo, and did a reverse image search over the next few weeks, would that work?
If someone took a pic of my boys i'd like to think i'd wrap the camera down the persons throat and tell them to shit out the film. But different when your kids are with you. Got to be all diplomatic. |

When it comes to my children and their well being, I don't have a sense of humour. I would have gone ballistic and made them delete it.
She's a minor, so whether legal or not to take the picture it's an intrusion and a tad suspect in my books, and therefore not welcome.
I'm sure she wouldn't have minded if they had asked.

It is illegal! My new next door neighbour was caught videoing my 15 year old son without my permission. I called the police right away. They said it's a criminal offence and came out to collect the evidence and make arrests. Unfortunately by time they tirned up, next door had deleted the recording. Without evidence no arrests were made! I now have CCTV covering my entire property and new fencing/gates. I can't move because I'm a private tenant and my contract isnt up yet. OP, don't stand for it and report to the police immediately if it happens again. |

For me it's not the fact a pic was taken. H is cool with that. It's the fact the adult didn't ask if she could take a pic of her. It would of been different if it had been a press photographer. Xx |

Because your son was at home where he has the reasonable expectation of privacy. Had your neighbour filmed him on the streets then it wouldn't have been illegal. |

May I ask where your son was when he was being filmed?
I ask because it is not illegal to film a person in a public place.
However there may be other laws being broken... |

I totally understand where you are coming from, however if you lost your rag with someone you would be the one getting in trouble not the photographer.

Just seen this post, it reminds me of me when I was younger well I was 16. You could have called me and my mate's different we was punks back then, I had a pink mowhock (hope that's how it spellt). We lived in London, this 1979/80 by the way every weekend We would go to the west end, people tried to take pictures of us which was OK!! As love as thay paid us. We used to get a £5 ago mostly Japanese or USA tourists. Most paid some tried not to but thay did in the end. We made a lot of money I was bring home 3 times what my Mum and Dad made and by the way I gave most of it to Mum. What I'm Tring to say is if it happens a lot make them pay because if like you say it go's on the net you can bet there makeing money.

I've read about half way down.
If it was illegal to take pictures then newspapers couldn't survive. Nor photographic artists.
People are speaking as if he stole her soul with a magic machine.
As for her age.... she's underage for sex not for fully clothed photos.
Personally I walk out of camera shot when i see them but this day and age it's the norm for people to snap everything that moves. |

Now I love my daughter and I let her express herself exactly how she wishes. I don't care what she wears or how much white and black make up she wants to wear as long as she's happy. She's only 13 but life moves so quickly that in another 5 years she may not be able to express herself as she wants too cos she maybe in university or have a job that means she has to tone down her look.
Today whilst we were out H was photographed by an adult without her permission. This isn't the first time this has happened but it is the first time it's happened whilst I have been with her. H isn't arsed about people taking her pic but tbh I was pissed off about it. I was pissed off because I though it was fuckin rude! How would you like it if I took a pic of your child without permission? And why didn't you ask permission? And why do you want a pic of my goth kid? To put on the internet? To mock?
I kinda feel I shouldn't be pissed off cos if she looks so alternative then she's got to put up with attention. And yes I get that. H doesn't give a shit. She thinks it's funny n she pulled a silly rock pose.
She's a cool kid n I love her but please for the love of god if you wanna take a pic of an alternative kid just ask them. They don't bite dispite the fake teeth n blood. kids will be kids. Adults should behave like adults and learn some fuckin manners.

I was a goth when I was in my teens. This used to happen to me to. And my mates. It is rude. Back then though theres was no Internet for it to be published on.
If you look a bit different, people act weird towards you. This is because people are shits.

Why is a press photographer more acceptable? They may sell the picture to some rag to use to illustrate a yoof of the day all mad, bad and dangerous type story. If all it takes to be acceptable is a lanyard, which are easy enough to get, what are you actually angry about?

'Alternative' is just the oldish term for goths and stuff from the pre emo times.
Hence 'alternative' nights at some clubs. Thing annoys me is the ones hurling abuse at goth kids etc are usually a peice of shit with no imagination in £10 worth of sports direct crap.  |

Manners cost nothing and your daughter is not alternative she is a normal human being I would be pissed off if someone had took a pic of my family too. I would of had to say something quietly to the person and made them aware how you felt and how would they feel of some taking a pic of them (maybe they may think next time) |
