The question reminds me of that famous court case in the US in the 1960s when a judge was being asked to decide if a film breached the laws of obscenity.
There was disagreement about what constituted pornography.
The judge said the law could not define hard-core pornography. "But I know it when I see it and the motion picture in this case is not that."
