There was a court battle over vat, as above it was proven cakes go hard biscuits go soft. No VAT on Jaffas yeahhhh ) |

I do like a tax loophole - biscuits and cakes covered in chocolate are classed as luxury and therefore subject to VAT (whereas plain ones are zero rated). But if the chocolate is embedded in the biscuit - like chocolate chip cookies - then it avoids VAT. |

"Its a cake due to some VAT scam I believe
it's a cake because it's a cake "
MCVities won a court case against HM Customs & Excise who claimed that jaffacakes were biscuits and as they are covered in chocolate should be subject to standard rate for VAT purposes, whereas cakes are zero rated. The court ruled in favour of McVities who claimed they are a cake. |

"If it goes hard when you leave it out, it's a cake. If it goes soft when you leave it out it's a biscuit"
I like this theory
Will someone now please test it on a jaffa cake to put us out of our misery |

Can anyone answer the truly vexing question, is shortbread a biscuit?
I'll happily dunk in my tea. They retain high volumes without disintegration after all.
I'm not a fan of dipping my bread in my paned. |

"Im confused,i dunk a jaffa in my tea but i wouldnt dunk any other cake,i need input on this as its stressing me out!"
Firstly; what kind of depraved, deviant lunatic dunks a Jaffa Cake?
Secondly, and in answer to your question; no idea, they never survive long enough to warrant classification. |

that as may be, but that isn't what makes it a cake..the fact it's a cake is what makes it a cake, meaning, that it still would be a cake if there was a court thingy or not whatever...i want some now |

I love the VAT rules. I gave up crisps for lent one year but carried on eating doritos as they are corn-based snacks. Shamefully I have now forgotten which one is zero rated |

I remember reading an article a while ago regarding this. Apparently competitors were trying to prove that they were in fact a biscuit as biscuits are taxable and cake isn't. They failed. |

Corn based are zero rated, crisps are standard rated. I also like how it works with gingerbread men. A biscuit with two eyes, fine, you can be zero rated. Put icing buttons or chocolate trousers on that fucker and it's standard rated |

The VAT folks were always the weirdos in the corner. But being able to multiply by 17.5% seemed to justify the highest charge out rate in the office for some reason |
