So, I've just read this article regarding the censorship of porn videos.

I know this may have been discussed before but I couldn't find anything recent.
A quote from the article:
'Pictures and videos that show spanking, whipping or caning that leaves marks, and sex acts involving urination, female ejaculation or menstruation as well as sex in public are likely to be caught by the ban – in effect turning back the clock on Britain’s censorship regime to the pre-internet era.'
I wonder what sort of impact this will have on fab and other similar sites. I'm aware that some of these acts aren't allowed on profile pics, but there are some grey areas. |

Others will know better than me, but are they 'just' enforcing existing laws which effectively make bdsm illegal or a grey area.
A quick search shows criminal cases meaning inflicting actual bodily harm is illegal, regardless of consent.
I'm not making out any of this is ban is right. I'm just highlighting them maybe enforcing something that is already the case.
If that is true then the law behind it should be reviewed.
Any BDSM experts here who know the full answer?? |

This is mixed in with the overall effects of the IP Bill / Snooper's Charter but when I raised the issue here before, the reaction was "meh".
People don't give a fuck about any of this until it smacks them in the face and then they start whining that they were not told. Same with Brexit. |

I was supposed to say BBFC not BBC lol, yes we join the ranks of India & China as one of the only other countries censored with what we watch, they are also trying to censor political material too but with Brexit on the horizon they will wait for that one.
All the main professional adult sites including ours have had to be relocated abroad because this is a definate, it don't only stop with all adult pics & films as audio is now on the list too.
Web camming will be illegal with a list of other things mainly to do with S&M. |

The act of leaving the EU does not automatically reduce human rights. We would have to repeal the Human Rights Act and un-sign the UN Convention on Human Rights to do that.
Plus...for the next two years or so ae are still in the EU. So thid has nothing to do with Brexit. |

The new law will not ban porn sites. The BBFC will be involved in what is acceptable to access.
From the BBFC website:
The following content is not acceptable:
• material which is in breach of the criminal law,
including material judged to be obscene under the
current interpretation of the Obscene Publications Act
1959 (see Annexe)
• material (including dialogue) likely to encourage
an interest in sexually abusive activity which may
include adults role-playing as non-adults
• the portrayal of sexual activity which involves real
or apparent lack of consent. Any form of physical
restraint which prevents participants from indicating a
withdrawal of consent
• the infliction of pain or acts which may cause lasting
physical harm, whether real or (in a sexual context)
simulated. Some allowance may be made for
moderate, non-abusive, consensual activity
• penetration by any object associated with violence or
likely to cause physical harm
• sexual threats, humiliation or abuse which do not
form part of a clearly consenting role-playing game.
Strong physical or verbal abuse, even if consensual, is

It will give the govt the *legal* means to attempt to block, but not the technical means. Unlike many countries in which internet censorship takes place we do not have a single government-owned internet service provider. We have a number of service providers here and they are commercial entities and are not particularly wanting to be blocking things as
1) It is more work for them to do
2) It opens them up to liability as to what they do/don't block and how effectively they block it
3) They know that if they blocked xhamster (say) they would find a lot of customers moving to a different ISP.
So, yes it is shit, and yes it is furthering the slippery slope towards mass surveillance and censorship (between the twin forced of the IP Bill and the DE Bill). But the reality is that, technically, these blocks will be near impossible to actually carry out without completely crippling our digital economy. Not that I don't doubt the govt would try... they are already hell bent on screwing up the rest of our economy.

We will still be in the EU in April so will still have all the rights we had prior to the referendum also this bill was drafted long before the referendum so stop talking rubbish, you lose any credibility and the point of your post when you start to try and take cheap political shots. |

Guess who's going to be paying for this? Us. Changes imposed upon the internet, such as has happened before, where adult content restrictions are implemented for mobile/landline internet, cost the tech companies money. We the consumers thus have higher broadband costs levied by the ISPs or the government compensates them, with our (taxpayer funded) cash.

The new ruling is called The Digital Act & unlike the BBFC rulings on films all adult pics audio & videos will be blocked by our providers e.g. TalkTalk BT on the net, not even topless will be allowed unless you pay the BBFC to go through your site & ok it.
If the site owners step out of line putting up pics or allowing members to put up pics disallowed they will face closure or possible fines.
Tube sites are to blame as there is no credit card system to stop under 18's so the new laws will protect kids & help adult producers from piracy, we will have to do another site ourselves but it will be watered down to BBFC regs as its better to be part of a 100 BBFC regulated sites than compete with 50,000 sites at the moment. |

Sites will face closure or fines? How do you envisage the UK govt imposing closures and fines on sites hosted outside the UK and in a different legal jurisdiction? Hint: they can't. The only thing they could attempt to do is block those sites. Which will be like playing whack-a-mole. Each one they block, and another will just appear. Not only that but there are plenty of means to very simple, cheaply and easily side step any blocking by using any of the many VPN services out there. And the govt could block those? Well yes, they could, but would pretty much prevent any remote workers for any significant company being able to do their job.
What they are proposing is not technically feasible and won't achieve any of the aims they are trying to achieve. They would be much better spent actually looking at education than a futile attempt at blocking things.

I'm no legal expert (Law was too hard, so I did Criminology instead) but leaving the EU makes no difference to our human rights; we're still covered by the Human Rights Act (1998) until this government attempts to repeal it and replace it with a Bill of Rights, which they announced in the Queen's Speech. You're also covered by the Equality Act (2010) until they try to get rid of that as well. The only difference is that you won't be able to appeal to the ECJ once we're out of Europe. |

It will give the govt the *legal* means to attempt to block, but not the technical means. Unlike many countries in which internet censorship takes place we do not have a single government-owned internet service provider. We have a number of service providers here and they are commercial entities and are not particularly wanting to be blocking things as
1) It is more work for them to do
2) It opens them up to liability as to what they do/don't block and how effectively they block it
3) They know that if they blocked xhamster (say) they would find a lot of customers moving to a different ISP.
So, yes it is shit, and yes it is furthering the slippery slope towards mass surveillance and censorship (between the twin forced of the IP Bill and the DE Bill). But the reality is that, technically, these blocks will be near impossible to actually carry out without completely crippling our digital economy. Not that I don't doubt the govt would try... they are already hell bent on screwing up the rest of our economy.

The new ruling is called The Digital Act & unlike the BBFC rulings on films all adult pics audio & videos will be blocked by our providers e.g. TalkTalk BT on the net, not even topless will be allowed unless you pay the BBFC to go through your site & ok it.
If the site owners step out of line putting up pics or allowing members to put up pics disallowed they will face closure or possible fines.
Tube sites are to blame as there is no credit card system to stop under 18's so the new laws will protect kids & help adult producers from piracy, we will have to do another site ourselves but it will be watered down to BBFC regs as its better to be part of a 100 BBFC regulated sites than compete with 50,000 sites at the moment.
Sites will face closure or fines? How do you envisage the UK govt imposing closures and fines on sites hosted outside the UK and in a different legal jurisdiction? Hint: they can't. The only thing they could attempt to do is block those sites. Which will be like playing whack-a-mole. Each one they block, and another will just appear. Not only that but there are plenty of means to very simple, cheaply and easily side step any blocking by using any of the many VPN services out there. And the govt could block those? Well yes, they could, but would pretty much prevent any remote workers for any significant company being able to do their job.
What they are proposing is not technically feasible and won't achieve any of the aims they are trying to achieve. They would be much better spent actually looking at education than a futile attempt at blocking things.

Sites outside the UK are not accountable to the BBFC but providers will block any adult site here or abroad, proxy servers will be set up like people use in China to view banned stuff...could have been worse as Facebook & Twitter were on the hit list at first. |

If the government gets its own way on this you would be blocked from these other sites by your internet service providers. Whilst there are ways to bypass such restrictions I would guess its only time before making any attempt to do so will also become verboten (probably at risk of your liberty). |

The bill hasn't been made law yet, but there's already inconsistency on fab.
There are fetish sites to post on, which we also use. But even if they're hosted outside the UK they could still be blocked by UK ISPs.
But as others have said, it could be unworkable from a technical point of view.
Reminds me of something a law student friend at Uni told me, it's technically illegal to spit in the street. But when was the last time you saw that enforced? |

yeah true, loads of illegal stuff goes on, which is why prisons are full of the ones who got caught.
i used to know a lot about hosting and that, can't really remember much of it now and it might be out of date anyway.
i've noticed its getting harder to find online free movies and that, the new ones, but not impossible yet. |

We live in a police state not a free country so nothing surprises me about our crazy laws compared to the relaxed laws of Europe, can the UK implicate such measures we will see.
I personally think it impossible but they are threatening adult produers who have adult sites hence why I based myself in the States a few years back.
In theory being one of a few legal sites would be heaven for webmasters as an earner so most of us that are still going will opt for a BBFC controlled site here & keep our others sites for the free countries that can view xxx material. |

This is so stupid. The MPs are saying that it is to protect children but this law will push people into using the dark Web in search of the consensual kink they have been enjoying. There they will find the non consensual stuff, actual rape porn, kiddy porn, all the real nasty stuff. Unfortunately, some people will be turned on by this and investigate further which is theoretically but entirely possibly going to lead to more of this material being produced. |

Actual physical harm is not allowed, and while there are no definite guidelines I can find, bleeding would be an obvious one. So simply to play it safe, any pictures showing any blood would be removed by sites to avoid the risk of prosecution.
OP: As for the rest of it, it is already illegal to make these videos in the UK, so technically this law simply closes a loophole which only existed because a few years ago it was thought no-one could police the net.

Perhaps, if internet providers show they are able to restrict content, coupled with an effective age-verification system, perhaps in future the limits on what can be shown may be relaxed once again.
I know it might seem a little goody-two-shoes, but I quite like an end of the "Wild-West" era of the internet, and a little more policing of it.
It's been a bit of a nightmare worrying about teenagers,at times, if I'm honest.

This however is the point that many people are missing here. The government is requiring that sites implement an age-verification system for these sites. Even if we leave behind the futility of implementing this in one country, when we are talking about an international network... how exactly are they going to implement this age verification system? What criteria are you going to use in order to prove someone is over 18?
Ever been to a website for an alcohol company? They simply ask you for your date of birth. Clearly that is not going to be of much use. The next common pattern you see is taking a credit card number in order to verify age. This is on the assumption that only over-18s have credit cards. Again, even if you leave behind the idea of how easy it is to grab mum and dad's card...
What is going to end up happening is that there will be large databases of credit card details or other personal identifiable information being collated. These collections of information are worth a lot of money in the wrong hands. This is assuming that the random porn website you just found and which just asked for you credit card details is legit to begin with. Not only are there going to be big troves of things like credit card data, but also by the very nature of the site, details that Mr Jones, of 5 Dingleberry St has just registered on midgets-love-cake-farts dot com.
This is also one of the main reasons that the other lovely bill just being passed, the IP Bill is again so dangerous... that is the one requiring ISPs to record the browsing habits of every UK subscriber for a year. And have you seen the list of the organisations that are allowed access to it? It includes people like the Food Standards Agency. wtf?! Again, no technical thought has gone into how this will actually work. The cost is going to be astronomical and the end result will be a very valuable trove of the entire browsing history of the nation. And considering pretty much every week there is another story of a govt agency screwing up private data...
Anyways... enough of a rant...

Possibly a debit card. In the old days a debit card would be enough to class you as over 18, even if you weren't, much like a provisional driving licence would. Nowadays the software seems to be able to distinguish between credit & debit cards. So don't know |
