ok here we go...

1) Were the leaves outside of someones property? as a rule it is the property owners duty to maintain the paths outside of their homes and not the council.

2) you could sue god but thats already been done, several times and it always ends with the person suing the deity loosing

3) Chances are it will be on CCTV somewhere. either ARC monitoring, highways agency or private CCTV. however to get a copy costs between £20 to whatever the private company wants to charge

4) Personally you would be better suing the water board.... due to them poorly maintaining the sewers and systems, there was inadequate drainage which led to your spill (see what i did there?)

..... you could also counter it with the "Down stream" law and point out that due to the above reasoning, they were denying themselves access to said amounts and could technically charge them.

but if you are going to sew them, it can be a bit of a slippery slope

But through previous experience (in Wrexham) it cost me £200 just to take the council to court to have it.... heard.

I lost!

£200 down the road and a grand in lost wages.

Don't get me wrong I do feel sorry for you, you have taken a tumble and thankfully you're not hurt more seriously, merely pointing out what they will say, now if you had tripped over a flag stone that exceeded the height it should be in building regulations that was previously reported and not attended too then you'd have a case.

I think highly unlikely if the pathway was otherwise intact and the shoes were anything less than boots with a non-slip sole.the council would argue that you should foresee the risk of unsure footing.

My Ex was successful against the council in Huntingdon when she tripped and fell in bad light sustaining a back injury. They paid for most of the treatment that she received.

We've been having terrific thunderstorms here, so I ought to stage a claim via the American system, before it dries up.
