Small claims court?

Put a claim in for damage to car after hitting a deep pothole to the council. cost over £200 to fix. Just got a reply saying they take reasonable care looking after the roads. So. .. Worth going via small claims?

Can be did you photo the pothole? As i believe that the council have paint a circle around it to make it visible, if they didnt then you have claim... or something like that.

didn't gave camera at the time. After i calle them for application form, i went the next day and they had filled it in

Sounds daft but should take a pic of the hole with the day's newspaper next to it to prove the day it happened. As you say, they often nip and fill the hole in once you've reported it! Otherwise it's your word against theirs

they did go out and check.. Net with them and showed where the hole was. Yes evie the hole was full of water and looked like surface water.

It's not so much about proving that there was a hole there but that the council have a system in place to check the condition of roads and maintain them...if they can prove that they have a system in place you won't get anything...However if they lapsed you might get lucky.

can the system be questioned as to it!s efficiency? Fitness for purpose?
