hope fully there will be incriminating marks on her car or you might have trouble proving it ...the police dont always take someones witness statement as fact ?? i really hope they do tho !! good luck .

Renews your faith in people when something like that happens doesn't it. Good to know that there are decent and honest people about and willing to do good turns for others. We hear to much bad stuff nice to hear something positive for a change.

police will give you a crime number for insurance purposes, they do this for more serious offences like burglaries too

they might acctually catch the couple if they go too fast through a speed camera making their getaway...about the only thing our boys in blue like to persue these days

Nothing the police will do, As its not on the public highway so normal rules don't apply as your not covered by insurance on a private road or car park.

legally they don't have to do anything and if they don't tell there insurance there is nothing you can do,As Insurance company are your agent so can only act if you tell them too.usually this is got around as implied permission if you request a claim form but if they don't tell there insurer your buggered.

The Police give a crime number for absolutely every single crime committed, they dont pick and choose who to give a crime number out to. The crime number's use is not solely for insurance, all crimes are recorded onto a crime reporting system, hence the issue of a number.

".. called police and her just running off is against the law so thay said .. "

That is odd, because as long as no one is injured, if the owner of the damaged property isn't there you can drive away. They have 24hrs to report the accident to the police. Failing to report it to the police in 24hrs is the offence.

Hi Jo (xx)

Happened to Les in the car park at work. Someone clouted the side of her Beemer and did £1200 of damage! Police were called and they made the right "noises". But even with footage of a white van on CCTV pulling into the next space and pulling out straight away, then driving off very fast and dissapearing, they said there was not enough evidence! The van was back within a week, new paint on the offside wing and bumper...

Don't expect much, Jo.. Police will give you a crime number and then it will be up to you to go through your insurance!!

Not true I am afraid.

The law was changed some years ago that defined the queens highway as anywhere that the public has permission to be. This includes shop carparks, bike and car rallies (even if an entry fee is paid) and well, just about everywhere including your own driveway (unless it is gated and locked).

I remember the law being introduced very well as at bike rallies it was sort of traditional to remove your helmet once you were on private land. The police got very 'active' after the change in the law and were around the bike rallies handing out on the spot fines for no helmets. It is also now illegal to drive a car on almost any land with no licence/insurance 'for practice' for the same reason.

The insurance company WILL pursue the other drivers insurance company for a payout. It's a matter of profit. For much the same reason the other parties insurance company will payout without much more than a token fight. Again profits. If they put up a fight and lose (likely with witnesses) in court they pay all the legal fees.

Clark vs Kato, Cutter vs Eagle Star, HoL, 1999, a car park is not a road. The offence of failing to stop specifies on the road, or damage to a property near the road.

Regretfully, failing to stop does not appear to apply in this case.

General liability in respect of the tort of negligence does however, and the injured party can sue.

its a criminal offence, and there is direct evidcence that it happened as there was witnesses, maybe cctv, but as it stands the law should procede x

The damage done to your car is a civil matter and needs to be pursued through your insurance company (unless the police quickly come back and say the other party has offered to pay cash etc---doubtful).

The police are only interested in the fact that they left the scene of an accident without attempting to leave details as a crime has been committed there.

Yes, a car park like this IS classed as a public road under amendments to the road traffic act.

Go to a site called 'Pepipoo' (google it) for legal advice from people that actually know what they are talking about.

had something similar happen to us a guy went into our car outside our house n drove off the lady behind him that saw stopped n left her details with a neighbour of ours for us it all got sorted and our car got fixed even though the guy driving denied it we will be eternally gratefull to that woman that bothered to stop

last week i had a bump n straight after restarted engine to move out of road before giving details (i was 100% in the wrong) when i got out the other woman said she was worried i was just going to drive off i assured her i would never ever do that i think it is awfull that anyone would consider it just got our renewel quote on insurance today and its jumped up £600 and as far as i'm concerned thats my punishment for loosing concentration and i should think myself damn lucky thats all the punishment i have been dished out

Could have been worse, someone done same to me. Came back to car, found side damaged and note under windscreen, unfortunately the note read 'everyone thinks I am leaving my details, but I'm not'

To say I was fuming would be an understatement
