An interesting article coming up today. FAILED asylum seekers (illegal migrants/ financial migrants or whatever).

Under rulings from the European courts we are apparently having to pay them tens of thousands each in compensation for "wrongfully detaining" them prior to the court also blocking us from kicking the illegal scroungers out.

One guy on program given £33k compensation. But as he is an illegal immigrant he can't open a bank account...so he spent it all on drugs and gambling.....un be fecking leavable!!

Key parts are:

If judges determine the government has detained someone unlawfully, it must pay compensation.

"Immigration detention is lawful in certain circumstances where the Home Office is intending to deport someone and there's a reasonable prospect of that taking place.

"But what we're seeing is people being detained for months, often for years, long after it becomes apparent that there's no prospect of their deportation actually taking place," he said.

So it's basically not a case of illegal immigrants being given sack loads of money, it's the government not detaining people lawfully and in some cases for a long time. If I were locked up for no sound reason then I think I'd be looking for compensation, too.

Fully agree with this....but the point being made was that they were detained (as illegal/economic migrants) with what was thought to be a genuine reason/prospect to deport them. But the courts, following rulings from EU courts then said no to the deportation. Only then did it become a 'wrongful " detention.

Fully agree with this....but the point being made was that they were detained (as illegal/economic migrants) with what was thought to be a genuine reason/prospect to deport them. But the courts, following rulings from EU courts then said no to the deportation. Only then did it become a 'wrongful " detention."

So if the rozzers nicked you on what they THOUGHT were good grounds, kept you detained for ages and then it turned out you were perfectly innocent all along, would that be 'wrongful' or just wrong?

If a government acts wrongfully then it should rectify. Monetary compensation is one such rectification. Just because someone is an illegal immigrant doesn't mean the government can do whatever it wants with that person - including unlawful detention for months or years.

However, the one's gaining compensation aren't illegal immigrants, hence the compensation.

I don't read the daily mail....my eyes would fall out if I did. I was merely pointing out what was on the TV show so people could discuss.

The point raised was, however, that many of these people would normally be deported/sent back quick sharp as they are economic/illegal migrants rather than asylum seekers (whom I have every sympathy with). But EU court rulings about their "human rights" ( I remember one case it was because someone had "adopted a cat") prevent us sending them back.

Oddly , in Greece they are sending hundreds back on a daily basis. Under an agreement with Turkey the "genuine" ones are sent back to camps in Turkey to swap on a one for one basis because they should have applied for asylum in Turkey. The economic migrants are detained and sent back within days....all agreed by EU commission. Double standards?

I rather think you are missing the point - the courts have determined that these are genuine asylum seekers, hence the compensation.

There's no doubt there's some very dubious reasons for getting "asylum"!.

However I'm totally against my government detaining people for months and months.

These applications should have a maximum time allowance of say one month before a decision is made by the courts

British courts could well see it as the same problem!.

The problem seems to stem from a lack of government speed!.

I'd like to throw alot more manpower at speeding up these applications to a maximum time of a month preferably two weeks

i love threads like this.....because they sometimes like the twist the fact and the cicumstances of a story to fit a narrative.......

the OP has twisted this one to the point of being really disingenious with the truth.....

so after thinking... this doesn't feel right..... i found this....

so the actual reason that he could not be deported was that he had no passport.. and the country where he has come from refused to give him one.....so they couldn't confirm he was a citizen anyway.... so in effect he is actually "stateless" and in that case you cannot detain someone for an unlimited timeframe

so it would have had nothing to do with the EU court at all..... any british court would have thrown that out....

Yep there was a story in the Guardian a couple of days ago. One solicitor would hear hundreds of cases a week form immigrants and detainees, he would turn them all away as there are only specific circumstances where their rights are violated and can progress to court action. It had been toughened up by a recent British law that (from memory) was in respect to their treatment whilst in detention I think.

The legality of the EU/Turkey deal has been questioned by the United Nations but Jean Claude Juncker thinks the EU is above the law (he says it's legal under the terms of the Geneva convention but again this has been questioned by the UN). The EU/Turkey deal has also been publicly condemned by amnesty international. The EU condemns individual EU countries for putting up their own border controls, so as you said it is a clear case of double standards from the EU.

actually it isn't... it is the UK supreme court that decides these... not the European court of justice as you like to claim....

oh.... and you can blame the house of lords as well.... the government wanted to allow unlimited detention... they voted that down and put in a 28 day clause instead (the only exception to that is in terrorism related situations....)

you opening post is inaccurate to the extreme....

No it's the UK courts, who made the decision, based on UK and International law. In fact if the UK had followed EU law, this would not have occurred; since the UK is the ONLY country in the EU that has no time limit on detention; if UK had followed EU practice, it would have had to deal with this and solve it sooner....
