Are you absolutely sure your cover includes DOC?

It used to be pretty standard but was changed fairly recently, and now it's less common. You should double check just in case before risking it.

what a lot say now is car must have its own insurance. That combined with stay insured stops people driving cars they cant afford to insure. I had a 1.1 fiesta but drove a japaness supercar.

a while off. Really takes the pee. A year ban is actually a 15 month ban due to waiting for licence. Waiting for theory. Waiting for test. Good job im in no hurry to get back behind the wheel.

It's not really 'taking the pee' is it?Presumably you've been disqualified for dangerous driving or driving under the influence. You don't tend to get ordered to resit a test for totting yp penalty points

Besides you get a provivional licence when yours ban expires so can still drive with L plates

o they are. As said Im a ROSPA ADvance driver and member and no rush to drive. But for employment even office based jobs seem to require drivers license im not interested in driving. ID is also a major issue. Hense only need insurance for test. Not even planning on driving to test or driving home. But will allow me to go track days and work on family members cars without being done for incharge of vehicle without a license. Also in emergancys i can drive if needed.

You lost your licence because you were driving so dangerous the courts revoked it and ordered you to sit an advanced test.

I'm really not sure why you keep saying you are a a ROSPA advanced driver. Or why you seem to feel that you are the victim because having to sit your test is a logistical nightmare. That;s because insurance companies and driving instructors don't want to go near people that are so high risk.

i more tgan a compantant driver. It attidude that my problem. Some one smashes into your car. Then rams you off road and fleas scene. My mistake was chasing them down and forcing them to stop. 22 years clean licence 15 years ncd no criminal record all gone in 3 minutes. I can get instructor to lend me a car. But new cars arnt for me. Reversing cameras. beeping alerts. lights flashing to say change gear eletronic hand brake and hill hold technology along with all the other stuff lol. No wonder people cant drive after passing test buying a 10 year old car. With only abs fitted. My son starts learning in march 10 leason with instructor then on to an old banger.

It's pretty astounding that someone who claims to be a ROSPA advanced driver ;

1. Has been banned; since everything you learn would make it almost impossible to get banned ( if you actually continue to follow what you have learned)

2. Has such a dreadful attitude to driving. You must have put on a convincing show for the examiner , if you fooled him for a whole test. ( and indeed your instructors, if they didn't realise what you are like during your training).

The ROSPA bike test is harder than the car one, but even so, I am astounded you got through with that attitude .

What did you get? Bronze? Silver? How long ago? How many ROSPA periodical retests have you done?

silver only last year. Brake test was at to slow a speed got caught out by a new speed limit change. stalled pulling away.vocabulary could have been better. But i think the 22 years clean 15 year ncd. Talks for its self.

Especially when the OP invites opinion by trying to use a ROPSA qualification to show that he is a good driver;

Somehow to me it seems a ban shows how good s driver he is:

My opinion; but then I am opinionated.

apparently not. Even though had a list off priors. Snapped door mirror off car i was driving and hit car with steering wheel basball bat. Apparently cops messed up case and cps wouldnt act because off that. Video evidence two statements matched. His statement didnt even match video evidence. But you were convicted and blame it on "red mist?"

Might I humbly suggest that you address that issue before returning to the road - or even making yourself eligible to driving again?

Sure, most of us would be pissed off by a hit and run but most of us would weigh up the risk to other road users before trying to respond. Even the police have to do that.

I really am not wanting to sound self-righteous. But I am not sure you being on the road at the moment would be quite the right thing, even if it was just for an emergency. Tin hat on, by the way.

Yes I know you said you chased someone but I was confused as to how that got you to a ban as I would assume you must have been driving dangerous to get it. I suppose it was a "little" too dangerous or you wouldnt have been banned

O o O oo

You see I dont agree with using someone who might get you off even though you did it .... if you were nicked for dangerous driving and admitted to it, you shouldn't get away with it.

Did they offer you help with your anger while driving?

That doesn't justify dangerous driving on your part. You could of killed an innocent person for the sake of "red mist" if you suffer with such anger while driving then I would seriously consider rethinking whether you drive or not. You acted irresponsible and dangerously. Will your red mist go one further where you would cause physical harm to another person that pissed you off on the roads.

. When you chased the car , did it not occur to you that the driver of the vehicle who hit you and failed to stop might not be the friendiest of people and would be unlikely to react well when subsequently boxed in by yourself .

Assuming your facts are correct it would appear that the accident was not your fault and has cost your dearly . However your other thread on not receiving the costs bill and not being aware of them does throw some doubt on the matter .

If as you say your record is spotless , I hope that you get your licence back shortly. I would just borrow an instructors car as advanced drivers need to be familiar with all modern technology . Good luck in the test and just leave the insurers or police to chase the culprits next time .

one day insurance cover

my insurance covers me to drive any cat 3rd party with owners consent

Are you absolutely sure your cover includes DOC?

It used to be pretty standard but was changed fairly recently, and now it's less common. You should double check just in case before risking it. what a lot say now is car must have its own insurance. That combined with stay insured stops people driving cars they cant afford to insure. I had a 1.1 fiesta but drove a japaness supercar. "

The Driving Other Car benefit only covers you for Third Party damage. So, if you're driving a £100K supercar using the DOC cover on your own insurance and get involved in an accident that is your fault your insurance company will be paying out fuck all for the supercar, just for whatever damage you may have caused to a third party.

Anyone letting someone else use their car on DOC is a fool. Unless said car is a bag of shit and worth nowt.

id paid for so was only my loss but someone else registered owner. That why they closed the loop hole. Because insures wouldnt take away drive other vehicles across the board. Police never liked it when stopped but couldnt do anything as had policy on me.

I can't decipher what you've just written but I was just clarifying what the DOC actually is, not referring to your circumstances.

However, as you've responded to my post I shall say that I think you should stop moaning about your plight and take ownership for your own actions, and stop bellyaching about the consequences. "Red mist" or not, no-one forced you to do what you did.

Dangerous Driving is a really serious charge. It actually carries a really heavy burden of proof.

The CPS much more usually go for the charge of Careless Driving because it's not so difficult to prove.

To proceed with a charge of Dangerous Driving it must have been a fairly clear cut case and they must have had a lot of evidence.

It's possible to kill another driver by pulling across their carriageway right in front of them and only be charged with Careless Driving, because the CPS don't think they can prove the criteria required for Dangerous Driving. The criteria are stringent and they must prove a standard of driving far below that of a competent road user.

For them to go for Dangerous over Careless it must have been dangerous indeed.

true but id rather have a true charge. And careless you dont have to be banned so with mitigating cirtcumstances. Which i didnt bother to use as would have made no difference.

like i said crap defence as i thought it was free and didnt know the fall consiquences of not paying for specialists. My solicitor didnt even tell me get my lap top back from police. Which i found out after they had no right to retain so long. Had I had my PC they would have not been able to take me to crown court. Would have hone magistrates. Where i would have got a fare trail with mitagating circumstance. My bad i lost it. Didnt let the scum get off at time. I didnt know the system. My lawyer was shit. End result im living with it. Learnt from it and just trying to sort out a short term insurance policy to use my mums car for extended driving test. I was in full control off car cause no harm. Np damage to anyone or anything. Realistically it was two minor offences and speeding and delaying other motorists.

That would have had no bearing on what you were charged with.

The CPS are wary of going for Dangerous Driving because it's so difficult for them to prove.

They must have felt they had a very strong case to try it.

They wouldn't have known when deciding which charge to bring, what sort of defence lawyer you'd have.

They considered it a clear cut case of being more than a one-off lapse of judgement by an otherwise competent driver or they'd have charged you with Careless Driving not Dangerous Driving.

The requirements to prove Dangerous Driving, as I said, are far more stringent than for Careless Driving. The CPS obviously thought they had enough to prove the more serious charge.

No you weren't . You have already said you had " red mist" and that you lose control of yourself: so you were not in control of the car either.

i didnt crash and was close calls with offender and bollards and lots of things to judge. So yes i was in my opinio. That will never change.

That would have had no bearing on what you were charged with.

You had defence lawyers before you were even charged?

Regardless, you could have changed solicitor/barrister at any time. The CPS did not decide on the charge they brought based on your defence lawyers.

You did not get charged with the more serious crime because you had poor lawyers.

No : you seem to have a basic misunderstanding of the law: you were guilty of " said charge"; because a court found you guilty .

Simple .

Yes; by definition, you were found guilty of it, so it's true.

And from what you describe of the incident, you got off extremely lightly.

Our criminal law system is by no means flawless. You did, however, confess to a "red mist" moment (which you regret) and chasing another motorist, which may (and I say may) have endangered others. You have said that you don't really wish to drive on public roads again for the time being, for which you should be given credit. You do seem to have an issue accepting that what you did was wrong. That's rubbish to suggest CPS somehow knew who your solicitors were and that's why they charged you. It is impossible for them to know simply because you can change them at any time

Also let;s be clear your 'crap defence' is not why you were charged. It had no bearing on the charges the police presented to CPS. It had no bearing on the CPS decision to go with those charges.

AS someone else has said, the bar for dangerous driving is very high and CPS will go with the lesser charge pf careless driving as securing a conviction is far more likely.

Your choice of defence is irrelevant.

You could you have changed your solicitor at anytime, probably even on the day of your court appearance. So how would that influence a CPS decision made weeks and more likely months beforehand?

there was no defence. If id employed people i would have had a defence because they hopefully would have told and helped me get my laptop back. Like mine should off done as police had no grounds to keep it. Simples really. Lesson here is pay for pros services in crown court. My friend just been lumbard with a £40,000 bill after winning a case in magistrates it then went crown where third party then won saying magistrares fooked up. So 3rd party appeal was granted and won. His now gotta pay the lot. Luckily i stepped down helping him incase i jepodised the case.

What difference does having your lapptop have to your defense in a charge of dangerous driving. Surely your defense was that 'you weren;t driving dangerously' or offering mitogating circumstances based on the circumstances. Your laptop is immaterial to that.

Or would your laptop have helped you find a legal loophole? If so it speaks volumes that that is your chosen route rather than defending your driving

video evidence from my car matched my statements and witnesses statements could have blown 3rd parties statement out the water as it was not real.

Despite me telling him the laws and that he was wrong. Then called me hrs later opologsing and canceling summonds as he was wrong i was right. Least he did call himself. Still lost me an hrs pay though.

They just seem to have it in for me. My freinds is to do with fighting the council to stop unwanted changes in our area. Thought with backing off all local councillors and bnp putting money up front. We nail it. How wrong we was. 1 person in a powful position in council will not give in and head man is arrogant and agreed to release finances to employ top level barrister.
