"Anyone else watching it?
No, but they were asking people to watch it on r4 today as it's going to a talking point on women's hour. "
It's pretty fascinating. They're showing clips to groups of male & female teens of questionable situations to see what their opinions are.
What's sad is the part where one girl's said that loads of girls have been in a position where a boy's tried it on a bit too much and they've gone along with it. |

Reminds me of a poster I seen recently. Said something along the lines of "if she is d*unk she can't consent" some one then raised a good question...... If the male was also d*unk at the time, would the police also arrest her for rape when she reports it. After all if he is d*unk then how can he consent? |

If she sat on his face, she's guilty, if he shoves his cock in her mouth, he's guilty.
Someone has to instigate sex in the first place. |

"Not always.....
I have had sex whilst I was d*unk and she was sober (designated driver) I would say it wasn't instigated by me or her. It just happend. Does that mean I was raped???? No. And if I when to the police and claimed rape it probably wouldn't of been taken very far...
Now take that situation but with the male sober and the female d*unk, the next day she regrets it and claims rape..... That bloke is gettin arrested!!!"
Did you watch the programme? |

Nope. But I'm not talking about the program. I'm talking about the poster I was reminded of when I seen this thread |

Yes there is. And some girls need to realise that. And so do the media |

i think you will find the number of false accusations of rape are most likely significantly lower than the number of genuine unreported cases because of exactly the view point your putting across
i dont in any way condone these girls who lie ... they are as bad as the rapists in some cases because they put other girls off from coming forward and ruin someones life .... but it seems like you are suggesting its pretty common for girls to feel a bit meh in the morning and cry rape .... |

I'm not saying it's common. I'm saying it happens... And I'm saying the media don't help. How can a poster that says. "If she's d*unk she can't consent" be right. Surly "if a person is d*unk they can't consent" would be better. Being d*unk alone does not make it rape, a mistake yes but not rape. Some media outlets don't put it that way
Like I said if he was d*unk also does that make her guilty of rape.... Or is that not how equality works??? |

Females don't have a penis so cannot be accused (under law as it stands now anyway) of rape. They could still be accused of sexual assault though yes.
Another thing you need to consider is that without undeniable proof sexual assault is hard to prove and most accusations of rape or sexual assault don't even get to a court of law in the first place because of this. |

I watched it and I was totally confused by the language. He assaulted her. There was no consent. His penis didn't enter her vagina or her anus and that to me is the dictionary definition of rape.
However, having done a bit of googling, it seems that your mouth is included in this definition so what I would have considered sexual assault, is apparently rape. I'm not sure when that changed or indeed if that was simply my own perception of it. Rightly or wrongly, it wouldn't have occurred to me to refer to forced oral sex as rape. So I've learnt something out of it.
It was interesting to watch the reactions and indeed the initial differences. Definitely worth watching. |

No a woman cannot rape a man.
The legal definition of rape is
1-(1) A person (A) commits an offence if—
(a) he intentionally penetrates the vagina, anus or mouth of another person (B) with his penis
(b) B does not consent to the penetration, and
(c) A does not reasonably believe that B consents.

no, oral sex is still rape. The law says penetration by the penis.
If it is the same one as I saw a while ago it was definitely rape. There was no doubt that she could not consent....if they were equally d*unk though who would be assaulting whom? |

Yes rape can only be committed by a man as it must involve a penis. There is assault by penetration which can be committed by either gender which does not involve a penis. Rape does indeed include the mouth but assault by penetration does not.
Oh and if it's penis in mouth and then vagina that is two separate counts of rape. Sexual offences act 2003 is long and detailed! |

not quite right. A woman can be convicted of rape if she aids and abets the act...eg she holds victim down or lures victim into the situation |

"That is in the 1956 act but seems to have disappeared from the 2003 act, so I think, not certain, but this would only apply to offences carried prior to 2003.
"
Funnily enough there's a case in the paper today. Mail on line.. |
