The press constantly tell me how the big corporations employ tax wheezes to avoid paying millions (billions) in tax. I think last year most of us on PAYE paid more tax than Costa Coffee
Then I go up the pub and listen to my self employed mates discussing how they book everything from a bog roll to a holiday in the Bahamas as legitimate business expenses, therefore pay about 3p tax per year
Are people on PAYE the only mugs paying there fair dues in this country?

My self employed friend lives in a million pound house and happily brags about the free dental care he receives as a low earner. Everything he buys he puts through the business so on paper he's not paid that much.
Or so he says. Problem does not lie with people like that it lies with regulation and while these loopholes exist corporations and people like him will do it.

Is it really a risk? With a LTD company the owner simply folds the firm, leaves a load of unpaid bills and a load of shafted customers and starts another LTD business in his wife's name. Where. Exactly is the risk? |

Oi I'm self employed and no way near rich ..I'm honest and been told too honest with what I tell the tax office .I pay my taxes and have always done so kindly don't label all of us the same .

I spent 3 years running an extra job, to subsidise my business whilst I was building it . I probably spent a few more, living like a tramp, whilst I was building it up.
I have paid people who work me wages even though I knew on that time, I would not be able to pay my phone bill .
You ask any self employed person the same , and they will all have the same story if they started from scratch with nothing rather than buy into a business with redundancy .
I have worked hard at what I do , I made my business myself from nothing . My success is my own doing . I have not back boned on someone else's success or even their investment .

I have quite a few friends who are self employed and, quite rightly and legally, they claim anything they possibly can as tax deductible. A few also admit that not all cash in hand transactions are declared through their accounts but, of course, I have no idea of this is true or not.
Whereas us PAYE pay in full.. and if we owe anything they're always down on us like a ton of bricks!
Thing is, life isn't fair, Fab isn't fair, the tax system isn't fair etc etc .. we just all have to suck it up and move on |

I am a Sole Trader, so therefore if my business goes bust, I am responsible for all the outstanding debts. That is a lot of risk for me. I also pay Tax and NI on all my earnings, just the same as someone on PAYE. Although I can write off certain things, just like them, I can't legitally write off a holiday to Barbados |

My old boss was fiddling tax etc.. We never saw a wage slip never got correct pay/holiday pay part of reason I went self employed .did hear through grapevine she's having a audit from tax office
If anyone is interested I've paid my ni up to date for the tax year and paid my tax bill on time wasn't much as only me in company and between work and some play I help my mum care for my disabled dad.before anyone starts mum gets carer allowance which is crap and I do it free .
Seeing both parents have always paid tax/ni carers allowance is shit esp when take into fact 24 hour job no sick or holiday pay

THIS..
This is so true. There is so much LTD company dubious activity that has gone on for decades. Apart from dodging your liabilities we have the big perk of paying your income in the form of dividends so ensuring that you pay far less tax overall.
Mr Osbourne has put a stop to that in the last budget where he increased the tax on dividends. His target was the LTD company directors who paid themselves via divis but unfortunately he is also going to hit ordinary shareholders. |

There is only so much you can legitimately book as expenses and unless your business is I travel and hospitality I am not sure that that holiday to the Bahamas would slip through unnoticed.
The self employed have always had perks, it goes with the territory. Having a "job" can have perks, depending on the job.
As a self employed person, I take advantage of every tax loophole that my Accountant identifies. As a Company Director I have a responsibility to the shareholders to ensure that the Company operate in the most tax efficient manner possible.
The Company pays CT and i pay tax on my earnings. No one can earn big money these days and not pay tax. The last budget squeezed small businesses even more meaning that from April next year small businesses will be paying even more. |

Being self employed myself, I would suggest your mates are having a laugh at your expense!
While I can claim for many things, they are only a percentage. Whilst my job can be dirty and very often clothes ripped etc, I can only claim for safety boots or related. I have heard stories of claims for washing clothes etc, but think they are just that, stories! As for holidays to Barbados? I have a job to afford a week away and if i do, I am not earning! If i am ill, I am not earning. I work 6 days a week and can certainly not afford any luxuries, let alone try to claim on them! If i tried I'm sure my accountant would have something to say on the matter! An accountant who I have to pay for. |

I'm a sole trader too, but I very rarely earn enough to pay much tax by the time I've taken non taxable materials off. I don't get any tax credits or benefits that I'm entitled to. Nor would I want to
To me being self employed means being self sufficient. |

Totally agree .saw it first hand as worked as a carer then was /am caring at home .trust me the companies charge big money and carers don't see it .I quit and started my own cleaning business ..its just me and I declare everything ,pay taxes .use to work 6 days a week 7am to 10 pm with little breaks for crap money .now work Mon to Fri 9am to 5pm and earn a lot more .not so much as some but I'm lucky to have lovely customers who when I need time off for dad don't mind. |

Also public liability
Run a second vehicle
pay into a pension
have to find my own work spend my evenings doing quotes plans and designs
No holiday or sick pay it's a hoot give it ago lol |

They won't be laughing so hard when they get glandular fever or a car accident and can't go to work. They have 6 months without any income.
While the full timer just sits at home wat hing Jeremy Kyle.
His main client goes bust - tough.... Permie gets a redundancy package.
He goes to Barbados for a holiday - he's now lost 2 weeks of earnings, add that to the cost it's a lot!! Where's permie gets his 28days paid a year - how nice to sit on a beach being paid to be there!!!

I could go on - yes being self employed has advantages, and yes when the going is good it can seem to others your living the life of Riley, but it can go bad so quickly. Your family life takes a huge toll - you don't work - you don't get paid.
No one is stopping anyone going self employed or vice versa. It's choice and it does rile me when people moan about it. Do it - if it seems that good. Feel free to think your being paid to much and don't claim any expenses, have some morals. Good for you.

Everyone assumes that you are cheating , I had to buy a new car , so people think it's a tax dodge , if I worked for someone they would have had to buy me a new company car , that's not a tax dodge
Self employed people earn more because they have to spend more to make the same money as those on paye .

It is my choice yo go self employed and for the record I'm guessing like others I've got insurance to cover illness /accidents .Ive paid into a private pension for years and you need to check your facts because of misuse a lot and I mean a lot of companies don't pay sick pay or only after so many days .my sister had to have a hysetacmy and was off work for several months .she works for a large company who like to boast about profits and did not get sick pay had to claim .

No. I get funny looks because I insist on invoices and appropriate VAT from trades too. One plumber told me I would cause him a problem as no one else paid VAT and for small jobs they were always cash in hand.
I believe in paying tax and using it well to support our services.

Those on PAYE who don't fill in a tax form every year don't have the hassle of remembering to keep a note of the tiny pittance of interest (at current rates) on any savings.
I get annoyed that I'm paying more tax than a multinational with turnover a zillion times greater than my self employed earnings but that's not a reason to not pay my share.

Whilst I agree there is a lot of this going on, it isn't completely risk free. Through my work I often getting involved with Insolvency Practitioners pursuing misfeasance claims against ex company directors. There is also the possibility of being disqualified.
I don't think much more can be done about it than already is. I would just be very dubious of people in most walks of life who have been involved in numerous failed companies |

It was my understanding that where people use a service company as long as they meet the HMRC criteria for being a contractor rather than a straight employee, the taxman will not get involved.
It's not just big earners who use them. They pretty much benefit anyone whose in the higher tax band. |

Those "perks" are allowing you access to roads, hospitals, libraries etc...that you haven't paid for. Your not paying what you should, nobody forced you to take a risk with your own business, but your happy to take in all the profits.
Oi I'm self employed and no way near rich ..I'm honest and been told too honest with what I tell the tax office .I pay my taxes and have always done so kindly don't label all of us the same .
I didn't. I addressed the comment above mine. From someone who thinks he is entitled to not pay taxes as a perk of his perceived risk.

I pay taxes here through PAYE and I pay taxes in the US (US citizens still have to file tax returns if living abroad).
I like taxes. They are responsible for great things that society does (as well as bad things, yes). I wish more people liked taxes. They certainly like a majority of what is provided to them via taxes.

You're thinking of Starbucks, who famously make a loss on paper by buying the right to use the "Starbucks" brand from an offshore holding company, therefore never showing any pre-tax profits in the UK (and therefore not owing any corporation tax).
Costa Limited paid £30M in corporation taxes in their 2014 filings (and have always paid a "normal" level of corporation tax according to their previous records, which I can no longer access for free). Their owners, Whitbread Group PLC (also owners of Premier Inn), are happy little taxpayers, and pay about a hundred million per year into the public purse (in addition to the taxes their subsidiaries like Costa pay).

The only time she spends at her house is Friday and Saturday. And her regular parties go on till gone 3am. Luckily we are no attached, though I pity her pensioner neighbours on the other side that are. |

I happen to work in a tax team for a large us multinational, and it's my job to try and get the best legal outcome for our shareholders in terms of paying less expenses eg tax
The problem is the tax legislation can be manipulated by tax lawyers / accountants |

If it's legal, people will do it. Rightly or wrongly, there's plenty of people looking for things to do to save or make money. And the ones who brag about it, well if they need to brag, that says it all. I've been self employed and it's very low risk in my experience, and I paid more taxes then than I do now. |

it is not so much the taxes that are manipulated but more the allowable real expenses of the company... and the tax is then calculated on the remaining "profit" |

I'm self employed in that I own my own company so I pay Employee NI, Employers NI, Personal tax, Corporation tax and soon to be introduced tax on dividends too. I am also taking the risk of being self employed, have no paid holidays or sickness benefits...I think I'm paying my fair share. |

I went self employed at 18...chose to pay tax and NI....was exempt because I wasn't earning enough.
Fast forward I now work for a company on PAYE, and some months get taxed £1000.......I'm a fucking hero of the British people |

Being on PAYE doesn't make you a hero. Being self employed doesn't make you a villain. You can't start linking the actions of self employed people to the apparent failings of the NHS. There are far more significant contributing factors which limit NHS resources. |

This was never a thread about PAYE v self employed. It was about tax avoidance. Legal or otherwise
Its an issue of morality, as one of the previous posters out so eloquently.
We all want our children to receive the best education, the best medical care, and to grow up in a safe and secure society. This all needs to be paid for. We all have a moral duty to pay what we can.
Maybe the next time a Starbucks store catches fire they wont mind putting the fire out themselves. Maybe the next time a tax avoiders child gets run over they wont mind waiting two hours for an ambulance to arrive because its busy attending to the child of someone who has paid for the service.
We all know it wont happen because the honest people in society will continue to fund the dishonest

Rant over" . If you are self employed you can only book legitimate businness expenses against tax . If as you say they are paying about three pence tax per annum they are most likely to be flagging themselves up for an investigation by HMRC . The penalties for making mistakes on a tax return can be quite draconion and in the case of fraud you are likely to end up in prison . HMRC can also go back for twenty years in the the case of serious investigations .
Do you know that you friend pays no tax or is that just a guess ?.
You are confusing Costa Coffee with Starbucks ..In any event Starbucks pay over substantial amounts of VAT to HMRC ..

Not if your a multi national though!" . The tax laws apply to everyone and HMRC have recently concluded a long running case against Vodafone .
In addition shareholders in companies , the majority of whom are pension funds , will expect companies to organise their businness in the most tax efficient manner possible |

Its true that LTD company ducking and diving can make you wealthy as can being self employed but being self employed you have to pay your own NI, do all your own accounts, be answerable to HMRC, if your off sick you dont earn, sort out your own pension etc..
I suppose they key thing is,, if you have a decent job that pays a good rate,say right up to the limit of basic rate taxation (so in 2016/17 you can earn upto £42,700 before slipping into a higher tax band), you get looked after by your employer, they pay into your pension pot etc etc,,then why would you wing it as self employed?
True if you had the potential to earn a lot more then you could duck and dive trading as a LTD co to pay less tax, but that option is disappearing..
If you could only get a job for say less than 20k pa,,well you might fare better on the black economy or self employed again depending on your skillset. |

Sorry but I don't agree at all. Avoidance is legal. Evasion is illegal.
Every single employed person is doing some sort of tax avoidance. Do people on 15k a year pay 40% tax?? no - because the system allows then not to pay 40% until they hit a certain threshold. Uniform allowance? Pension schemes etcetc etc.
So all those people should not get the same healthcare as you say if their children get run over???
If there is a loop hole there you can't blame people for going through it - everyone does!!
Moan at the person making the rules, not the person abiding by them, whether it is unpalatable to you or not.
As already said, tax evasion will usually see you going directly to jail.
