drink driving question

had a conversation with friends about if you have your car keys on you, you can still be booked for drink driving.
got us wondering about how you go on if in a motorhome in a pub carpark for the night??
we have red about people sleeping it off in a car and being booked and arrested as they were technically in control of the vehicle, but surely its the same thing in a motorhome.
what do you think the law says about this?? |

It depends on the police officer and circumstances:
Attempting to enter the car, having its keys or being near enough to the car for any police officer to make a presumption of driving are all circumstances which could be tested in court but each case depends on particular circumstances.
There are other areas of the drink driving law, which are open to interpretation such as someone who is unfit to drive sitting in their car smoking a cigarette without it being driven or being asleep in it without the ignition keys.
With regards to motorhomes:
I don't think you need fear if you are on a campsite or even on private property. It could be more problematic if you were parked for the night at the side of the road in a layby or perhaps in a carpark where you could be required to move on by the police. |

Can't be done for having keys on you. You need to be in the vehicle.
The motorhome sets a bit of a dilemma tho....?

Doubt it would stick if the engine was cold tho..... Probs same with a car...if you were sleeping it off in the back.
But remember that just over 60% of drink drive convictions are the morning after......so sleeping off may not work. That's why the new poster campaign in pubs focuses on morning after driving! |

If you're caught d*unk, in a car, with keys in your possession, you'll be done for d*unk driving. If you're sleeping it off in the car, you need to leave the keys outside - put them on top of or behind one of the wheels.
If they are in your pocket on in the ignition, you'll be done.

but if you walk to your vehicle in the pub carpark with your keys on you, then technically you are able to drive it away, so therefore, breaking the law (technically) |

You can be done for drink in charge
But it is about intention to drive, close the cab off put stuff on front seats cover the cab windows, put, chocks on and under no circumstances no matter how much a copper protests don't move it,
I wild camp on road sides and laybys and will drink, have never been questioned by police in 8years, make sure it's parked in a safe location and make the van unable to drive (without a lot of work) and your generally left alone
Not saying it's a guaranteed fix as said the officer is a big factor but works for us,
on a site you are free to drink though |

I'm not asking about actually driving, I'm asking, Say you had permission from the landlord to park overnight on his pub car park, and he said it is ok, you then have a few beers in his pub, where would you stand regarding the law when you went back to your motorhome to go to bed/sleep |

Campervan - as long as there is no intention of driving then you're perfectly fine to drink in it - ie, slippers on, bed made up etc
You can not sleep in a car whilst under the influence of alcohol even if there is no intent to do so - you can be charged with "being d*unk/under influence whilst in charge of a vehicle" even if the keys are in the foot well or in the glove compartment & engine off. |

Its a grey area im a long distance lorry driver technically you can be charged as you have keys in your possession on the other side of the coin its also your home so you allowed to drink alcohol in home same rules apply to me |

i was told if your inside a car with keys and pissed you get done, but a motor home if your in the back it is classed as a home, it is a grey area, i think the law should state if your in driving seat over the limit then get done, as a prev post put keys on wheel arch but you had to use key to enter car first, cant win |

I'm not asking about actually driving, I'm asking, Say you had permission from the landlord to park overnight on his pub car park, and he said it is ok, you then have a few beers in his pub, where would you stand regarding the law when you went back to your motorhome to go to bed/sleep"
If I had a motor home I would not park it in pub car park
I think if your in your vehicle and d*unk you may make a wrong decision if under pressure
I would not risk it best thing If you want a drink get a taxi |

A lot of country pubs allow motorhomes to stay in their car-parks overnight. It can be great fun if part of a tour - we did Cornwall like this. One pub was owned by a retired policeman - he told us that as long as the keys weren't in the ignition and the stabilisers were down we be would fine. Never had a problem. |

been told that a motor home is exempt as the front is motor and rear is home, i think the law should only apply if keys are in ignition, as if you was at home drinking and your car was on street and you went to get something out of it is that d*unk in charge |

I would not drink so it does not matter
Personally i think those sleeping in motorhoms should lose their licence like the people in cars |

Safety in numbers helps as well. If there is a few vans parked you are generally more likely to be left alone
Did a walk on rhyl front sat night, splash point to cinema I counted 28campers, high numbers due to the air show but they did look cool,
No worries about drinking with that many about, |

hmm, so if I unlock the car with the remote, open the boot and lock the keys in the safe, then close the boot, get in the back and lock the car with the central locking, wonder how that'd be interpreted? (don't have the keys accessible and hadn't entered the passenger space while I did have them...)
For a camper van it'd be fine, you "live" there, plus there's usually a seperate door into the "home" part  |

Although it is possible to be charged with being d*unk in charge.
If it is clear you have no intention of driving whilst d*unk the courts would dismiss the case.
Otherwise every person who owns a car could be charged with being d*unk in charge whenever they got d*unk; think about it.
If however you are sitting in the front seat of the vehicle and have the keys in your pocket there is no reason to believe you have no intention not to drive and you would be convicted. |
