Are Blurred Lines, by Robin Thicke and Got to give it up, by Marvin Gaye, the same song?
Well a Jury in LA, thinks it is and have awarded the Gaye family $7.4 million.

The song as a whole sounds very different. It sounds like a sample thats been altered. You cant trade mark a style of music. The jury didnt even hear the full song. Ms gaye was hammimg it up for the cameras though, made me cringe |

Let's say you have an idea to cut costs at work. Someone overhears your idea and thinks it's good. Some time later they have a brainwave. However, it's very similar to yours. They've left out some bits and added a few new ones but basically it's your idea. They then get a bonus based on it thereby making money from what is, essentially, your original idea.
They argue it's all their own but clearly many parts of it are lifted straight from yours. Shouldn't you be allowed some compensation for that? After all, THEY made money from it. |

Can understand why the musicologists have reached this decision.
There are not only striking harmonic similarities, (bass line is very obvious), but the rhythmic syncopations are pretty much the same.

The bass line is lifted note for note and the tempo and syncopation is identical.
Yes, they've overlaid a different melody and lyrics, but to claim it as a totally original composition is just blatantly passing off and copyright infringement.
Speaking as a musician (one that plays instruments, not a studio cut and paste merchant), I think the panel got it entirely right.
Currently, the track can no longer be sold until a resolution on the split of future profits is worked out. 50/50 would seem about right to me.

It has actually, several times - Richard Ashcroft, George Harrison, Led Zeppelin to name but a few notable ones.
Often though, using samples or using parts of a song are done properly, in negotiation with the copyright owner, for a share of the proceeds. |

Doesn't sound like the same chords, melody, or words.
Sounds like a similar drum pattern.
Quite how that is enough to prove plagiarism is a mystery, but I haven't seen what evidence was presented in court. |

It is exactly the same intervals, with the same stepped bass line between them - I think it's even in the same key, but A/B'd it to check. The Thickie version doesn't do the turnaround that the Gaye one does, Thickie simplified it in that respect, then he and Pharoah put a different melody line and lyrics on top.
I'd guess that in court they'd play sections of the two songs back to back and A/B.
Anyone who has a musical ear, or is a musician, will hear immediately that the underlying bas line, is identical, thus the verdict, which as I've stated (as a musician) I consider to be entirely fair |

I think the only fair way to compare Marvin Gaye and Pharell is to compare them to a wank and a wet fart...........one is gratifying and enjoyable.....the other is embarrassing and some what uncomfortable to listen to. |
