Hi all just wanted to ask about something.
when you been working at your job for a month and get fired because they aren't the person for the job, do you get the wages normally via the bank or do you get a cheque or does it depend on the company?
Basically my boyfriend's wages didn't go into his bank account this morning, and we got rent etc going out on Monday, so far we are Panicking. |

Maybe his start date meant he missed the first payroll and won't be paid until the next pay cycle?
That's not uncommon in a new job.

Depends entirely on the company - but most payrolls are run a couple of weeks before payday. The company can contact their bank to stop a particular bacs payment - your best bet is for him to ask them!

If it is normal time for him to be paid it shouldbe. AAlso it should be in the agreed form ie bank or cheque.
Instead of panicking just call and ask there may be a legitimate reason. |

So far as I'm aware you are still paid up until the point of dismissal - unles it's for theft/fraud etc where there has been financial loss to the business.

Yes,depending on why someone was dismissed,if it's serious gross misconduct then a company can withhold any monies owing, if it's for something like poor attendance, time keeping such like where you've had various warnings leading to dismiss then normally they will pay, |

He got fired because he is the right guy for the wrong job or whatever that means.
Basically his boss hired him thinking he was a senior PHP developer and he isn't.
His boss shouldve read his C.V |

The chances are he will be paid at the end of the day as he would have worked the week required. I would tell your man to chat to the boss and get a direct answer so you can put your mind at rest and make plans for shortfalls. Please do not panic I til you have had the conversation. It is all heresay til that point |

When is the due date for payment? They may be withholding until the end of the week they have asked him to work. When people get fired they sometimes stop coming in, especially if they have already been paid.
His contract should state what the notice period is during the probationary period. It's usually one or two weeks unless both parties agree to waive this.

It is not unusual to miss the payroll deadline for new employees, and instead pay them 2 months salary a month later. Many firms have systems for discretionary payments beforehand.
However, depending on when his boss took the decision, he may not even have been entered on the formal monthly payroll, and the plan instead is to issue a cheque.
There is no compulsion for said cheque to be issued today however, hence the need for him to speak to his boss and for you both to start planning for the worst.
Speak to your landlord today and warn him. Assuming you are not already massively in arrears you are in no danger of losing your home. Most landlords will be understanding, and will be grateful of the warning themselves.
(Your landlord may have bills of his own, and also be relying on your rent)

Yes.
A firm can withhold payment for any reason they see fit, and offset it against any costs they incur.(eg re-advertising the job)
Whether or not this is fair, or if a court would back them, is unfortunately largely irrelevant.
(When I was 18 I lost a weeks wages for not giving the correct notice)
However, this doesn't sound likely in your case OP.

He got the job on 23rd of December, then broke up for christmas on the 24th lol started work properly on the 5th Jan but they said they'd give him his wages today and they haven't. |

If it was me..I wouldn't give a fuck when company policy was to pay me.
If they want to fire me within a month I'd be demanding payment now.
I've been suspended before but never fired.
My last job I had before I quit to run my own business I was there 5 years. |

I hear what you're saying, but if it isn't in the bank now, then it probably won't be on Monday. BACS transfers would likely all be on the same day.
They may claim they withheld it to make sure he worked today, but will argue today doesn't finish until 5pm.
Either way, don't panic, all will be fine eventually, and it sounds like he's well out of it.
But warn the landlord.

What does his contract say? What are the terms of his probation?
I know up here they can withhold monies to cover re-advertising the job if the probationary period is deemed a failure, or to recoup any fair costs (uniforms etc)
Hope he can get it sorted.

Basically he started the job beginning of Jan, he was promised no probation period etc...
However after working there for a few days they dropped a bombshell.
The boss will get 15 grand if he does this website for a posh restaurant, if he gets it done on time he gets the job, if he doesn't then he loses his job...
He's not the only guy who works on the project, he works along side with someone who has OCD, and due to the guy having OCD he has never finishe a project on time.
So whatever my boyfriend does to the Module, the guy with OCD deletes my boyfriends code and puts his own code in place.
Therefore making my boyfriend falling behind.
My boyfriend was up for 39 hours last week, worked on the module all weekend from home using a web programming programme.
On Tuesday he had a meeting and saying they're goin to have to let him go because he hasn't finished the project.
I know that probably doesn't make sense but that's what it is in a nutshell. |

don't bother with ACAS .... they won't be interested unless you've been employed by the firm for the statutory period of two years. if less than this they will just say you have no employment rights."
